On the evening of the 10th inst., Meshack Slaven and Daniel Pennington, brother-in-law and near neighbors, had a personal difficulty. Slaven came up to Pennington's house and rested his rifle upon the fence and fired upon Pennington in his own house, but without effect. Pennington returned the fire with a pistol, the ball taking effect in Slaven's shoulder; whereupon Slaven fled. Pennington walked out a short distance from his house and sat in the bushes, and a few minutes later he was shot by someone, supposed to be the brother of Mr. Slaven, who was near by when the difficulty occurred. The following article apppeared in the Scott County Call, 24 Jun 1887, Helenwood, TN, Vol. I, No 14.
"In July 1872 a man by the name of Dan Pennington was killed in the third District of this county. A bill was found by the Grand Jury against Steward Slaven, who left the county immedicately after Pennington was killed. In a year or so, Anderson Lewallen, who was then living in that part of the county, moved to Texas. Last month Mr. Lewallen, in company with his brother-in-law, Elihu McDonald, came to this county. After they had been here some time Lewallen was arrested, accused of murdering or helping to murder Dan Pennington. Monday the 20th inst., the case was called, Esqrs. Sharp and Griffith presiding. Both sides announced ready for trial. A number of witnesses testified. Among them was the then wife of Dan Pennington, who said she was a sister to Steward Slaven and that he was the man who killed her husband. Before her husband died he told her he saw Steward Slaven run after he (Pennington) was shot, and knew him. Other witnesses testified that before, or as Steward Slaven was leaving the ocunty he said they need not bother his brother becase he (Steward) killed Dan Pennington. Mr. Lewallen testified that he stayed in the country for a year after the killing and was never accused of it. It was very clear that Lewallen was innocent. The decision of the court was "not guilty as charged in the warrant." The prosecution must be satisfied, after hearing the evidence, that Lewallen was wrongfully accused."

    Directions to Cemetery:
    Hamby/Spradlin Cemetery
    Oneida, Tennessee

From Oneida take the Big Ridge Road to Fosters Crossroads and turn NE towards Cottonpatch Knob. Continue past the Lucy Boyatt place 2.0 miles from intersection with Big Ridge Road before you come to the church. After passing the Taylor farm and head of Williams Branch turn right on road to the cemetery while still in Tennessee. The cemetery is about one-tenth of a mile south of the KY-TN state line in Tennessee and almost due south of of Cottonpatch Knob in what is known locally as the Old Spradlin Fields.

At one time the people in this nearby Tn. area went to school in Ky. The area is about 2 miles from the mouth of Bear Creek in McCreary Co. on the Big South Fork of the Cumberland.

There are 13 unidentified graves at this cemetery.

I have in my files that Barzilla (Phillips) Slaven was born 4 Sep 1848 in Scott County, Tennessee, died 9 Dec 1922 at Odon, Daviess County, Indiana. Barzilla's obituary states she was living with her son James a mile west of this city (Odon, Indiana). Barzilla is buried in Walnut Hill Cemetery, Odon, Indiana.
In my file I have that Barzilla's parents were Thomas Phillips, born about 1832, and Racheal West, born about 1833. Don't have any documentation for this entry. I could kick myself from here to yonder that in the earlier days of searching I did not enter documentation but that is now gone by.
    ********************************* *****************************************
Barzilla's obituary was in the Dec 15, 1922 edition of the "Odon Journal" newspaper, Oden Indiana. Copy of paper furnished by Lou Butler: LouButler@aol.com
    It reads:
    ********************************* *****************************************
    DIES OF HEART TROUBLE
Mrs. Barzilla Slaven aged resident of the community passed away at the home of her son James a mile west of this city last Saturday, her death being due to heart failure. She had been in fairly good health and when stricken passed away very suddenly her death coming as quite a shock to her friends and neighbors.
Barzilla Slaven was born in the state of Tennessee, Sep 4, 1850; and departed this life Dec. 9, aged seventy two years.
Shortly after the close of the Civil War, she was united in marriage to Jefferson Slaven and to this union nine children were born, two dying in infancy, and one daughter, Emerine, passing on at the age of seventeen years. This union was severed fifteen years ago when the husband and father answered the final summons.
Mrs. Slaven united with the Baptist Church when she was seventeen years of age, and when she moved to Indiana in 1913, she placed her membership with the Christian Church at Newberry. She was faithful in the discharge of her duty to her Lord as long as her health would permit, and as long as she could attend the services of the Church.
She leaves to mourn her going, two sisters, Peggy and Ferbe, three sons Absalom, James and Emanuel and two daughters, Tabitha and Elizabeth. She also leaves forty-seven grandchildren, and thirty great grandchildren. She was a kind and loving Mother, and will be cherished in the memories of all who knew her.
The funeral service was held from the residence Monday afternoon at two o'clock with Rev. R. T. Gwyn in charge. Burial was made at Walnut Hill cemetery.
    ********************************* *****************************************
I note there is a discrepancy between my record and the newspaper account. I have Barzilla born in 1848, and by computation of the dates, died 1922 at age 72 would compute birth year as 1850.

EMail from Robert Slavey [rcw@clever.net] 2/1/1998
In the pension file, she writes (on Dec 8th, 1916) "I was born Sept 4th 1846". But, she also writes "So, it seems like I am 70 years old. That is the age that I think that I am." Also, she appears before a notary on 4 Aug 1908 and states her age as 59, which would put the year of her birth as 1849. It seems that she was a bit confused about when she was born.

The confusion also extends to her marriage date to Jefferson.
On August 4th 1908, she has the marriage date as 26 May 1866.
On Dec 31, 1908, she says they were married on 26 May 1867.
On Dec 8, 1916, she has the marrige date as 26 May 1864 (Jefferson was enrolled in the military from Fe 1864 to April 18 1965, so this may have been problamatic)
Sometimes I feel that no one born before 1900 knew for certain when they were born or married :-)

She lists her siblings (all with the surname Phillips) as:
    Peggy Ann
    John
    Pherba
    Ewel
    Tabitha
    Emma

Andrew B. Slaven. He lived in Wayne County and listed on the census in 1850 with
    Ann(50)
    Nimrod(20)
    Jane(15)
    Granville(10)
    Lynn(7)
Andrew married Mary Ann Winchester in 1852,they had 5 children, she died in 1858. Andrew was a constable in the same time frame.
In 1850 Andrew was 25. The listing just before this is Alexander (27). I believe this is Andrew's brother.
I would like to know if there is anyone who has any info stating who Andrew belongs to. My dad always said Andrew's father is a Richard Slavey. Andrew married a 2nd time to Edith Susan Hill (Suckey) in 1871 they had 5 children, he died in 1896.

    hi, becca

i hope this letter finds you well. i wanted to tell you that fred smith, son of john (hawk) smith, is the one that shot and killed my husband's greatgrandfather, newt blevins. this was such an interesting family to work on. it took me 3 years to find out who newt's parents were. i do have a picture of newt with his wife and children. do you have a picture of your fred smith. i would love to exchange photos by mail, regular mail. that is if you have a photo of fred. newt was married to amanda ruth smith, daughter of william smith and sarah slaven. newt blevins was illegitimate along with his brothers and sisters. his father was richard slaven and his mother was litha blevins. richard and litha married at the age of 62 after richards wife died. this is wonderful story and family. newt served time in prison, due to the killing of william(dick) hatfield. newt's sister was married to william's brother, harmon. if interested, please let me know.

    thanks,
    nancy

Daniel was murdered in a family feud shortly before the birth of his son, William. He was supposedly shot by Steward Slaven.

From Scott County TN Obituaries, 1850-1889, published by the Scott County Historical Society
"A Man Killed in Scott County"
Before her husband died he told her he saw Steward Slaven run after he [Pennington] was shot, and knew him. Other witnesses testified that before, or as Steward Slaven was leaving the county he said they need not bother his brother becase he (Steward) killed Dan Pennington.

I am looking for the parents of Newton Blevins b. 1878 either in TN of KY. He married Amanda(Mandy)Smith 1899 in Scott County, TN.I would like to know her parents also. Newton was a moonshiner. Newton Blevins killed William Clayburn Hatfield in 1924 in Scott County, TN. He was charged with involuntary manslaughter. Newton Blevins was shot and killed at his home either by Sherman Litton or the Smith's. Uncertain. No one was ever charged. I was told by Gar Blevins that lives in Jamestown, TN that it was the Smith's. A newspaper says that the hounds kept ending up at Sherman Litton's home. Newton and Amanda's children were: Tilden mar. Sarah(last name unknown and she died 6 months into the marriage),then he married Charity Wright(daughter of Will Wright), Tilden Blevins , along with Math Burk and Baty Burk were charged with assault with the intent to kill, Virgil Smith in 1926. Florence,I don't know what happened to her, Sarah died at age 14 and is buried in the Chimney Rock cem., Victoria died as infant and also buried in the Chimney Rock cem., Richard Austin married Geneva Byrd, Ida married Melvin Crabtree, Hattie married Walter Wright(son of Will Wright), Nettie(don't know what happened to her), Harve(died young, never married), George, Frank married Ruby(last name unknown), Hugh(don't know what happened to him), and Virginia(don't know what happened to her). Amanda Smith Blevins married Will Wright after Newton was killed. This is all I know. I have tried everything to find his parents. I need someone who is maybe related somehow to let me know who he is and where he comes from. I have found a Newte Blevins b. 1878 GA living with Richard Frank Tittle on the 1900 TN census. i don't know if this is him or not . He is the only Newton born at the same time as my Newton, but i still can't find him on an 1880 census. I am guessing that his parents were moving at that time, so I have a loose end that has no connection. Please help!!!!!
    thanks to all,

    15. JOHN HAWK5 SMITH (SAMUEL4, SARAH3 SLAVEN, RICHARD HARVE2, SLAVEN1) was born 1867.

    Notes for JOHN HAWK SMITH:
    From Tracy Honeycutt-Hall
    Debbie,

Here is the story on John J. Smith.

    JOHN J. SMITH
Probably one of the best known and
most colorful characters who ever lived on
the Big South Fork was John J. Smith, my
    great-grandfather, who was more commonly
known as John Hawk to his friends,
For over thirty years, John and his family
lived on the east bank of the river, about
    four miles downriver from Leatherwood
Ford. Many of his descendants still live in
    Scott County today.
Born near Station Camp on December
9, 1866, John was the son of Samuel and
Sally Smith. Sam (1842-1918) , was a Civil
War veteran who had been raised on Laurel Fork,
the son of Anderson and Sarah
Smith. They were some of the first known
settlers that ever came into this region,
and the first known Smiths. Sally (born
1836), was the daughter of Elijah and
Nancy Smith, another set of Smiths that
lived near Station Camp. Sam and Sally
    raised eight children, James (1858.1933),
Nancy Jane (born 1859), William (1860-
    1931) , John (1866-1949), Anderson (born
    1870), Dave (1871-1913), Elijah (1872.
    1899), and Polly (born 1875).
In 1886,John married Polly Ann Blevins
(1868-1942), the daughter of Diancis and
Sarah Koger Blevins of Rock Creek. When
John and Polly were first married, they
moved to a farm on the Tennessee-Kentucky state line,
    just north of the present
day Pickett State Park. Here, they began
raising most of their family, which included
    12 children, Jake (1887-1971), Nancy
    (born 1889), Alford (1891-1970), Lady
    (1893-1963), Betty (1894-1984), Henry
    (1896-1933), Anse (1899-1934), Fred
    (1901-1969) ,Sam (1907-1981) ,and Conellan
(1913-1982). Two other children, Jessie and Sally,
    died in infancy.
In 1915, John moved his family to a farm
on the Big South Fork, just below the Bill
Branch. Here, they farmed both sides of
the river and raised sheep, cattle, and
hogs. John also built and operated a black-
smith shop in Oneida. He and his boys
were perhaps best known, however, for the
moonshine whiskey that they made up un-
der the high river cliffs. Anyone who was
ever at the old John Smith place will also
remember the huge fish trap dam that
they had built across the South Fork.
Johns family met with a great deal of
tragedy during the years that they lived
on the river. On April 30, 1933, Henry was
killed in a gunfight with a man he was at-
tempting to arrest at Hazel Valley. A short
time later, Bettys only son Floyd was shot
and killed by an unknown assailant while
in a boat at Station Camp. He was only
17 at the time. In October of 1934, Anse
was trapped in a mine cave-in at Zenith
and was killed. Then on July 9, 1937,
Alfords son Everett was accidently shot
and killed by his best friend.
In 1913,Johns second oldest son, Alford
    (my grandfather), married Nancy Burke
(1895-1925), daughter of Ike and Mary
Burke of No Business. They moved into
a log house about two miles downriver
from John, and Alford soon went to work
on the new 0 and W Railroad, which was
being constructed from Oneida to Jamestown.
They began raising five boys, Everett,
Claude (my father) , Lonnie, Clay, and
Leon. On February 8, 1925, Nancy died
suddenly after racing her little brother
down a hill at Alticrest, where they lived
    at that time.
Alford later moved back to the river and
built a house close to his Dad on the west
side of the river. He married Elva Choate,
daughter of Ike and Mattie Choate of Pop-
lar Cove. Together, they had 9 children,
Ruth, J.D., Herbert, Archie, Edna, Arvilee,
    Ralph, Milford, and Mildred. Alford
was an avid sportsman who spent every
spare moment hunting, fishing, and trapping.
When World War II began to break out
in the early 1940s, four of Alfords boys,
Claude, Clay, Leon, andJ.D., all joined the
service and went off to war. Claude was
in the first boat to land on Utah Beach during
    the Normandy Invasion on D-Day,-
June 6, 1944. He was wounded several
days later near Cherbourgh, France. Clay
was in the North Africa campaign and the
Anzio Beach assault in Italy. He was later
captured by Germans while crossing the
Rhine River on a night scouting patrol.
Leon saw much heavy fighting during the
Battle of the Bulge, and was in the honor
guard for General George Pattons funeral
in Luxemberg. J. D. was in the Air Force
    and served in the Philippines.
On November 23, 1949, John Smith died
at the age of 82 at the home of his son Fred
at Black Oak. He and most of his family
are buried at Hazel Valley. Many people
have said that there probably wasnt a
man in Scott County who helped feed and
shelter more people in need, then John
    Smith did.
    Recently, the National Park Service
placed a historical marker at the site of
John Smiths old home on the river. That,
and a few old rock chimneys and grave.
stones, are about all that is left to remind
visitors today of these generations of
mountain people who pioneered this wild
river wilderness. Submitted by: David Neal
