    (Mackenny) We being summoned by the Sheriff by virtue of an order 26 May 1708 in an action of trespass between William Robinson by John Wellingto his prochin amy and George Brown, and having met on the land and being sworn by John Bushrod, Gent., to lay out the land in dispute with Thomas Thopson, surveyor, we did not find George Brown a trespasser.

    • Note:
      The land William and Jane occupied was almost certainly property that originally belonged to Thomas Gerrard. In several later land transactions, it is clear that the land held by Gerrard descendants is adjoining to the McKinney land. See: land subject to suit between Gerrard McKinney and William Gerrard 3/25/1735, which states the land in dispute was obtained by grant from Richard White 11/26/1670. See: land sold by William Edwards to Daniel McKinney, 3/4/1783, which states that Edwrds obtained his land from Nathaniel Gerrard, son of William Gerrard. See: land sold by William McKenny to Gerrard McKinney 11/27/1750, which adjoins Gerrard's land. See William McKinney 11/30/1749 land referenced as next to Osmond Crabbe.

      All of this suggests (1) William, Gerrard, and Daniel McKinney had adjoining lands; (2) these lands adjoined those belonging to the Gerrards; (3) they also adjoined those belonging to Osmond Crabbe.

      Note also that Osmond Crabbe is Temperance Gerrard's son, so both of these lands may have been obtained from Temperance's inheritance.

      To all People to whom these presents shall Come, We Willm and Jane Makenne do Send Greeting. Know ye that we thus: Willm and Jane Makenne of the Parish of Copley in ye County of Westmoreland for and in Consideration of Love and good Will affection &c. we have twoards our Loving Sons Garrard John and Daniel Makeney Have Given Granted and by these presents do freely clearly and asolutly Give and Grant unto ye aforesaid: Garrard John and Daniel Makenne their Heirs for Ever Lawfully begotten two hundred acres of Land and ye Plantation whereon We now Live to be equally Divided betwixt my aforesaid Sons Garrard John and Daniel With those presents We have Delivered the aforesaid two hundred Acres of Land and Plantation to our aforesaid Sons and their Heirs Lawfully Begotton for Ever. Should one of my aforesaid Sons Die without Lawfull Heir that part Possessed shall be Equally Divided betwixt ye other two. Should two Dye without Heir ye aforesaid Land shall be Inherited by him or his Heir that is Living for Ever. We also give free privilege to Either of our aforesaid sons to Sell, Morgage or Bargin that part of Land they are possessed with to each other their Heirs &c. In Witness whereof We William and Jane Makenny have Reason to set Our hands and Seals this 29 Day of March in the Year of Our Lord One thousand Seven hundred & thirty two.

Deed mentioned Which at the instance of The said William Makenny is admitted to Record.
