is the last Will and Testament of me William Coltman of the Borough of Chepping Wycombe in the County of Buckingham Gentleman whereby I direct all my just debts funeral and testamentary expenses to be paid and satisfied as soon as conveniently may be after my decease I give and bequeath unto my dear Wife Frances all and singular my household goods and furniture plate linen china apparel books pictures and other effects of a like sort which may be in and about my dwelling house at the time of my decease to and for her own use benefit and disposal and I hereby direct that my Son John Tobias Coltman shall be permitted to rent and occupy the yard shops garden and premises now in his occupation and also part of my dwelling house during the life of my said Wife paying and allowing unto her as he now does to me for such use and occupation the [rent] or sum of forty pounds per annum and if at any time my said wife shall cease to reside in and occupy part of my said dwelling house and the whole thereof shall be used and occupied by my said Son John Tobias Coltman then I direct that he my said Son shall pay and allow unto my said Wife the further rent or sum of twenty pounds per annum And as to all the Rest of my Real and Personal Estate and Effects whatsoever and wheresover I give devise and bequeath the same unto my said Wife my said Son John Tobias Coltman and my friend Thomas Wheeler now or late of the Stock Exchange London and formerly of Chepping Wycombe aforesaid Banker and the survivors of them and the heirs executors and administrators of such survivors upon Trust to receive and take the rents ? and profits interest dividends and proceeds thereof and pay and apply the same unto or to the use of my said Wife for and during the term of her natural life And from and after her decease then do trust that they my said Trustees and the survivors of them and the heirs executors and administrators of such survivors do and shall as soon as conveniently may be sell and absolutely dispose of my said Real Estate either by public auction or private contract for as much money as can be reasonably obtained for the same And as to the monies arising from such sale or sales and from the [residue] of my Personal Estate and Effects I direct that my said Trustees shall [stand] and be possessed thereof on Trust to pay and divide the same equally between and among my Children John Tobias Coltman, James Coltman, William Coltman, Mary the Wife of William Henry Hayden and Henry Coltman and my Grandchildren Frances Matilda Abbott and Frances Mary Knight share and share alike provided always and I do hereby declare that in case any or either of my said Children or Grand-children shall depart this life before he she or they shall receive the share coming to him her or them under this my will leaving issue lawfully begotten then and in such case the share of him her or them so ? shall go and belong to such issue share and share alike if more than one and if but one then to such only child And I do hereby authorize my said Trustees and the survivor of them and the heirs executors or administrators of such survivors to advance whenever they or he may see [occasion] to either of my said Children or Grandchildren any sum of money not exceeding two hundred pounds on account of and in anticipation of the future share of such Child or Grandchild provided my said Wife [consents] thereto in case she shall be living and is satisfied that such advance will be for the benefit and advantage of such Child or Grandchild to whom the same may be made provided nevertheless that upon such division as aforesaid after the death of my said wife my said Sons John Tobias Coltman, James Coltman and Henry Coltman having during my lifetime severally received the sum of two hundred pounds and my said Daughter Mary Hayden having also received in my lifetime the sum of one hundred pounds and my late Daughter Frances Mallows Coltman having in my lifetime received the sum of fifty pounds I do hereby direct and declare that the said John Tobias Coltman, James Coltman, Henry Coltman, Mary Hayden and Frances Matilda Abbott shall severally receive so much less on such division and that the said sums already received by the said James Coltman, Henry Coltman, Mary Hayden and Frances Mallows Coltman shall be deemed and taken to have been paid in anticipation of the future shares of the said James Coltman, Henry Coltman, Mary Hayden and Frances Matilda Abbott And I hereby further order and direct my said Trustees and the survivor of them and the heirs executors and administrators of such survivor before proceeding to a sale of the messuage or tenement and premises now in the occupation of myself and my said Son John Tobias Coltman and situate and being in the High Street of Chepping Wycombe aforesaid to offer such messuage or tenement and premises to my said Son at a fair and proper valuation thereof (the goodwill of any business which may then be carried on therein by my said last mentioned Son not to be taken into consideration or included in such valuation) and in case my said Son John Tobias Coltman shall elect to take and purchase such messuage or tenement and premises at such valuation then I [declare] that the other Trustee for the time being shall have full power legally and effectually to convey and assure the same to my said Son John Tobias Coltman and the receipt of such other Trustee shall be a good and valid discharge to my said Son John Tobias Coltman for the purchase money in such receipt mentioned to be ? provided always And in case any or either of the Trustees of this my will shall die in my lifetime or shall refuse the [trusts] or become incapable or unwilling to act [then] I empower the surviving or continuing Trustees or Trustee of this my Will or their or his executors or administrators or the executors or administrators of the last surviving or acting Trustee by any Deed in writing to appoint any person or persons in the room or [stead] of such deceased refusing retiring or incompetent Trustee or Trustees and every Trustee so appointed shall be fully competent to exercise all the powers and discretions which are ? osed in the hereuntofore named Trustees of this my Will And as to any other said except such last mentioned receipts of my said Trustees or Trustee or such newly appointed Trustee or Trustees for the time being of this my Will shall be good and valid discharges for the sum or sums mentioned therein And that it shall not be necessary for any purchaser or purchasers of any part of my said Estates to see to the application of the monies mentioned in such receipts nor be accountable for the application of the same or any part or parts thereof provided also and I do hereby further will and desire that my said Trustees shall be charged and chargeable only for such monies as they shall actually receive notwithstanding they or he may give or sign any receipt or receipts for the sake of conformity And that either of the said Trustees shall not be answerable or accountable for any Banker or Broker or any other person or persons in whose hands any part of the said trust monies shall be deposited or entrusted for safe custody or otherwise and that they or either of them shall not be answerable for any misfortune loss or damage which may happen thereto in the execution of the trusts of this my will or in relation thereto except the same shall happen through his or their wilful default respectively and then such person shall alone be answer- able for such loss And also that it shall and may be lawful to and for my said Trustees or Trustee their or his heirs executors and administrators by and out of the said trust monies to [deduct] retain and reimburse themselves and himself respectively and also to allow his or their Trustee all costs charges damages and expenses which he or they shall or may suffer sustain expend or be put unto in or about the execution of the aforesaid trusts or ? Proved at London with three Codicils the 2nd Septr 1852 before the Worshipful William Robinson Doctor of Laws and Surrogate by the Oaths of John Tobias Coltman the Son one of the executors named in the Will and Robert Wheeler the Younger the executor named in the second Codicil to whom Admon was granted having been first sworn duly to administer - Power reserved of making the life grant to Frances Coltman Widow the Relict & the other executor named in the Will when she shall apply for the same.
