Beckley (AP) - A man who says pollution in the New River killed his wife is suing the federal government. James Roop and his wife, Patricia, were picnicking in Fayette County near Thurmond on Sept. 1, 1991, when she fell headfirst from a 30-foot ledge into the river. The lawsuit, which seeks $5 million in damages, said park rangers moved the woman up the hillside because the river was contaminated. It does not identify the type of pollution. While Patricia Roop was hospitalized, toxins from the river caused her to develop a lung infection, the lawsuit said. She died on Sept. 19, 1991. Authorities knew the river was polluted but ignored the problem, the lawsuit said. Named in the lawsuit are: The National Park Service, Park Service Director Roger Kennedy, B.J. Griffith, the agency's mid-Atlantic regional director, and Interior Secretary Bruce Babbitt. Roop named others in a similar lawsuit last year that was dismissed. Park officials declined comment on the case. The lawsuit was filed in U.S. District Court in Beckley.

Beckley - A federal magistrate recommended dismissing a lawsuit that contends a woman contracted a fatal lung infection when she fell into a tributary of the New River. Mary Feinberg's recommendation will be reviewed by a federal judge. James Roop is suing the National Park Service, which oversees the river and its gorge in West Virginia, for $5 million. He said he and his wife, Patricia, were picnicking in September 1991 beside Dunloup Creek in Fayette County when she fell 30 feet into the water. Roop said she died 18 days later. Mrs. Roop contracted the infection from fecal matter in Dunloup Creek, he said. A sewage treatment plant is located nearby and authorities knew pollution was a problem but ignored it, Roop contended. Feinberg said Monday the Park Service was not required to warn the public about the problem.
