Last will and testament dated on May 5, 1820, making his mark as Benjamin Duvall Sr., and died the next day at the age of 74 years. He devised to his "beloved children by my first wife Jemima namely: Benjamin Duvall Jun., William Duvall, Isaac Duvall, Gabriel Duvall, Edward Duvall, Griffin (sic) Duvall, Susanna Nesbet, and Juliet Duvall all the tract of land I now live on, known by the name of Brook Field; containing 262 5/8 acres, llying and being in Alleghany", also the proceeds from the sale of three negroes. He likewise devised to "my three beloved children by my Second wife Sally namely Jefferson Duvall, Martha Ann Duvall, Eva Duvall all that tract or parcel of land lying and being in the State of Ohio", containing 340 acres. Various articles of personal property were bequeathed to his three younger children, but his silver watch was willed to his brother Gabriel Duvall. Edward W. Duvall, his son, was named as executor. The instrument was probated at a court held in Allegheny County on May 31, 1820, by David Hoffman, Jr., Andrew Hayner and John Endow. Ref: Wills, Liber A, folio 188, Courthouse, Cumberland.
