WILL OF MICHAEL HARNESS: (recorded WB 1, pp. 110, 111, 112, Hamp shire County, Virginia) - written 1779
" IN THE NAME OF GOD AMEN. I, MICHAEL HARNESS of the South Branch in the: County of Hampshire, State of Virginia, being in good health at present and considering the uncertainty of human life, and that it is necessary for all persons while they have the happiness to enjoy their senses of memory perfect, to seel and dispose of their affairs in such manner as may prevent any dispute or lawsuits after their death amongst their friends and relations -- I, therefore, to prevent the same as much as possible in my own Family and dispose of my Estate in manner Following , viz.
"First: I recommend my body after my decise to the Earth from whence it came to be Buried in a decent manner and my Soul unto my Heavenly Father, and it is my desire that all my funeral expense and other lawful debts be paid as soon as convenient can bed one after my decise.
"Item: I give and devise unto my beloved wife, ELIZABETH, one-third part of my plantation, massuage or tenement, ordgard and all belonging to it, induring her life, and also two slaves, one negro man named Manuel and one wench named Rachel to labour for her during her life, and if said wench should bear any children , the one-half of them to be my wifes own for her and her heirs forever, and after her decise the above named Manuel and Rachel and the other half increase of said negroes children to be returned unto my son JACOB HARNESS to be his own for him and his he irs forever. And, I give and devise also to my beloved wife the one-third of all my other Effects or Moveables and also her thirds in the money left by me to be her own forever.
"Item: I give and devise unto my youngest son, JACOB HARNESS, my plantation, dwelling house, Baron, Ordgard and all utentials husbandry and all the Household Furniture (my wife's part excepted) the living Stock :and also all my slaves. Except one for PETER. In short he is to have everything left by me on the plantation and he is likewise to have one equal part of the money left by me and this is for the Good cause and Reason that I have Furnished and Suployed my Elder sons with Land and Other Necessarys before in former Times, all to be his without any mollastation forever.
"Item: I give and bequeath to my son, JOHN HARNESS, one equal part of the Money left by me for him and his heirs forever and no more
"Item: I give and bequeath to my son, GEORGE HARNESS, One Equal part in the money left by me to be for his share forever and no more.
"Item: I give and bequeath to my son, LEONARD HARNESS, One part of the money left by me to be for his share forever and no more.
"Item: I give and bequeath to my son, PETER HARNESS, one Negro named Witt and also one part of the money left by me for his Share to be his Own for him and his Heirs forever.
"Item: I give and bequeath to my Grandson, MICHAEL HARNESS and his sister ELIZABETH ROBINSON one equal Share of the money left by me to be divided amongst them for their part and no more.
"Item: I give and bequeath to my beloved Daughters, ELIZABETH YOACKUM and BARBARA ZEE (SEE), & Likewise.... and DOROTHEA HORNBECK and MARGARETHA TRUMBO. Likewise each one of them to have an equal part or Share in the money left by me to be equally divided a mongst all my Children above here mentioned.
"And Lastly, I do hereby Nominate & appoint my son JOHN HARNESS and my son-in-law SAMUEL HORNBECK whole and Sole Executors o f this my last Will and Testament.
"And I do hereby revoke and make Void all former Wills, declaring this to be my last Will & Testament and no other. In Witness whereof I have hereunto set my hand, Sign and Seal this day One Thousand Seven hundred and Seventy Nine.

At a Court held for Hampshire County the 8th day of March, 17 8 5 ... This last Will & Testament of Michael Harness, dec'd was presented in Court by John Harness one of the executors therein named. Proved by the Oaths of Joseph Petty & Jacob Yoakum witnesses thereto and ordered to be recorded and on the motion of the said Executor who made Oath according to Law, Certificate is granted him for obtaining a probate there of in due Form giving Security whereupon he together with Jacob Yoakum & Daniel Tivebaugh his Securities entered into and acknowledge Bond in the penalty of Five thousand pounds for his due and faithful Administration of the said decedents Estate & performance of his duties.
