  Civil War Service: Enl 5 Apr 1862 at Rennersville, AL., Co. A 1st Batallion, Hilliards Legion, Gracy's Brigade. Later Companies A to D were consoliodated with the 3rd Battalion to form the 60th Regiment, Alabama Infantry. This change was effective Nov. 25, 1863; at that time Benjamin was deceased.
  Civil War Department History identifies Hilliard"s Legion, Gracy's Brigade as one of the units moved into the battle area on Sept. 18 or 19, 1863 and entered into first combat with Uinion Forces on Sept. 20, 1863. Thus, it is more than likely that Benjamin was killed on the first day of his first battle. His Service Record lists: "When deceased, Sept. 20, 1863, further lists where and from cause: "Killed at Chickamagua, TN." There were no casualties buried at Chickamagua and there are no records to indicate place or date of burial.
  Foootnote #1. Widow, Mary Elizabeth Pitts, related to family members that she went to some place nearby to nurse Benjamin until he died. Supposedly they stayed with some family relations in South Carolina. As recalled by her grandson, Guy Hicks Barrett, Benjamin lived about two months after being wounded. (Source: Guy D.
