Mary York Trigg reported that William York, while serving in the War of 1812, had been woulded at the Battle of Horseshoe Bend. There was a William York in the listing for the Rutherford Co, NC Seventh Regiment of the War of 1812-1814. The relationship of William York and Catharine Smith was a union, not a marriage. The ruling in 1853 of Superior Court of Burke Co, NC did not recognize the children of Catherine Smith as the legal heirs of William York. Judson Crow points out that he has never seen proof that Riley was the middle name of this William York, nor that he was born in Guilford Co, NC. Burke Co, NC Superior Court record Fall term 1853 gave: "That the said William Yorke left behind him surviving Sarah Yorke (wife of John Yorke), William Yorke, Abner Yorke, John Yorke, Nancy Yorke (wife of Andrew Yorke), Dicey Deal wife of Henry Deal, Mary Ann Deal wife of William Deal, his children and heirs at law, and the said tract of land has descended to them from their father, William Yorke as tenants in common.... Your petitioners further showeth that each of them are tenants in common with the aefendant James Yorke, in said lands and that each of them is entitled to one seventh part of the same in severalty, and the aefendant, James Yorke, is entitled to four seenths thereof." James York, a son of the union of William and Catherine Smith, had purchased his four sevenths as described in the court record.
