  I.B. McWhirter, 83, died Saturday, May 12, 2007 at his home in Canton Twp., MI He was born July 3, 1923, in Madison County, Alabama. He was a former resident of Detroit, MI.
  Mr. McWhirter was a retired truck driver and worked for many years as a Teamster. He enjoyed his retirement years. He served in the U.S. Army during WW II.
  Surviving are daughters Sonja Ellis, of California, Sandra Chester (Jim), of Shelby Twp. , Constance Frank (Steve), of Harrison Twp. Samantha Barnes , of Alabama (Paul) Sons, Jesse, Tennessee, Richard (Barbara), of Ypsilanti, Michael (Diane); of Madison Heights, 29 grandchildren and 26 great-grandchildren. Preceded in death by daughter Amanda Golden formerly of Alabama.
  There will be a graveside ceremony at Hillside Cemetery, Belleville, MI at 1:00pm Wednesday May 16th 2007
  LAST WILL AND TESTAMENT OF INDENMON MCWHIRTER I, INDENMON MCWHIRTER, presently residing at 1339 Shirley, Ypsilanti, Michigan, being of sound mind and disposing memory, do hereby expressly revoking any and all Wills and Codicils heretofore made by me.
  ARTICLE 1 FAMILY My family includes the following: my children are: SANDRA F. CHESTER, SONJA R. ELLIS, JESSE O. MCWHIRTER, CONSTANCE E. FRANK, RICHARD G. MCWHIRTER, MICHAEL A. MCWHIRTER, and SAMANTHA A. BARNES. Any reference to my children will refer to all of the children mentioned above. My deceased child is AMANDA K. MCWHIRTER. Any reference to "descendants" or "heirs at law" does not refer to the descendants of this child. ARTICLE 2 CLAIMS AND TAXES I direct my Personal Representative to pay out of my residuary estate the following: Section 1. The expenses of my last illness, administration expensus, and all legally enforceable creditor claims.
  Section 2. All federal estate taxes, state inheritance taxes and all other governmental charges imposed by reason of my death, without seeking reimbursement from or charging any person for any part of the taxes and charges paid.
  Section 3. If necessary, reasonable funeral expenses, including the cost, if any, of a suitable marker for my grave, without the necessity of an order of court approving such expense.
  ARTICLE 3 PERSONAL REPRESENTATIVE I appoint my son RICHARD G. MCWHIRTER to act as my Personal Representative. To the extent by law, the Personal Representative shall serve without bond.
  ARTICLE 4 PERSONAL PROPERTY BEQUEST I give each of my following children the sum og one dollar ( $1.00 ) SANDRA F. CHESTER, SONJA R. ELLIS, JESSE O. MCWHIRTER, CONSTANCE E. FRANK, MICHAEL A. MCWHIRTER, AND SAMANTHA A. BARNES. If any beneficiary under this Article shall fail to survive me, then that beneficiary's share shall be distributed according to the remaining provisions of this will. I deliberately make no other provision in mt Will for the children listed in this Article or therir descendants for reasons personal to me.
  ARTICLE 5 TANGIBLE PERSONAL PROPERTY I have prepared or may prepare a written statment or list, either in my handwriting or signed by me, or both, to dispose of certain items of tangible personal property to a certain person or persons. If I have not already given each item to that person, my Personal Representative shall deliver that item to that person. Unless otherwise specifically provided, my Personal Representative shall then deliver all remaining tangible personal property to my son, RICHARD G. MCWHIRTER. If my son, RICHARD G. MCWHIRTER, fails to survive me, then this bequest shall be distributed to his descendants, in equal shares, per stirpes.
  " Tangible personal property " means personal property ( not primarily used in a business ), such as boats, books, china, clothing, furnishings, furniture, glass, household items, jewelry, lawn and garden equipment, motor vehicles, personal effects, pictures, recreational items, rugs, silver, works of art, and any other similar items, and includes any insurance on those assets. My Personal Representative shall determine which items are within this definition, and determination shal bind all persons. ARTICLE 6 DISTRIBUTION OF RESIDUE I direct that the residue of my estate be given to my son, RICHARD G. MCWHIRTER. If my son, RICHARD G. MCWHIRTER, FAILS TO Survive me, Then this devise shall be distributed to his descendants, in equal shares, per stirpes. ARTICLE 7 SURVIVORSHIP REQUIREMENT Unless otherwise soecifically provided,, a beneficiary of my Will who also fails to survive me by 30 days shall be deemed to have predeceased me and shall not share in my estate. The share of such beneficiary shall be distributed as directed by the provisions stated in my Will.
  ARTICLE 8 ADDITINAL PROVISIONS Section 1. I direct that my will be interpreted under the laws of the State of Michigan. Section 2. I direct unsupervised administration of my estate.
  ARTICLE 9 POWERS AND DUTIES OF MY PERSONAL REPRESENTATIVE I authorize my Personal Representative to do any of the following, if necessary, in the course of the administration of mu estate. {a} To make repairs or improvements to my property, as may be deemed necessary to preserve or enhance the value of my estate. {b} To sell or convey any part of my estate whether real, personal or mixed ( for cash or on credit ) at public or private sale. {c} To borrow funds for use in estate administration if there are insufficient liquid assets in my estate. {d} To employ persons, including attorneys, investment advisors, or other agents for assistance or advice, or not to employ such persons, as my Personal Representative deens appropriate. In addition, my Personal Representative is authorized to preform any act which theapplicable laws of the State of Michigan authorize a personal representative or fiduciary to preform.
  I, Indenmon McWhirter, the Testator sign my name to this instrument on January 10, 2006. I certify or declare under penalty of perjury under the law of the State of Michigan that the statements in this document are true. I declare that this document is my will: that I sign it willinhly or willingly direct another to sign for me; I am eighteen years of age or older, of sound mind, and under no constraint or undue influence.
  We RHONDA A. PATTERSON and BLYTHE K. SNEIDERAITIS, the witnesses, sign our names to this document and certify or declare under penalty of perjury under the law of the State of Michigan that all of the following statements are true; the individual signing the document as the Testor executes the document as his will, signs it willingly or willingly directs another to sign for him, and executes it as his voluntary act for the purposes expressed in this will; each of us, in the presence and hearing of INDENMON MCWHIRTER signs this will as witness to the Testator's signing: and, to the best of our knowledge, the Testator is eighteen years old or older, of sound mind and under no constraint or undue influence.
