RICHARDSON, deceased, his heirs and assigns UNKNOWN OWNERS You are hereby notified that a Complaint in Condemnation has heretofore been filed in the Office of the Clerk of the United States District Court for the Middle District of Pennsylvania, in the United States Courthouse, Scranton, Pennsylvania, in an action to condemn an estate In fee simple, subject, however, to existing easements for public roads and highways, public utilities, railroads and pipelines, In the following described property: TRACT 218-C A certain tract of land situate in the Commonwealth of Pennsylvania Tioga County, Nelson Township, and more particularly bounded and described as follows Beginning at a corner common to lands now or formerly owned by Paul Bennett, et ux [?]. and the subject owner, said corner being further located South 70 degrees 09' West 19945 feel from Monument TTD-1 as estaiblished by Abrams Aerial Survey Corporation; thence, continuing with lands of said Bennett, et ux, the following courses and distances . South 75 degrees 58' East 50 feet. South 15 degrees 02' West 50 feet, North 75 degrees 58' West 50 feet. North 15 degrees 02' East 50 feet, to the place of beginning, containing 0.04 acre, more or less. The foregoing description is a cemetery containing 25 graves, more or less. It is the intent of the foregoing description to include a part of the same land as that described in a deed from Clifford S. Merritt and Irene B. Merritt, his wife, to Paul Bennett and Jean E. Bennett, his wife, dated 2 June 1953, and filed for record 9 July 1953. in Deed Book 267, Page the land records of Tioga County, Pennsylvania. for use in connection with the Cowanesque Lakes Project and for such other uses as may be authorized by Congress or by Executive Order. The authority for the taking of the land is under and in accordance with the Act of Congress approved April 24. 1888 (25 Stat. 94. 33 U S.C. 591) and March 1, 1917 (39 Stat. 94B. 33 U S.C. 701) which acts authorize the acquisition of land for flood control projects, and the Act of Congress approved July 3. 1958 (Public Law 85-500) which act authorizes the project; the Acts of Congress approved July 18, 1918 (40 Stat. 911 33 USC 594), and August 18. 1941 155 Stat. 650. 33 U.S.C. 701C-2), and Ihe Act of Congress approved August 28. 1974 (Public Law 93 J93) which Act appropriated funds for this acquisition. You are further notified that if you have any objection or defense to the taking of vour prooerty, you are reguired to serve upon plaintiff's attorney at the address herein designated within twenty (20) days after personal service of this notice upon you. exclusive of the date of service, an answer identifying the property in which you claim to have an interest, stating the nature and extent of the interest claimed and stating all your obiections or defenses to the taking of vour property. A failure so to serve an answer shall constitute a consent to the taking and to the authority of the Court to proceed to hear the action and to fix just compensation, and shall constitute a waiver of all defenses and obiections not so presented. You are further notified that if you have no obiection or defense to the taking, you may serve upon plaintiffs attorney a notice of appearance designating the property in which you claim to be interested, and thereafter you shall receive notice of all proceedings affecting the said property. All expenses to be incurred in the disinyerment. removal and reinterment ol the bodies located under this land will be cared for by the plaintiff free of cost to the defendants, therefore no compensation will be payable to the next of kin.
