Continued: 2.cc-b: 12 Feb 1829 & WB-A:55 Feb 1829 - - LAST WILL AND TESTAMENT OF WILLIAM HORNSBY Produced in open court and duly proven by oaths of Jas. McCanse, Wm Noblett, and Jas Swan, subscribing witnesses, who say they saw Wm Hornsby sign, seal, publish and declare it to be his last will and testament. Exrs named in will, James and Brinkley Hornsby, appeared in court and took oath prescribed by law; Wm Johnson, Henry Collins, and Josiah Fike, his securities, entered into bond of $1000. Will....to wife Winny Hornsby during widowhood for maintaining my family, schooling, etc. sons Jas Hornsby of Roane County and Brinkley Hornsby of Rhea County, to be Exrs. That sons Wm and Semastin V. Hornsby, both of Roane County, be guardians of my children who are underage. At death of my wife Winny, estate to be equally divided between my 13 children: Wm, Winny, Fanny, Jas, Susan (Hussong), Semastin, Elizabeth, Winny, Alvin, Crawford, Lucy, Sally, and Polly Hornsby. Susan Hussong has had advancements, etc. Test: Jas McCanse, Wm (x his mark) Noblet, Jas Swan, and Moses Ferguson. *Note: WILLIAM (2) HORNSBY, in his will states that he has thirteen children still living. Three by his first marriage, name of wife unknown, and ten children by his second marriage to Winnifred Stinson. Apparently thirteen children were alive at the time of his death. YET, IN THE ABSTRACT OF WAKE COUNTY, N.C., WILL BOOK 10, 1811 - 1812, IN THE AUGUST 1811 TERM OF COURT WILLIAM HORNSBY RECEIVED A COUNTY COURT TICKET FOR SERVICE. THE 1810 CENCUS OF TENNESSEE WAS DESTROYED , SO WE CAN'T USE THAT TO VERIFY THAT HE WAS IN TENNESSEE IN 1810. SO THERE IS UNCERTAINTY AS TO WHEN HE MOVED TO TENNESSEE. *THE 1810 CENSUS OF WAKE COUNTY, N.C. IS MISSING , SO WE CAN'T USE THAT TO SEE IF HE WAS STILL IN WAKE COUNTY, N.C. IN 1810.
