U.S., Revolutionary War Pension and Bounty-Land Warrant Application Files, 1800-1900

James Maxwell. Wife Elizabeth on 5 Apr 1839, a resident of Smith County, age about 81 gave, petitioned to obtain her deceased husband's pension as his widow. Her husband died on 7 Dec 1838. She married William the 11th day of June 1785. She was not married to him prior to his leaving the service but the marriage took place previous to the first day of January 1794 to wit at the time above mentions
October term 1844 Samuel P.W. Maxwell, grandson and legal heir of William Maxwell and Elizabeth Maxwell his wife, aged 26 years, resident of Smith County, TN. Requesting the pension due Elizabeth Maxwell which she never received because she died 8 Feb 1840 leaving the following children and grandchildren to wit: William Maxwell, Robert Maxwell, Nancy Love, the heirs of John Maxwell, deceased, the heirs of Jesse Maxwell, the heirs of Elizabeth Maxwell and the heirs of James Maxwell and that they are her only heirs
11 Oct 1851 - appeared Robert Maxwell, aged 46 a resident of Smith County, TN made following declaration about William and Elizabeth's pension applications that as her executor he is seeking her share; he mentions the family record left by William Maxwell and that only he and Nancy Love are living and listed are the following:
  1. Charlotte b 26 Apr 1789
  2. James b 27 Feb 1791 will Dec 1828 Rutherford County proved Jan 1829-(DNA kit 59129 - wrong info); in his will he names his wife Jane (no last name) who is currently pregnant, daughter Naomy L. Amanda Marchal who is claimed to be his illegitimate child (her mother is Elizabeth Martial) Parents William and Elizabeth Brother Robert, Heirs of deceased brother John - probable son is Samuel P. Maxwell (b1818) since he made a petition as an heir of William his grandfather William A. Maxwell Brother Jesse Maxwell Sister Lidda Adcock Sister Nancy Maxwell (named Love by 1851 in brother Robert's petition) Not named are Charlotte and Elizabeth who are presumed deceased by Dec 1828.

  8. Jesse b 18 Apr 1807 -MOST PROMISING CANDIDATE WHO MARRIED ELIZABETH CARSON
  9. Nancy b 5 Aug 1810 - Named as Nancy Love in later petition by
William and Elizabeth lived in Rutherford County when application was made for his pension in 1831. Son James was living in Rutherford County and that is where his will was filed in Jan 1829
Williamson County is adjacent to Rutherford County. Williamson County is where Jesse married Elizabeth Carson on 4 May 1826
In 1830 census Jesse Maxwell is in Humphrey's County with 1M<5; 2 M 20-30; 1 F 5-10; 1 F 20-30 In 1835 Jesse was summoned for Grand Jury in Obion County as was William and William A. appointed judge of execution of Hollomon Distruct (US Gen Web from Court records in Obion County)
Jesse and Lydia are deceased by 1844 as noted by testimony of Samuel PW Maxwell; William, and Lydia are all deceased by 1851 when Robert makes his petition and states he and Nancy Love are the only living heirs (although Samuel PW Maxwell is alive).
The other Jesse's don't work for the following reasons:
Jesse Jr. B 1796 17 Aug 1856, son of Jesse and Annie Armstrong is well documented with family bible records
Jesse, the son of George who died in Hawkins County was deceased by the time George wrote his will
Hawkins County written 4 Nov 1812; George b 1751 Augusta VA (from FAG) d 23 Nov 1822; (abstract by LAM) in will names son Jesse, dec. (Geo mentions that the money he borrowed from Jesse who at his death requested the amt be split btwn 2 sisters so George is now giving them their share of the money); daus Matilda and Anne (has children), sons William, Solomon (who has children); son-in-law Wm Lyons and son Solomon are exec; info from FAG: his wife is Sarah Ann Armstrong b 1761 TN (not likely since wasn't populated by then) - 1794 Tn; dau Matilda m Wm Lyons (in will of Wm Phipps, son of Johsua CC names land next to Wm Lyons and Wm Armstrong is exec (Geo Maxwell m Sarah Armstron) -written 1844 proved 1856; Annie m James Lyons; son Jesse b 1792 d 1816
From a tree on ancestry, Samuel Pinkey William Maxwell was born 6 Oct 1818 Rutherford, TN and died 11 Jan 1884 Smithville, DeKalb TN and married Nancy Oliver Fitts. They have John William Maxwell and Elizabeth Covington as parents with John dying 16 Nov 1829 (not possible since James will was written Dec 1828 and proved Jan 1829 mentioning heirs of brother John) and Elizabeth 1799-1872. The Elizabeth Covington is likely because the marriage took place in Rutherford on 13 Jan 1818.
As for Elizabeth being a sister of Kit Carson,
Alexander Carson from Scotland went to Ireland where son William was born. His family then left for America settling in Lancaster, PA. Alexander had 4 sons and William was the 3rd son. A 5th son was born in Lancaster.
About 1773 he followed the Shenendoah Valley migration along with the Boone family to North Carolina. The Boone family settled in Yadkin River and the Carson family in Iredell, NC.
In Iredell William married Eleanor McDuff and with her had six children (1) Lindsey b 1 Aug 1754 d 4 Sep 1818 (2) Andrew (3) Robert (4) Sarah (5) Eleanor (6) Alexander bc 1765
William died about 1773 and his widow married John Scroggs (b Scotland to Ire to PA) . He had children from his first marriage, John Jr who married Wm?Eleanor's dau Sarah; Jeremiah, David and 4 dau; 2 other Scrogg and Carson children married
Eleanor and John Scrogg had one child together - James
Sons Lindsey, Andrew and Robert were in the Rev. War under Gen. Wade Hampton. After the War, Lindsey and brother Robert went to South Carolina where Lindsey Married Lucy Bradley. They then moved back to Iredell, NC.
Lindsey and Lucy had the following children 1. William b NC or SC 2. Sarah b NC or SC 3. Andrew b NC or SC 4. Moses b NC or SC In 1793 Lindsey and Lucy followed Daniel Boone into KY where 5th child Sophie was born abt 1794 KY. Son William had married Millie Boone a grandniece of Daniel and had daughter Adeline whom they left with Millie's sister.
Lucy died shortly after the birth of Sophie and Lindsey married secondly to Rebecca Robinson of Greenbrier, VA. The family lived in Madison County, KY
Lindsey and Lucy had 10 children together including Christopher (Kit) b 1809 and Elizabeth born 29 Nov 1797 Madison County KY - this is probably why she was identified as a wife of Jesse Maxwell.
However the following document disproves that. It states that Elizabeth Carson married Robert Cooper (son of Braxton Cooper) in Howard County 17 Aug 1813 - it was the first marriage to take place in Boonlick County, Missouri - the place where the family lived. Robert Cooper did not died until 29 Jan 1850, thus not possible that Elizabeth married Jesse Maxwell in 1826.
