Note: About 1776, he removed to Huntingon, buying one of the first lots to be sold in the new town. Shortly thereafter he settled in Hagerstown, Maryland, establishing a pottery very close to the original courthouse. He also owned a homestead on the outskirts of the original town, but now within the city limits. In the winter of 1799 he sold his Hagerstown properties to Lysinger and Bell ( the latter later established the famous old "Shenandoah Potteries" and in some manner this family was related to the Ashbaughs. Frederick and Sophia moved in 1799 to a pottery site just outside present Ft. Erie, Ontario, Canada, taking a land grant from the British king. ASHBAUGH, FREDERICK: D. 1818 Estate File ? Lincoln County Surrogate Court THE WILL In the name of God Amen I Frederick Ashaugh of the Township of Bertie County of Lincoln District of Niagara and Province of Upper Canada. Considering the uncertainty of this Mortal life and being of sound and perfect mind and memory ? Bless�ed be Almighty God for the same ? Do make and publish this my last Will and testament in manner and form following that is to say: FIRST that all my lawful debts be paid. THEN I give and bequeath unto my son Andrew Ashbaugh the sum of one hundred and fifty pounds lawful money of this province, to his heirs and assigns forever. The same to be paid by Samuel McAfee his heirs or assigns in annual payments of fifty pounds a year after my Decease. I also give and bequeath unto my son Frederick Ashbaugh the sum of fifteen pounds twelve shillings lawful money of this province to his heirs and assigns forever, this sum being the amount of a note of hand which I hold against the said Frederick Ashbaugh. I further give and devise unto my daughter Catharine Oliver all the money remaining after my lawful debts be paid to her heirs and assigns forever. I further ordain and devise that my daughter Catharine Oliver shall have a good and Decent maintenance off the farm on which I now live so long as she shall remain in her present situation. I further give and bequeath unto my son John Ashbaugh the sum of fifty pounds lawful money of this province to his heirs and assigns forever, this sum to be paid by the aforesaid Samuel McAfee his heirs or assigns in the term of four years after my decease. I further give and devise unto my son David Ashbaugh his heirs or assigns all that my messuage or tenement situated lying and being Lots number ten and twelve containing by computation two hundred acres each in the fifth concession of the Township of East Gwilimbury in the County of York Home District and Province of Upper Canada to hold to him the said David Ashbaugh his heirs and assigns forever. I further give and devise unto Samuel McAfee his heirs and assigns all that messuage or tenement lying and being situated on the Niagara River being lot Number Five in the Cross Concession of the Township of Bertie County of Lincoln District of Niagara and Province of Upper Canada to hold to him the said Samuel McAfee his heirs and assigns forever. I further give and bequeath unto the said Samuel McAfee all of my goods and chattels excepting money to his heirs and assigns forever. I further give and divise conditionally unto my Grand Daughter Catharine Ashbaugh if she lives with her aunt Catharine Oliver until she is eighteen years of age she shall have a cow, a feather bed and a spinning wheel to her heirs and assigns forever. Lastly I hereby appoint John Warren Esquire of the Township of Bertie County of Lincoln and District of Niagara Province of Upper Canada and Jacob Wintermute of the same place to be my sole executors of this my last will and testament, hereby revoking all former wills by me made. In witness whereof I do hereunto set my hand and seal this twentieth day of January in the year of our Lord one thousand eight hundred and eighteen. Witnesses: David Everitt, John Hershey, Samuel Speers AFFIRMATION BY WITNESS TO THE WILL District of Niagara, Province of Upper Canada ? in the Surrogate Court Be it remembered that on the fifteenth day of December in the year of our Lord one thousand eight hundred and eighteen. Personally came and appeared in the office of the Surrogate Court for the District of Niagara, in the Province of Upper Canada aforesaid, John Hershey of the Township of Bertie in the District aforesaid, Farmer. Who being of the Persuasion of People called Menonists and being duly affirmed doth affirm and say ? [Menonites do not swear legal oaths] That he was Personally Present when the within named Testator Frederick Ashbaugh signed and executed the within written Instrument as his last Will and Testament. And doth further affirm that David Everitt also then of Bertie was also present and saw said Testator Frederick Ashbaugh sign and seal the within written instrument as his last Will and Testament. And the Affirmant also declares and affirms that the Witness Samuel Speers did sign as a Witness but not in the presence, he believes, of the Testator, nor can he say that said Samuel Speers heard Testator declare it to be his last Will and Testament but says that he saw Samuel Speers come into the room immediately after the Testator Frederick Ashbaugh had executed the written instrument as within, but that he said Samuel Speers came into the room in time to sign as a Witness with the two who did subscribe in presence of the Testator, at least heard it acknowledged and saw the Testator sign and execute as is aforesaid.
