Wentworth County Surrogate Court THE WILL In the name of God Amen I Frederick Ashaugh of the Township of Ancaster County of Wentworth and District of Gore in the province of Upper Canada, Being of sound and disposing mind and memory for which I desire to bless God, Do make this my last Will and Testament, as following, ? After all my just debts and financial expenses are paid ? 1stly I give and bequeath to my Dear wife Catharine Ashbaugh all my personal property, namely horses, cattle, sheep, hogs, wagons, harness etc., also all the household furniture of every description to be disposed of by her as she may think proper after my death ? 2ndly I Give and bequeath to my son Oliver Ashbaugh twenty eight acres of land with all the improvements thereon situate in the Township of Windham [sic], London District, to him his heirs and assigns for ever ? 3dly I Give and bequeath to my son David Ashbaugh one hundred and eighty eight acres of land in the Township of Glanford, Gore District, to him his heirs and assigns for ever ? 4thly I give and bequeath to my [other] three sons and the survivors and successors of them, namely John, Frederick and William Ashbaugh, fifteen acres and eighteen parcels in the Township of Barton adjoining the Gore of Ancaster, also a hundred acres of land situate in the Gore of Ancaster With all improvements to them to share and have equal to them their heirs and assigns for ever. 5thly I give and bequeath to my Executors hereinafter to be named and to the survivors and successors of them, all the residue and remainder of my real estate, wheresoever situate lying and being, to be disposed of by them to the best possible advantage and Converted into Cash which said Cash is to be divided among my children in the following manner, namely ? 6thly I give and bequeath to my daughter Sophia Winter, the sum of one hundred and twenty five pounds currency to be paid to her and after her death then to said sum of one hundred and twenty five pounds is to be paid equally to her surviving sons when they marry or become of age ? 7thly I give and bequeath to my daughter Susan Fox the sum of one hundred and twenty five pounds currency and in case of her decease without issue then the said sum to be equally divided between my sons Oliver and David Ashbaugh. 8thly I give and bequeath to my daughter Catharine Sutton the sum of one hundred and twenty five pounds currency to be paid to her and in case of her death then it is to be equally divided between the issue of her body when they become of age or marry ? 9thly I give and bequeath to my daughter Eliza Gorie [?] the sum of one hundred and twenty five pounds currency to be paid to her and in case of her death without issue then it is to be equally divided between my two sons Oliver and David, that is should she die before she arrives to the age of twenty one years. 10thly I give and bequeath to my two Grandsons namely James and Frederick Hughson sons of Nathaniel Hughson Esqr each the sum of fifty pounds currency when they arrive at the age of twenty one years. 11thly I give and bequeath to my two sons Oliver and David all the residue and remainder of the Cash which my remain in my said Executors' hands, being the avails of the sale of my real estate which I have authorized them to sell to be equally divided between the heirs ? And lastly I appoint my Son Oliver Ashbaugh, James Bates, William Ashbaugh and William Beta Van Every to be my Executors to this my last Will and testament. Be it remembered that on the ninth day of December in the year of our Lord one thousand eight hundred and forty, personally came and appeared in the office of the Registrar John Ashbaugh of the Township of Glanford in the Gore District, Yeoman, who being solemnly sworn, taketh oath and saith that he was personally present when Frederick Ashbaugh, the Testator named in the last will and testament hereunto annexed, signed and subscribed said annexed last will and testament, and saw said Testator sign and subscribe the same, and heard him the said Testator declare and pronounce the same to be his last Will and Testament. And Deponent also swore that Caleb Forsyth and Peter Bumbargen the Younger, both lately of the Township of Ancaster in the said District, Yeomen, deceased, were with him present, and saw the said Testator sign and subscribe said annexed written instrument, and heard the said Testator declare and pronounce the same to be his last Will and Testament. And deponent farther swears that the subscribing witnesses signed as witnesses to the said annexed Last Will and Testament in the presence of the said Testator and of each other. And farther this deponent saith not. To the Honourable John Williams, Judge of the Surrogate Court in and for the District of Gore ? The petition of Oliver T. Ashbaugh, James Bates and William B. van Every ? Executors with one another of the last will and testament of Frederick Ashbaugh ? Sheweth/ That Frederick Ashbaugh late of the Township of Ancaster, in the Fore District, yeoman, deceased, departed this life on or about the twenty-third day of October in this present year having first duly made and published his last Will and Testament, and appointed your Petitioners and William Ashbaugh, Executors of said last Will and Testament ? The prayer of your Petitioners therefore is that Probate of the said last will and testament may be duly granted to them, to do as the said last will and testament directs ?
