  The Petition of John M. Foltz, of the County of Muskogee, State ofOklahoma, respectfully represents and shows:
  That Margaret Foltz departed this life intestate at Muskogee, in theCounty of Muskogee, State of Oklahoma, on the 24th day of April 1950.
  That said decedent, at the time of her death, was a resident of theCounty of Muskogee, State of Oklahoma, and left estate consisting ofinterests in real estate in said County of Muskogee, and that thevalue and character of the property of the estate are as follows:
  Undivided interests in one residence property in the City ofMuskogee, in said County, and undivided interest in certain farm andgrazing land in said County; all of the probable value of $3,000.00.
  That the names, ages and residences of the heirs at law of saiddecedent, as far as known to your Petitioner, are as follows:

  John M.   That your Petitioner is the surviving husband of said deceased and,therefore, as your Petitioner is advised and believes, entitled toLetters of Administration upon said estate; that no other person hasor can have a prior or equal right to Letters of Administration uponsaid estate; and that no notice of hearing on this Petition isrequired by law.
  WHEREFORE, your Petitioner prays that this Petition be set for hearingforthwith and that upon the final hearing hereof Letters ofAdministration upon said estate be issued to your Petitioner, John M.Foltz.
  Dated this 12th day of March, 1970.

  The second document found in the court house of Muskogee Co., OK,states the following:
  "Affidavit in the Matter of Military Service and Application for Entryof Order...
  George W. Leopold, ... states:
  That he is the Attorney in the above entitled proceeding for JohnMichael Cochran, the Administrator of the Estate of Margaret Foltz,deceased, that the said John Michael Cochran is a non-resident of theState of Oklahoma and is not within said State; and this Affiant isduly authorized to make this Affidavit for him and on his behalf.
  That the said Administrator of said estate has filed a Final Accounton behalf of John M. Foltz, former Administrator of said estate, nowdeceased, and on his own behalf as successor Administrator of saidestate; and his Petition for Determination of Heirs and for hisDischarge as such Administrator.
  That said Decedent was survived by her husband, John M. Foltz, and byone daughter, Elma Foltz Cochran, who were all her heirs at law; thatthe said John M. Foltz is now deceased and was survived by his secondwife, Alberta Foltz, and by his daughter, the said Elma Foltz Cochran,and by two children of said daughter, John Michael Cochran and OtisFielding Cochran; and that the said Margaret Foltz was not survived byany other child or descendent of deceased child.
  That the said Alberta Foltz was a house-wife until the death of hersaid husband and now performs ordinary household duties at and abouther home and is not otherwise employed; Elma Foltz Cochran is ahouse-wife and teacher and is not otherwise employed; John MichaelCochran is not in default of any appearance in this proceeding; he isemployed as an Associated Press Writer; and none of said persons arenow or within ninety days prior to the date hereof have been, inMilitary Service as defined or contemplated by the "Soldiers' andSailors' Civil Relief Act of 1940" or any amendment thereto; and thesaid Otis Fielding Cochran, also known as Otis Fielding Cochran, Jr.,is a member of the United States Marine Corps and has presented andcaused to be filed in this proceeding his waiver of any right he mayhave by reason thereof.
  That there are no other persons who are heirs, devisees or legatees ofthe said Margaret Foltz, deceased, or otherwise interested in herestate but this fact has not been legally established and if there besuch other persons their identities and whereabouts are unknown toAffiant and to the said John Michael Cochran, and cannot beascertained or determined by any means within the control of either ofthem and that neither of said persons knows or can ascertain ordetermine if any such persons, if they actually exist, are, or withinninety days prior to the date hereof have been, in Military Service asdefined or contemplated by said Act of Congress or any amendmentthereto.
  WHEREFORE, Affiant, in behalf of the said John Michael Cochran,Administrator as aforesaid, prays that an Order be entered directingthat the hearing upon the said Final Accounts and Petition forDetermination of Heirs, for Distribution and Discharge, proceed andthat a Final Order be entered in accordance with the decision of theCourt at such hearing.

  "Mrs. J. M. Foltz, 68, Dies of Heart Attack
  Mrs. J. M. Foltz, 68, died in a local hospital Monday morningfollowing a heart attack at her home, 2127 Boston avenue. The body isat the Petering Funeral home.
  Mrs. Foltz was a member of the First Christian Church. She was bornJanuary 27, 1882 near Centralia, Ill., and came to Muskogee in 1908.
  She is survived by her husband, John M. Foltz, an oil producer; adaughter, Mrs. Alma Cochran, Stanford, Texas; a sister, Mrs. NonaHazen, of the home; a brother, Fred L. Boggs, Sedan, N. Mex., and twograndsons, John Michael Cochran and Otis Fielding Cochran, both ofStanford."

  "Mrs. J. M. Foltz Rites To Be This Afternoon
  Funeral services for Mrs. J. M. Foltz will be held at 4:30 p.m.Tuesday in the Petering Chapel with Rev. Don S. Hinkle, pastor of theFirst Christian Church, officiating. Burial will be in Memorial ParkCemetery.
  Mrs. Foltz, a member of the First Christian Church, died in a localhospital Monday morning following a heart attack suffered at her home,2127 Boston Avenue. She was 68 years old.
  She came to Muskogee in 1908 from near Centralia, Ill., where she wasborn January 27, 1882.
  Survivors include her husband, John M. Foltz, an oil producer; adaughter, Mrs. Alma Cochran, Stanford, Texas; a sister, Mrs. NonaHazen, of the home; a brother, Fred L. Boggs, Sedan, N. Mex., and twograndsons, John Michael Cochran and Otis Fielding Cochran, both ofStanford.
  Pallbearers at the services will be Bryan Hayes, W. J. Metzger, HubAdams, Russell Foltz, S. B. Norfleet and Ernest O. Leming."
