a. Note:   Mrs. Harriet H. Mass, administrator on the estate of James C. Mass,objects to land lot 46 in the 18th district of Cobb County beinglisted in the schedule of property of M. L. Cape, widow of James R.Cape. Mrs. Mass declares that the money has not yet been paid. MariahCape replies by a letter to the county on 10 March 1883. She statesthat she will have lot 46 "stricken from the appraisor bill and saidlot to stand just as it was before the appraisor bill was made." Shethen writes that she expects "to pay the last dollar on the note."(The copy of this record was obtained from Marilyn Henley.)
  MILITARY: On 13 February 1901, Mariah L. Cape applied for pensionbenefits. Mariah resides in Oakdale, Cobb County, GA. She claimsthat her husband James Russell Cape enlisted in 1863 in Company B,Henderson Regiment and that James served two years until his companysurrendered and was discharged at Savannah, Georgia. A. Melton (orMilton) completed "Questions for Witnesses." In this form, Meltonstates that he's known M. L. Cape for 65 years and that he served inthe same company and regiment as James Cape. Melton states thatMariah sold her land in 1899 to W. W. Cape (which would be her son).The Physician's Affidavit states that M. L. Cape "has tuberculosiswith occasional hemorrage of lungs, has a general nervous affection,being very weak at all times, and is confined to her bed and room andis not of sound mind." The Ordinary's Certificate declares that thetax digest of Cobb County shows that M. L. Cape "returned for taxationin her own name in 1899 275 dollars worth of property, and in 1900 nodollars worth of property." (Copies of pension records were obtainedfrom Roy Brown.)

Note:   COURT: One probate record is found in Cobb County, GA, dated in 1882.
b. Note:   Mariah L. Cape in 1901. Mariah stated that James was born in 1830,but his tombstone lists 1823 as his birth year.

Mariah L. is 50 and she lists her occupation as "keepshouse." Her birthplace as well as her parents' birthplace is listedas Georgia. James and Mariah list five children living with them; allborn in GA:

  Living in the house listed right above on the census sheet is Lewisand Elizabeth Cape. Both list their age as 60 and birthplace as NorthCarolina. Lewis is a farmer. Lewis and Elizabeth have three childrenliving with them; all born in GA.
