  This is the last will and testament of me Thomas Brown of Chesterfield in the County of Derby publican I direct my just debts funeral and testamentary expenses to be paid and discharged by my executrix hereinafter named I give devise and bequeath under my dear wife Rosena Brown for and during the term of her natural life the rents interest and proceeds to arise from my real and personal estate and the uses of all my household goods and furniture and stock in trade and from and after her decease I give the whole of my personal estate whatsoever and wheresoever unto and especially amongst the children of my brother James Lafbery and from and after the demise of my said wife I give and devise all those my four dwelling houses and gardens situate on the North side of Brunswick Street in Chesterfield aforesaid in the occupation of John Lafbery and three others under and to the use of my niece Annie Elizabeth Lafbery her heirs and assigns for ever and from and after the decease of my said wife I give and devise two other of my dwelling houses and gardens situate on the South side of Brunswick Street aforesaid in the respective occupations of xxxxxxxx and Mrs Chadwick until and to the use of my brother George Lafbery and his heirs and assigns for ever and from and after the decease of my said wife I give and devise one other of my dwelling houses and gardens also situate on the South side of Brunswick Street aforesaid in the occupation of Mr MAKIN unto and to the use of my brother William Lafbery his heirs and assigns for ever and from and after the decease of my said wife I give and devise my remaining dwelling house and gardens situate on the South side of Brunswick Street aforesaid in the occupation of Charles Somerfield unto and to the use of my nephew Herbert Kirk his heirs and assigns for ever but in case of his death before he attains the age of twenty-one leaving lawful sons there I give and devise the said last mentioned dwelling house and gardens until and equally amongst such issue and in case of his death before he attains the age of twenty-one without leaving lawful issue I give and devise the said dwelling house and garden unto my niece Rosena Kirk her heirs and assigns for ever I devise all estates rested in me as trustee and mortgagee unto my said wife her heirs and assigns subject to and upon the trust and equities affecting the same respectively I appoint my said wife sole executrix of this my will and revoke all other Wills by me at any time heretofore made and declare this only to be my last will and testament In Witness whereof the said Thomas Brown the Testator have hereunto set my hand this 21st day of May one thousand eight hundred and sixty-six
  Thomas Brown his mark X - signed by the said Thomas Brown the Testator and by him acknowledged as and for his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as Witnesses
  Samuel Stanton Charles Pearson Brook
  ��..at Derby on the 11th day of September 1867 by the both �..of Rosena Brown, Widow, the relict, the sole executrix to whom administration was granted.
  The Testator Thomas Brown was late of Chesterfield in the County of Derby publican and died on the 29th day of August 1866 at Chesterfield aforesaid.
