WILL This is the last Will of me, Elizabeth KIRK of the Nags Head Inn Newbold Chesterfield in the County of Derby widow
1.I REVOKE all former Wills and codicils made by me 2.I APPOINT my son Charles Kirk my daughter Annie Green and my brother-in-law William Smalley of Park Villa Thrybergh in the County of York Brewery Traveller (hereinafter called �my trustees�) to be the Executors and Trustees of this my Will 3.I BEQUEATH to my daughter the said Annie Green my furniture and all articles of personal or domestic use or ornament belonging to me and also the tenant right valuation and the goodwill of my trade or business of a licensed victualler and the stock-in-trade machinery plant fixtures and other effects employed therein or belonging thereto the cash in hand and the money standing in a current account at the Westminster Bank Limited Chesterfield in the joint names of my daughter the said Annie Green and myself and all book debts and moneys due to me in respect of the said business my said daughter discharging and indemnifying my general estate from all rents, debts and liabilities due or subsisting in respect of my said business at my decease. 4.I GIVE to my son the said Charles Kirk and my daughter Beatrice Crossley all the sums of money at any time or times advanced or paid by me to him or her and all interest due thereon and I DECLARE that no claim shall be made against him or her or his or her estate in respect thereof should he or she predecease me 5.I GIVE DEVISE AND BEQUEATH the residue of my estate whether real or personal and wheresoever situate to my Trustees UPON TRUST that they shall sell call in and convert into money the same and shall with and out of the moneys produced by such sale calling in and conversion pay my funeral and testamentary expenses and debts and shall stand possessed of the residue thereto IN TRUST for such of my three children the said Charles Kirk the said Annie Green and Beatrice Crossley as shall be living at my death in equal shares 6.I DIRECT that if any of my said three children shall die in my lifetime leaving a child or children who shall survive me and being a son or sons shall attain the age of twenty one years or being a daughter or daughters shall attain that age or marry under that age then and in every such case the last mentioned child or children shall take and if ore than one equally between them the share which his or their parent would have taken of and in the residuary trust funds if such parent had survived me 7.I TRUST that after my death my daughter the said Annie Green may be allowed to continue the tenancy of the Nags Head Inn now in my occupation IN WITNESS whereof I have hereunto set my hand this ninth day of April one thousand nine hundred and thirty one. In his majesty�s high court of justice Be it known that Elizabeth Kirk of the Nags Head Inn Newbold Chesterfield in the County of Derby widow died there on the 27th day of May 1937 AND BE IT FURTHER KNOWN that at the date hereunder written the last Will and Testament Charles Kirk of 191 Handsworth Road in the City of Sheffield Garage Proprietor son Annie Green of Nags Head Inn aforesaid wife of Walter Harry Green daughter of deceased and William Smalley of Park Villa Thrybergh in the County of York Brewery Traveller (Retired) the executors named in the said Admin
And it is hereby certified that an affidavit for Inland Revenue has been delivered wherein it is shown that the gross value of the said Estate in Great Britain (exclusive of what the said deceased may have been possessed of or entitled to as a Trustee and not beneficially) amounts to �426 19s 7d. and that the said Affidavit bears a stamp of �2, 10s, 0d Dated the 24th August 1937
