Merrimon Spring Term 1889 Notice - The plaintiff above named (GWWilliamson) will take notice that on the 19,h day of March 1889 at the residence of JH Noland on Fines Creek Haywood County, before Henry Kingsman Esq, Commissioner appointed by this court ( ) defendant (WC Hill) will proceed to take thedepositions of Margaret Lusk, Thomas Russell, and Nancy Brown, to be read in evidence on the trial of the above entitled cause, in the Superior Court of Haywood Co. At which time and place the plaintiff can attend and crossexamine the witnesses ifhe shall think proper. Mar 14, 1889 WC Hill Defendant Margaret Lusk deposes and says I have been over evry once and a while to see him and he said he put in his supplies and could not get it cooked/cashed (?) to suit him and if he did not dobetter he GW Williamson plan would have to put him a way if he did not do better or make some other arrangements That was the old n-mn Wm Rathbone that told me that. I do not know of my own knowledge whether he fin-nished his supplies or not buthe showed me a hog on one occasion and asked me if I did not think it would do for his fast/part (?) I am a sister to the wife of Wm Rathbone deceased. Wm Rathbone used his own furniture and bedding and I know he made use of that do not knowwhether he used his own fimiiture or not but know he had it their. I heard Wm Rathbone say his things was badly abused and he could not stand it he would have to do some other way. Margaret Lusk (her seal) Thomas Russell deposes and says I livedabout one and half miles from Wm Rathbone from 1880 until April 1887. Past very often and stopped and stayed frequently, In passing their I saw Wm Rathbone shelling com out of his own crib and taking it to the n3ill and after/often seen him WmRathbone taking wheat to the mill and cleaned it to be his own wheat and seen him halling:flour back and claimed it as his own. This wheat and com was a produce of his own farm and more than enough to support him. I sow this mining from year toyear during the hole time spoken of Mr. Rathbone told me at different times that he furnished enough for himself and his comers and goers and more than enough. I saw him Wm Rathbone on one occasion carrying home sixteen lbs of coffee which he saidwas for his use and for his comers and goers he told me I lay in for myself and for my comers and goers he told me that different times. Mr. Wm Rathbone told me that Mrs. Williamson was using his household and furniture and was abusing it. I knowthat Mr. Rathbones household was furnished with bedding and such as cooking vessels chars (?) I know that the plaintiff Williamson used horses oxen wagon and farming tools for mining farming and getting wood Williamson payed Rathbone rent from hisfia-m I know that he often cut and carry in wood that is. Rathbone. Cross examined - He says that he sold com at times and claimed that he Wm Rathbone ftu-nished his own and more too. Do not know that he put in enough but he told me he did andmore at different times. He told me they badly abused his cook and milk vessels. Did not hear him say Geo payed his rents. Thomas Russell (his mark) Nancy Brown deposes and swears I have been living in a mile of Wm Rathbone abouttwenty seven or eight years. I have passed their a heap of times and he always made a little crop himself both of wheat and com. He always rented out part of his farm and always got in rents and he was a man that always had plenty. I do not knowof my own knowledge that he furnished his own supplies but I noticed in passing that he always had plenty and he told me he ftu-nished his own supplies. That was Wm Rathbone himself. I asked Wm Rathbone if he would sell me some flour and he toldme he did not know but when he got it home from the mill if he had any to spare he would let me have it but wanted to keep enough for his own use. I sent to Wm Rathbone one spring to buy some lard and he told me that they put it with GeorgeWilliamson that they all eat together and he had none to spare on the summer before Wm Rathbone died I was talking to him about coffee being so high and said we would have to quit buying he said he expected to buy as long as he lived that healways layed in enough to do him and more too. AN of these thm32s happened while Mrs. Williamson was living with Mr Wm Rathbone. I know that he f@attened his boys three or four of the furst years and that he bought his baco after that. Cross exam- He had several horses but always fed them with his own feed. I do not know that he put in what done him of my own knowledge. Nancy Brown (her mark) The defendandt(WC Hill) answering the complaint of plaintiff alleges: I - That thefirst allegation is true H - That the second allegation of said complaint is not true M - That the third allegation is not true IV - That during the whole time for which the plaintiff makes his charge, the defendants intestate lodged himself inhis own house, furnished his own food, and washing, and cared for himself and plaintiff used the horses, oxen, wagons, tools, and other property of said intestate without charge and plaintiff and his fim3ily lived in intestate house with intestateand subsisted in a great measure upon the provisions furnished by said intestate V- That said intestate in the way of Punishing house, horses, oxen, wagons, tools, household and kitchen ftuniture, provisions etc, did more than compensate theplaintiff for any little services rendered by pl-iintiff, although this defendant protests that no such services were rendered. VI That more than three years have elapsed since the time of the alleged boarding, lodging, washing, and caring fordefendants intestate, previous to the commencement of this suit, and the plaintiffs said claim is barred by the statute of limitations. Therefore defendant demands judgment that plaintiff take nothing by his suit and for costs.
