Note: Garnett Mitchell will, 1829 July proved & ordered to be recorded Recorded Book B and page 432. I Garnett Mitchell of the County of Boone and State of Kentucky being desirous to direct in what manner the property I now have, shall be disposed of after my death, do make and ordain this my last will and Testament in manner following to wit, 1st - I give and bequeath to my beloved wife Lucinda Mitchell during her widowhood all my personal property that is to say one mare & colt, two heifers, two beds and the furniture thereto belonging one press & cupboard ware, one table, and kitchen furniture, one loom, one wheel and looking glass but my desire is that my Executor to be hereafter named, shall in case my wife as aforesaid shall marry any other man, then and in that case shall sell to the highest bidder on a reasonable credit the following property as named aforesaid with mare & colt, press & cubboard ware, loom, wheel, looking glass, table, kitchen furniture & one of the heifers provided the other is living -- and the money arising from such sale to be put on interest for the benefit of my daughter Malvina Mitchell. 2nd - Whereas I have about the amount of forty dollars in cash & notably(?) desire is that my executor as aforesaid after paying my just debts & funeral expences out to the aforesaid cash proceed to collect those notes and loan, the money out at interest for the use and benefit of my daughter aforesaid to her and her heirs & assigns forever. 3rd - I constitute and appoint my Father Benjamin Mitchell Executor of this my last will & testament. In testimony whereof I Garnett Mitchell have hereunto subscribed my name and affixed my seal this 19th day of May 1829. X [his mark - Garnett Mitchell] (seal) Witnes present: Joseph Graves James Riley X [his mark - Abraham Vaughan] Codicil to the aforesaid will whereas I have one bed & furniture and two chairs which my father gave me at the time I commenced house keeping which property is not named in my will and I hereby will & bequeath the bed & furniture and two chairs to my father Benjamin Mitchell. Also my saddle & clothes to the same.
