Sourced from Margaret Lowry - Petition To The Governer of Ireland - (very faded photocopy, extremely difficult to read - 3 pages scanned) July 1839 To His Excellency the Right Honourable Viscount Ebrington, Lord Lieutenant-General and General Governor of Ireland. The Petition of Thomas and Michael Cassidy, Most Humbly Showeth, That a riot took place in the village of Ballymore on the evening of the 25th of December last between our prosecutor, Kelly's party and another party with which we were not in any way connected. That as Kelly and his party, on their way home, were passing our house about a mile from said villages, the said Kelly disturbed the quiet and peace of our families by the most abusive and threatening language, which provoked us, importunately, to go out. That at said time the party ??????ed the Kellys' overtook them, where another riot took place. That we, labouring under temporary resentment at Kellys' abusive and threatening language the moment before, joined the party which was against him. That there was no premeditation of injury or waylaying as far as we are concerned, Kelly being the agressor upon the quiet of our homes. That we confess that we acted rashly, foolishly and criminally in assisting to injure the person of a fellow creature, though he abused and threatened us and provoked our hostility. That we deserve to be severely punnshed for our rash, foolish and criminal conduct. But that in the absence of any premeditation ?? or waylaying on our part, being in fact dragged into the riot by the abusive and threatening language of the prosecutor, we most humbly and respectfully submit to your Ecellency's gracious consideration whether it be not too harsh. That it is not for our own sakes but for theirs that we humbly beseech your Excellency, in the exercise of your clemency, to reverse the stern decree which will deprive them virually for ever of our aid and assistance. Punish us as severely as it may please your Excellency, but O for Mercy's sake give our families a hope that we may not be separated from them, perhaps, for ever. And your Excellency's most humble Petitioners and their families as in duty bound will we pray. We, the undersigned, considering the previous good conduct of the petitioners, the peculiar circumstance under which they were led into the riot, and the consequences of transportation to their helpless families, do earnestly recommend them to the Clemency of the Lord Lieutenant. We are of opinion that the ends of Law and Justice will be fully attained by such a commutation of their sentence as would both punish them sufficiently in their misdemeanour and shortly return them to the bosom of their families. See notes for son Patrick Cassidy The following MAY be this Michael Cassidy (refer to following paragraph from Geelong Advertiser re Lighterman) - From Drownings in Geelong & District 1836-1900 page 78 In reference to the drowning of Henry Pope on 27th December, 1856, the following paragraph is extracted. The coroner completely disregarded the evidence of a lighterman, Michael CASSIDY, who said he had heard a great disturbance on board the EMILY JANE some time between 8 and 9 o'clock, as though the men were fighting. He said he went down to the vessel and observed two men on deck, one of whom was crying and the other was telling him to go below. He heard the latter to exclaim that he would not go down, or go below after having been struck in the manner he had; one of these men appeared to have been intoxicated. According to the steward of the EMILY JANE, a sailor named Frank had been drunk during the day and although the first and second mate had been drinking, they could not be said to be drunk. Geelong Advertiser reported that the late Michael Cassidy 65 had been resident in Geelong for the 42 years. Long before the bar at the entrance was cut, he owned 7 lighters which were actively engaged in landing cargo at the wharves from ships anchored off Point Henry and he amassed considerable wealth. He followed the gold to Ballarat but was not successful. He returned to Geelong and started as a timber merchant and general dealer in which occupations he prospered. He took a great interest in politics and will be missed from the ring of old politicians so well known in Moorabool Street. He was a native of County Westmeath and left a large family well provided for. 3 April 1882 From the "Geelong Advertiser" Monday April 13 1882.
