  OBITUARY OF DEWAINE EDWARD MCDANIEL FROM THE ELDON NEWSPAPER Dewaine E. McDaniel, 68, of Mexico, dies Friday at the Missouri Veterans Home, Mexico. He had been a lifelong resident of the Eldon Community. Mr. McDaniel was born March 9, 1923, at Freeburg, a son of Frank J. and Hester Anne McDaniel. He was a navy veteran of WWII. He had been employed with the Rock Island Railroad as a conductor for over 30 years prior to his retirement. He was a 1942 graduate of Eldon High School. he was a life member of the Eldon VFW Post No. 2442. he was also a member of the Disabled American Veterans, the Tin Can Sailors, the USS Ault Association and the Clan Napier of North America. He was a Scottish Rite Mason. Survivors include: a son, Michael Dewaine McDaniel, Sr., Jefferson City; a brother, Roy McDaniel, Eldon; and three grandchildren. The funeral will be at 2 P.M. today at Phillips Funeral Home Chapel, Eldon, with burial in Eldon City Cemetery. Military grave side honors will be conducted by Eldon VFW Post No. 2442. Memorials have been suggested to Eldon VFW Post no. 2442.
  LAST WILL AND TESTAMENT OF DEWAINE EDWARD MCDANIEL I, Dewain Edward McDaniel, a resident of Audrain County, Missouri, being of sound mind, memory and understanding, being over the age of twenty one years, knowing the certainty of death and the uncertainty of the time thereof, and desiring to settle all of my worldly affairs, do hereby make, publish and declare this as my last Will and Testament, and do hereby revoke all Wills and Codicils at any time heretofore made by me.
  Article I
  Payment of Debts and Expenses. I direct my personal representative to pay all expenses of my last illness and funeral, and expenses of administration of my estate as soon as practicable after my death, and to pay my legal and enforceable debts or extend and renew the same, as my personal representative may deem desirable without order of court.
  Article II
  Payment of Death Taxes. I direct my personal representative to pay from the principal of my residuary estate all taxes lawfully imposed by reason of my death. All such taxes as my personal representative is hereby directed to pay shall be considered as part of the expenses of the administration of my estate.
  Article III Declarations. I declare that I am single, and that I now have one child, namely Michael McDaniel.
  Article IV
  Devise and Bequest. I give, devise and bequeath all of my estate not consumed in the administration of my estate real, personal and mixed, equally to the following three grandchildren, per stirpes and not per capita, to be theirs absolutely: Michael McDaniel, Jr., David McDaniel, and Mandy McDaniel.
  Article V
  If any person who would be entitled to share in my estate through intestate succession of under the pretermitted heir statute, except as herein designated, in any matter whatsoever, directly or indirectly, contests this will, or any provision hereof, then in any such case, I hereby bequeath to such person or persons, the sum of One Dollar only, in lieu of anything whatsoever.
  Article VI
  Nomination of Personal Representative. I nominate, designate, constitute and appoint Elaine F. Kubinski, as personal representative of this my last will and testament, and provide that she should be allowed to serve without bond, and further designate that no bond should be required of any trustee or guardian which may be appointed to effect the distribution of my estate.
  Article VII
  Independent Administration. I direct that my estate should be administered without adjudication, order or direction of the Probate Court, pursuant to the provisions of Section 473.780, Revised Statutes of Missouri.
  In Witness Whereof, I have subscribed my name to this my Last Will and Testament, consisting of five typewritten pages, this included, on the bottom of each of which I have placed my initials for purposes of identification the X day of X, 1988
