Eloy is 11 years old, so the age is appropriate to be the same person as Jose E. Rafael is age 13 and Ramon age 9. Tomas Falero y Machin, is 35, a widower, of the Roman Catholic faith, born in Puerto Rico, a farmer by profession, living in Ceiba Sur, Juncos, Puerto Rico. He can read, write and speak Spanish. He has three sons and two nephews living with him. His sons are Rafael Falero y Rodriguez, 13; Eloy Falero y Rodriguez, 11; and Ramon Falero y Rodriguez, 9. All three boys are born Puerto Rico, the two oldest can read and write, the youngest can read only. His nephews are Avelino Falero y Rivera, 24; and Wenceslao Falero y Rivera, 20. Again, he may be living on the boarder of Ceiba Sur and Valenciano Abajo. 1893 -- Don Tomas Falero, 51 (53), born in Juncos, widower and proprietor, is living in Ceiba Sur, Juncos, PR. [Accessed Apr 2014] ________________________________________________________________ 1898 -- Tomas Falero y Machin's death occurred on 19 August 1898 at 6 am as a cause of intense pulmonary congestion of traumatic origin caused by a bull. He may have been gored. His death record names him as, 54 years old, the widower of wife Da. Paula Rodriguez with whom he had three sons, Eloy, Ramon, and Rafael, who were living in the deceased's house in Ceiba Sur at the time of his death, according to this record. He was the legitimate son of D. Rafael Falero and of Da. Mariana Machin, both deceased. [Accessed 2 Jun 2014] ________________________________________________________________ 1901 -- ESTATE FEUD Oh, those Faleros!!! Here is a case that went to the Supreme Court in appeal and was published in a law journal. It is hard to understand all the legal style of writing but this is what I got out of it. It seems that when Esteban Falero y Machin died, he left a piece of property to his daughter Isabel Aurelia (or Amelia) Falero Rivera. Evidently his brother Tomas Falero y Machin was her guardian at the time and he managed her property, and actually appropriated the land and used it for his own benefit. Well, Tomas must have had a bout with his conscience and he gave Isabel 100 acres of land in Ceiba Sur to compensate her for her losses. Then Tomas died leaving all his possessions to his children which included, they thought, that 100 acres of land. Evidently, Tomas's son Rafael was living on the land as he is described as a tenant at will. Well, Isabel sold the land to Jose Casildo Reyes, who then sold it back to her brother Avelino Falero Rivera. This must have all happened quickly. Then Avelino registered the land in his name and evicted Rafael. So Tomas's children, filed a suit to reclaim the land saying that Isabel did not have title to the land at the time of Tomas's death, had no right to sell it, and the land was still apart of Tomas's estate. But the court ruled in favor of Avelino since he had a valid purchase agreement. Then the two families must have fought this back and forth until it came before the Supreme Court. Rafael Falero Rodriguez represented the rest of his family and filed suit against Avelino Falero Rivera claiming that Avelino lied and connived to get the property transferred to him and registered before they new what was going on. They wanted the court to not only declare the previous case Null & Void but to grant them $11,000 in damages. Well they lost the case at the Supreme Court level, too. It sounds like they lost it because the lawyer wasn't all that good and missed a few details, plus there wasn't enough evidence to prove their claim that Isabel didn't have the right to sell.
