Note: In 1854, Daniel Hahn, owned 70 acres of land and conveyed an undivided half interest to his wife, Nancy. In 1867, a year after Nancy's death, Daniel conveyed that half interest to Joseph Coleman, by warranty deed, for $450. The unnamed Plaintiff in this case bought the half interest from Coleman. A few weeks after Daniel died, the children of Daniel and Nancy filed suit against the Plaintiff for this half interest of land. The Plaintiff contested the suit and won in circuit court but lost in the Supreme Court when the plaintiffs in that case appealed (Miller v. Quick, 158 Mo. 495, 59 S. W. 955). The Plaintiff was ordered to surrender one-half of the half interest to the children of Daniel and Nancy when it was determined there was a breach of covenants in the deed from Hahn to Coleman. Because of that breach, the Plaintiff sought to recover from Daniel's estate the losses he incurred at having to give over land he had purchased from Coleman.

Note: This is the same Miller V. Quick case referred to in the Southwestern Reporter. Daniel Hahn conveyed to Nancy E. Hahn by warranty deed 120 acres on 10 Aug 1854. It was an undivided half of the southeast quarter of section 17, township 59, range 38. Nancy died in 1866 intestate and a year later, Daniel sold 70 acres of her land to Joseph Coleman by warranty deed on 11 Nov 1867. On 6 Nov 1869, Daniel sold by warranty deed 25 more acres of Nancy's land to Alvin H. Buzzard, his nephew. After Daniel died, Nancy's children filed suit against the current owner of the seventy acres they believed rightfully belonged to their mother and which should not have been sold by Daniel to anyone. The original deed was brought in as evidence. "Now, said deed is made with this express understanding, that is to say: That whereas my said wife Nancy E. has left my bed and board and sued for a divorce in the Holt Circuit Court, now, if said Nancy E. returns to my house and lives with me as a wife, and I never drink any intoxicating liquors or get drunk and treat her ill, then said deed is to be void so long as I act right towards my said wife. But if I at any time hereafter take to drink or abuse my wife, Nancy E. Hahn, then and in that case the said deed is to be in full force and virtue in law and equity." It is noted that Nancy did return to Daniel's house. The defendant won this case and the children of Nancy E. Hahn later appealed and won back half of the seventy acres.
