Note: In the name of God, amen, I, John Fugate of the township of Hanover, County of Columbina and state of Ohio, being in a weak and low state of health, but of sound and disposing mind, memory and understanding, knowing that it is appointed for all ???? ones to die, but not knowing the time thereof, think proper to make my last will and testament in manner of following: that is to say First is my wife, I do hereby order and direct that all my just debts and funeral expenses be paid as soon as convienent after my deceased by my executors herein after named. 2 I will and bequeath to my wife, Lydia, all my personal property to be by her disposed of as she may think proper and it is further my will I do order and direct that my said wife, Lydia, have a sufficient and comfortable support during her natural life out of my real estate. 3.I will and direct that my real estate to wit the south west quarter and part of the south east quarter of location number 12, of township number 15 and range number fourteen being the tract of which I have bequeathed be equally divided between my son Samuel and my daughter Mary intermarried with Joseph Murray by a line run through the center of said tract from east to west dividing it in to equal parts, as to certify Samuel to have the north half and Mary to have the south half to them their lives and offspring forever. It is understood that said Samuel relinquish to said Mary any claim which he may have to 30 acres of the above specified half ,it being that part I once gave my son William who is since deceased and which I again purchased of his heirs and which said Samuel bought at Sheriffs sale in a n attachement against John Wilson, Mary's part of said tract on the south half as aforesaid to remain subject to a lease, heretofore given by son Samuel, to John Clark. 4. I give and bequeath to my said son, Thomas two hundred dollars to be paid one half by my son Samuel and one half by my daughter Mary eight years from the time of my decease. 5. I will and bequeath to my son, Stephen, two hundred dollars to be paid one half by my son Samuel and one half by my daughter Mary seven years from the time of my decease. 6. I will and bequeath to my grandson, Matheo, (Matthew ?) Fugate, son of my son, William who is deceased and who is being in my family the sum of one hundred dollars to be paid by my son Samuel and my daughter Mary the half in each to be paid when said William arrives to the age of tweny one years. 7th. I will and bequeath to my son, Peter, one dollar he having been heretofore received his share by a trade. 8th. I will and bequeath to my son, John W. one dollar he having been heretofore received his share by a trade. 9th. I will and bequeath to each of grandchildren, who are children of my son William deceased as follows to wit, to Stephen one dollar, to John one dollar, to life one dollar to Nancy one dollar to William one dollar their father in his lifetime received his share. The foregoing services is to paid by my son Samuel and my daughter Mary, each to pay one half of their portion for all debts and dues which may come against my last will,a debt ?? from me to the heirs of Mary. William as all others each to pay an equal proportion there of from my will and I do order that any real estate so as after my bequeath to Samuel and Mary be held and bound for the support of my said wife Lydia and for the payment of each and every of the above specified services. Lastly I do constitute my son Samuel Fugate and my son-in-law Joseph Murray my executors of this my last will and testament, I hearby disavow all former wills by me made an confirming this to be my last will and testament. In witness whereof I have hearunto set my hand and seal this Seventeenth day of February one thousand eight hundred and twenty four
