Green Co., KY Circuit Case #9261 26 August, 1862 William Wallace vs. Z. K. Easton and William Harlow
William Wallace states that Z. K, Easton owes him $110 for 22 hogs at $5.00 each. He also owes him $18.00 for a saddle. No part of the debt has ever been paid. Easton had disposed of his property and left this state and conceals himself so that a summons cannot be served on him, with an intent of defrauding his creditors. He wants an attachment against the property of the defendant to recover his debt.
  Amended Petition:
Wallace states that an attachment was placed upon the entire crop of Easton, consisting of corn and tobacco, and also upon one bureau and cupboard, the property of Easton, all of which property was appraised by three disinterested housekeepers who were appointed by the court. It was inconvenient to move the property at the time the appraisal was made, and William Harlow unlawfully carried away all of the property and converted it to his own use without right and with full knowledge that it had an attachment on it. Wallace wants Harlow to return the property.
Summonses to Green County: David Judd and wife, H. T. Hagan, Bettie Price, Joel Atwell, William Harlow, Bettie Read, Abner Gooch.
James Carlile, attorney for Easton, states Chat he has been unable to learn the whereabouts of Easton.
  Z. K. Easton denies that he ever purchased 22 hogs from Wallace. He denies that he bought a saddle. He is not indebted to Wallace at all. He admits that Wallace was his security in the account of White & Roach on a note for $10.00 but he paid that debt. He denies that he has hidden any property and denies that he has left the state to conceal himself. He wants the suit dismissed and attachment discharged. He also states that Wallace is indebted to him for $126.10 for labor and he countersues for this amount.
  Z. K. Easton amends his petition stating that he owes nothing to plaintiff. Owing to the embarrassed condition of defendant and his absence from this county and inability to defend himself, the plaintiff took judgment against him by default for his pretended claim. He is not indebted to Wallace, but on the contrary, Wallace is indebted to him.
William L. Easton states that he is agent for Z. K. Easton who is absent from this county.
William Harlow states that he has no knowledge of Wallace having a suit by attachment against Easton and no knowledge of any levy by attachment on the property of Easton. Jenings Thompson had a crop of tobacco at Easton's, unstripped and hanging in a house on the premises. Thompson transferred it to Easton for the benefit of his children. He had William Gooch to take the tobacco to market and sell it to satisfy the debt against Mrs. Easton for removing --?--together with herself and children to Warren County.

William Harlow asks the court to set aside the verdict of the Jury because of an accident that prevented him and his witnesses from being in court and because of unavoidable tragedy. He and David Judd were unable to get across the river for a considerable length of time and were prevented from getting to court until the cessation of the trial. He could have proven by David Judd that the tobacco named in the action was not the property of Easton's but was his property. He can make the same proof by Lucretia Judd who was also summoned and unable to get to court.
  May 21, 1867
David Judd states that he was summoned as a witness for Harlow and could not get to court before the commencement of the trial because he was unable to cross Green River. But for said unavoidable accident he would have been at the trial. He will state on oath that the tobacco levied on was not the property of Z. K. Easton at the time of the levy. He knows that the tobacco was bought by Jennings Thompson some two or three months before the levy and was by him transferred to Harlow. Easton had no right to it.
