  "SOUTHWELL v DALY.
DEMURRER. The bill stated that William Clarke, being seized of the lands of Ballyquirke, in the county of Tipperary, for lives renewable for ever, by two deeds of the 3rd July 1811 and 3rd August 1812, granted to Thomas McBride to several annuities of £160 Irish, charged on said lands for the life of McBride, the payment of which was further secured by two bonds (with warrants of attorney) of W. Clarke and Miles Keon, each for £2000 on which separate judgements were entered in Trinity Terms 1811 and 1812.
That Clarke subsequently, by Deed and Will, settled all his properties on his five daughters and only children, and died in 1820.
That McBride died in November 1821, having made his will and appointed his son Thomas McBride, and Thomas McNamara, his executors, who on the 29th November 1821, filed a bill in this court against the daughters of Clarke, M. Keon and others, to recover the arrears of the annuity, pending which suit Eleanor Clarke, one of the daughters, married Robert Daly, who was then made party to the suit; and in June 1831, a final decree for a sale of the lands of Ballyquirke was pronounced, and the lands were sold, but did not produce sufficient to discharge the plaintiff's demands.
The plaintiff ... ascertained that Clarke had died seised of the lands of Redwood, Moatfield, and Ballincurry, under a lease of the 29th October, 1795, from Jocelyn Bloomfield, and over which lands a receiver was then appointed in a cause in this Court.....
That the estates and interests of all the daughters of the said W. Clarke became invested in the said Robert Daly, who was resident in the said house of Moatfield, and held said desmesne part thereof in his own hands; and from time to time, said Robert Daly, and others of the said Clarke family, procured friends to bid for said house and desmesne, at sundry lettings thereof, under this Honorable Court, in said causes and matters, and to become tenants thereto in trust for them; and all along the family of the said W Clarke, continued in the actual occupation of said house and desmesne, and whilst so in possession, some of them, and particularly the said Robert Daly, broke up large quantities of lay and pasture on said lands for tillage, contrary to the provisions in the head lease or leases of the said lands, which as alleged, held a covenant or covenants against turning up for tillage a greater quantity thereof than a certain specified number of acres, under a penalty of £10 an acre additional rent. ..."
