  The plaintiff Elzy R. Ensminger complains of Mary J. Ensminger Defendant and says that he is now and has been for more than one year last past a resident of Shelby county and State of Indiana and that on the 8th day of June 1867 he and the Defendant intermarried at said County, and that within ten days after said time the defendant disregarding her duties as his wife abandoned him without any cause whatsoever and notwithstanding he has on divers and sundry occasions earnestly and persistently requested and beseeched the Defendant to come and live with him and share his home and affection she has persistently refused to live with him and has continued to disregard his solicitations for her return home.
 The plaintiff further says that the defendant abandoned him without cause and has no reason for her continued abandonment of him.
 Wherefore the plaintiff demands a judgment for a Divorce and all other proper relief.

  The defendant Mary J. Ensminger for answer to plaintiffs complaint admits the marriage as alleged in the Complaint but specifically denies each and every other material allegations in the said Complaint,
 The defendant Mary J. Ensminger by every of Cross Complaint to the plaintiffs complaint says, that on the 8th day of June A.D. 1867 she was married to the plaintiff and that she was then and has continued up to this time to be a resident of Shelby the State of Indiana. That immediately upon the solemnization of said marriage the plaintiff abandoned this defendant and fled from the state and so continued to remain out of the State for about two years and then stealthily returned home to the residence of his father in Shelby County where he has continued to remain since that time and from the time of the first abandonment of this defendant by the plaintiff up to this time he has provided nothing for her or the child of the plaintiff herein after mentioned.
 That at the time of the abandonment of this Deft. by the plaintiff she was pregnant with a child of which the plaintiff was the father who was born on the 6th day of December A.D. 1867 and which now past four years and a male child named after the plaintiff Elzy Ensminger and that from the time of its birth up to this time he has provided nothing for said child but that she by her own labor and industry has provided for herself and said child. Nor has the plaintiff at any time given any recognition of her as his wife or of her said child. She would further show that the abandonment and neglect was without cause.
 That she has always maintained a good character for Chastity and been ready and willing to live with him as his wife but he has always treated her with cold, neglect and contempt. That she should have custody of said infant child for the reasons above set forth.
 Wherefore the Defendant Demands a decree for Divorce and the custody of said infant child.

 Elzy Ensminger Passed Away At His Home In Brandywine
 Township This Morning After Short Illness
 WELL KNOWN IN THIS CITY
  Formerly Occupied the Office of Township Trustee Of Brandywine Township-
 A Ditch Commissioner at Time of Death
  " Elzy Ensminger, prominent farmer and former township trustee, died at his home in Brandywine township this morning about nine o'clock of pneumonia. Readers of "The Republican" will recall the item published in regard to Mr. Ensminger's illness, but it was not thought at that time that the result would end sadly. Mr. Ensminger was in Shelbyville last Thursday, having come to this city to help in regard to the survey of a ditch, being one of the ditch commissioners in the county. Soon after he returned to his home Mr. Ensminger became ill from the effects of the day's work and his condition suddenly grew worse. A physician was called and everything that human hands could was done for him but the cold icy fingers of the Death Angel could not be loosened. The deceased was born on a farm in Brandywine township February 6, 1851 (sic--June 24, 1850). He was a member of the M.E. Church and also a member of the Masonic Order, which organization will have charge of the funeral services. The funeral services will be held at the Brandywine M.E. Church Friday afternoon at two o'clock. The cortege will leave the house at one-thirty. Interment will take place in the Fairland cemetery. Besides a wife Mr. Ensminger is survived by three children--Mrs. Nellie Beaumont, Urban and Lester, and two brothers, Ballard, of Elwood and Brown, of VanBuren township. He was a son of St.Clair Ensminger, of this city. D.B Wilson & Son have charge of the funeral arrangements.

 "Shelbyville Democrat," (Shelbyville, Shelby Co., IN) 21 April 1909 (page 1) "Shelby county lost one of her prominent and respected citizens in the death of Elzy Ensminger, which occurred at 9:15 o'clock this morning, at his home in Brandywine township. Mr. Ensminger was ill only a few days. Last Friday night about eleven o'clock, he woke up with a chill. His condition was such that a physician was called, who diagnosed the case as double pneumonia. All that medical skill could do was done in this case, but Mr. Ensminger steadily grew worse and passed away this morning. On March 26, Mr. Ensminger and his wife, his father, St. Clair Ensminger, and Mrs. Ensminger, and Mr. and Mrs. Joseph Lambert left here for a visit in the south. The trip was greatly enjoyed, the Ensmingers returning to their homes on April sixth. It is thought that the change of climate, occasioned by the recent disagreeable weather, caused the dread disease to fasten its tentacles (sic) upon this well known gentleman. Elzy Ensminger was born in Liberty township, this county, June 24, 1850, making him at the time of death fifty-eight years, nine months and twenty-one days of age. He was the oldest of five children born to St. Clair and Sarah Ensminger. He remained working for his father on the farm until he was twenty years of age, when he took up the vocation of a school teacher. He taught in all six consecutive terms with good success. He was married March 16, 1873, to Martha E. Hilligoss, a daughter of Jacob Hilligoss, who lives in Moral township at the present time. Mrs. Ensminger passed away in January, 1888. Mr. Ensminger resided upon a farm in Van Buren township until 1879, when he moved to Brandywine township, where he has since resided. While living in Van Buren township, he held the office of assessor one term, and in 1884 was elected trustee of Brandywine township, and was re-elected in 1888, serving the people of his township in a careful and economical manner. On May 5, 1889, he was united in marriage to Miss Kate Bassett, who survives him to mourn his loss. Mr. Ensminger was an industrious and successful farmer, a trustworthy official and a good citizen. He was a member of the Fairland lodge of Masons. In addition to the widow, he is survived by three children, Mrs. Nellie Beaumont of Brandywine township, Urban and Lester Ensminger of Moral township, and his aged father, St. Clair Ensminger, of this city, and two brothers, Brown Ensminger of Van Buren township, and Ballard Ensminger of Elwood. The funeral services will be held at the Brandywine church, Friday afternoon at two o'clock, the cortege leaving the house at 1:30 o'clock. Interment in the Fairland cemetery, in charge of D. B. Wilson & Son."

Lower of Rush County, in the State of Indiana for the sum of Three Hundred Dollars, the receipt whereof is hereby acknowledged, the following Real Estate in Rush county, in the State of Indiana, to-wit:
  The entire undivided interest of the North East quarter of Section fifteen (15) Township Thirteen (13) of Range Nine (9) in the district of lands offered for sale at Indianapolis, Indiana containing sixteen Acres more or less.
 In Witness whereof, the said Martha E. Ensminger and Elzy Ensminger her husband have hereunto set their hands and seals, this 22nd day of September 1875.

  And thereupon Court adjourned until Monday Morning at 8:30 o'clock.
