His friends are particularly invited to attend his funeral from his late dwelling No 422 N 2nd street, this afternoon at 5 o’clock. ------ * probate: This will was included as part of John Bender’s pension file. It apparently was never recorded, as Philadelphia administration records list him as dying intestate. Be it remembered that I John Bender of the Township of Northern Liberties County of Philadelphia and State of Pennsylvania, House Carpenter being weak in Body but of sound disposing mind and Memory do make this my last Will and Testament in manner and form following that is to say First after my just debts and Funeral expenses are fully paid and satisfied which I direct my Executors herein after named to do as soon after my decease as may be convenient. I give and bequeath unto my beloved Wife Margaret all my household furniture beds and beding and all my silver plate to be at her disposal without control. I likewise give to my said Wife all the income of my Real and Personal Estate until my youngest Child Julianna or in case of her death the youngest that shall be then living shall attain its fifteenth year: from and after which time my Wife shall take and receive one third part of the income of my Personal Estate during her natural life and no more: out of which bequests my said Wife shall bring up educate and maintain all my Children until they shall severally arrive of but at their fifteenth year it is my request they may be placed out to learn some useful trade or business. The above bequest to my said Wife to be taken instead and in lieu of her right of dower and not otherwise__And all the remainder or residue of my Estate as well as that part, after the decease of my Wife, the income where of I have given to her during her natural life as aforesaid, I do give and bequeath the same unto my ten Children Mary, Susanna, John, William, Jacob, Samuel, Isaiah, Joseph, Josiah, and Julianna to be equally divided amongst them part and share alike not as joint Tenants but as Tenants in common….but should any of my said Children happen to die under age, unmarried and without lawful Issue, then I do give the share of him her or them so dying, to the survivors or survivor to be divided among them share and share alike___ and my further mind and will is that if any of my said Children shall happen to marry before my said youngest Child shall arrive to fifteen years of age as afore said that he she or they so marrying shall be entitled to receive fifty pounds in one month after their said marriage in part and on account of the share bequeathed them as aforesaid. And from and after the time of my youngest Child that shall be then living as aforesaid shall have arrived to fifteen years of age I do direct that such of my other Children as shall have arrived to the age of twenty one years and the rest as they shall severally arrive to that age shall receive there respective shares and, not before accepting, the fifty pounds to be paid them in case of marriage as aforesaid. And my further mind and Will is that in one year after my decease at which time the Copartnership between Michael Baker and myself is by agreement to expire and cease for as soon after the dissolution of said Partnership as the money can be collected and got in belonging to my Estate my Executors shall put out the same to Interest on good landed security until my Children shall have a right to receive the same. And lastly I do nominate and appoint my beloved Wife Margaret Executrix and my trusty and well beloved Friends George Justice, Jesse Clever and George Woolley to be the Executors of this my last Will and Testament hereby revoking all former Wills by me at any time heretofore made and confirming this only to be my last. In Testimony whereof I have hereunto set my hand and seal this twenty second day of the twelfth month in the year of our Lord one thousand eight hundred and two.
