a. Note:   The following document was found among the letters of A. D. Meyer: THIS AGREEMENT, made and entered into, this the 16th day of Sept. 1897 by and between Mrs. Rebecca Ardis Browne of Washington Co. Ky. of the one part. and Mrs. Sarah Martin Browne widow of the late T. Reed Browne, of Spencer Co. Ky. and Thomas Reed Browne and Laura May Browne, infant children of the said T. Reed Browne, by their statutory guardian. of the other part. Witnesseth: That whereas on the 7th day of Oct. 1895. there was instituted in the Washington Circuit Court. a suit in Equity styled. Sarah M. Browne. etc. vs. Mrs. R. A. Browne, etc. wherein it was sought to recover for plaintiffs and defendant. T. Reed Browne certain interests in the farm on which Thomas R. Browne resided at the time of his death and the rents thereon. and wheras there was rendered in said suit, a judgement on the 4th day of June 1897 in favor of plaintiffs and said defendant T. Reed Browne, decreeing a sale of said farm and giving to them one half the proceeds of same together with $1717.50 for rents thereon and wheras said judgement was left open and incomplete, the Court reserving for future adjudication the question as to proper and equitable settlement of the rights of the parties growing out of the attempted recision of the sale of the one half of the one third interest in said land purchased of May Browne Martin by Mrs. R. A. Browne and sold by her to the late T. Reed Browne, as same might be made to appear on future preparation of said suit, and wheras it is now agreed by all the parties in interest that said judgement, in its present open and incomplete condition gives to said plaintiffs and to defendant. T. Reed Browne more of said estate than they are in justice entitled to and all the parties being now desirous of a full, fair and honest settlement of all of said matters and further desirous of closing up and making complete said open and incomplete portions of said judgement and decree, do hereby agree upon the following as such settlement and as completion of said judgement and decree. FIRST. The said farm of 200 acres is to be valued at $30.00 per acre making $6000.00 for same and the rental thereon less taxes and improvements at $300.00 per year and to be estimated from July 5th 1892, making the whole value of said farm and the rents thereon up to said July 5th 1897 amount to $7500.00 and of this amount it is agreed that the said Sarah M. Browne and her two children, Laura May Browne and Thomas Reed Browne are jointly entitled to the sum of $2500.00 and in addition thereto at the rate of a $100.00 per year from said July 5th 1897 until same shall be paid or to be put in interest bearing notes. SECOND. It is agreed that proper proceedings shall be instituted in the Washington Circuit Court and the proper judgement procured to ratify this agreement, adjudging the said land to be absolutely the property of Mrs. R. A. Browne; that she is indebted to said Sarah M. Browne, Laura May Browne and Thomas Reed Browne as herein before set out; that they have a lien upon said land to secure the payment of same and that said Mrs. R. A. Browne may liquidate said indebtedness by executing to said Mrs. Sarah M. Browne and the guardians of said Laura May Browne and Thomas Reed Browne her note for the amounts due them respectively as the Court may adjudge; said notes to be secured by a lien upon said land to be due and payable on or before Four years after date and to bear interest at the rate of 6% per annum from their date. THIRD. It is agreed that the cost of the suit already pending and such other proceedings as may be instituted for the purpose of making this agreement effective shall be paid; two thirds by Mrs. R. A. Browne and one third by Mrs. Sarah M. Browne, Laura May Browne and Thomas Reed Browne together, the said Mrs. R. A. Browne is to pay her attorneys' fees and the said Mrs. Sarah M. Browne, Laura May Browne and Thomas Reed Browne are to pay their attorney's fees. This agreement is to be signed by all the parties hereto and steps are at once to be taken to procure such orders and judgements as are necessary to carry this agreement into effect and to make same final. In testimony wherof witness the signatures of the parties this the day and date first above written. $781.89March 10, 1898 On or before four years after date I promise to pay W. P. Hayes, guardian for Laura May Browne, the sum of seven hundred and eighty-one dollars and eighty-nine cents ($781.89) with interest thereon from date at the rate of six per cent per annnum, said interest to be due and payable annually until said principal sum has been fully paid off; and the payment of this note is secured by lien adjudged upon about 200 acres of land situated in Washington Co. Ky. Said lien upon same having been adjudged in the case of Sarah M. Browne, etc. vs. Mrs. R. A. Browne, etc. late pending on the Equity Docket in the Washinton Circuit Court. signed (R. A. Browne)
