a. Note:   N1 In the 1865 census Lelah C Smith, 38 was the head of a household in District 04, Huntington, Suffolk co, New York. His wife was Hannah, 36. The children were:
 Ed B 9, Chas D 7, Aug C 5, and Shep H age 0.
  In the 1870 census Selah Smith, 42, was the head of a household in Huntington, Suffolk co, a hotel keeper, born in New York. His entire family was born in New York: his wife Hannah, 40, Charles D 13, Augustus 11, Shepard K 6, and J Brock 3. There were 5 domestic servants noted after them and 8 hotel servants.
  In the 1880 census Selah C Smith 52, was a hotel keeper in Babylon, Suffolk co NY. Hanna was 52, keeping house. Chas D was 22, Augustus 19. Shepard N 15 and J Brock 12 were in school. (the two older sons had no occupations listed)
  In the 1900 census, his name is Sheppard K Smith and he was born Jun 1865. He and Estella L had been married for 9 months so I would think they married in fall of 1899. It was noted that he was 35 years old. He was employed as a clerk. Estella L was born in April 1874 and had no children yet, she was a housekeeper.
  Smith studied shorthand at the New York YMCA and is a good stenographer.
 In 1899 he married Estelle Townsend of New York city, who had been well educated at private schools. Miss Townsend taught school for a time before her marriage. Her father is dead, but her mother Mrs Charles Townsend, of No 168 West 96th street, New York, 70 years of age is living with her daughter and sons Otto Townsend and Dr Wisner R Townsend, a well known physician. Otto Townsend is secretary or Newton Bennington, the well known horseman, with an office in the Gain Exchange.
  Mrs. Smith’s family disapproved of her marriage to smith, and, in fact, so violent was their objection that she and her people are not upon good terms.
  The Smith’s could not find support in New York, and moved to Columbia VA where they boarded in the house of Lionel Ashburner. Mr I Brock Smith, brother to Shepherd K Smith, furnished them money to keep them going.
 I Brock Smith continued to furnish money for their mainenance, but of late has withdrawn his support, and it is thought that shepherd K Smith went to New York to interiew his brother.
  It is known, that Smith will not be tried until the September term, He will have been then confined in the Manchester jail five months.
 In the trial of his wife the witnesses, who will doubtless be the same that will be called by the Commonwealth against him, failed to connect him in any way with the murder of his child, Ralph.
  Smith stated that he knew that his wife whipped the child, and that he never tried to prevent her, because he believed she was acting for the boy's good. A witness for the prosecution, the Turner child, stated that he had seen smith hit Ralph once with what looked like a piece of axe handle. Witness after witness, amongst them Mr WJ Carter, Dr Frazer Smith, Mr and Mrs Ashburner, Mr Cruit, and Mrs Lum, stated that Smith had been kind and affectionate to his child. There does not seem to be any evidence that can injure the man. It would seem that he must be acquitted, although before he is freed he will have spent five months in a prison cell.
  Mrs Smith received many letters for a lady living at No 967 E 168 st NY. She declined to give the house address of her mother in New York, but this was gotten later from New York.
  The preliminary trial will take place this morning at 9am before his Honor the Mayor.
 The burial of Ralph Smith took place yesterday afternoon from Morrisette’s undertaking rooms. The interment was in Maury Cemetery-

  Mrs. Estelle Townsend Smith, of Richmond, Va., was sentenced to five years in the Virginia penitentiary. Judge Clopton denied the motion for the woman by her lawyers, who sought to have the verdict of the jury set aside and a new trial granted. Counsel for Mrs. Smith will appeal to the Virginia Supreme Court. Mrs. Smith was recently convicted of the MKS. E. EMITII. killing of her 5-year-old son Ralph, by repeated and severe beatings and other cruel forms of punishment. The commonwealth's attorney moved the court to dismiss the warrant against Sheppard K. Smith, the husband of tho convicted woman, who has been in custody awaiting trial on the charge of complicity in the killing of the child. The court agreed to the motion and the husband was released from custody.
  In the 1920 census Shepherd lives at 1326 Lexington Avenue in Manhattan, he is renting. His wife is 45 year old Louise who was born in NY of a NY b father and VA born mother. His parents were born in NY. She is a clerk in a wooden ware place.
  His name is Shepard K Smith on his son Richard’s marriage license of 1937
