Note: Samuel Jolly was a farmer, stockman, slave holder, Methodist, and one of the most respected men in Breckinridge Co., KY. When Nelson Jolly, Sr. died at the home of Nelson Jolly, Jr. near Sample, KY in 1819, his sons, Samuel and Nelson Jr. by agreement decided that the next two male heirs would be named after one another so that there would be a Samuel and and Nelson in both branches of the family. The first male heir thus born (after the death of Nelson Jolly, Sr. in 1818) was Samuel James Jolly, born Jan 6, 1820 to Nelson Jolly Jr. and Barbara Claycomb Barr. The second male heir thus born (after the death of Nelson Jolly, Sr. in 1818) was Nelson Jolly, born May 27, 1920 to Samuel Jolly and Agnes Pettypool.

Note: Last Will and Testament of SAMUEL JOLLY Will Book I, Pages 201-204 Breckinridge Co., KY Date of Will: July 10, 1850 Date of Codicil: April 23, 1853 Date Probated: May 16, 1953, Samuel McClarty, Clerk, Breckinridge Co., KY I SAMUEL JOLLY of the County of Breckinridge and State of KY being of sound mind and memory but growing old and approaching near the grave do make and ordain this my last will and testament. EXCERPT: 1st I will and desire that all my just debts and funeral expenses be first paid. 2nd to my son SAMUEL MCCLARTY JOLLY one half of my land to be laid off to take a due proportion of timber, but not the dwelling and other houses. 3rd to my son JAMES WILLIAM JOLLY the other half of the land including the dwelling and other houses. Also my Negro boy, Abel. These devises to SAMUEL and JAMES respectively being in fee simple and over and above their equal shares of the residue of my estate hereafter devised. 4th to my wife AGNES the portion of land devised to JAMES WILLIAM including the dwelling and other houses to have an hold for and during the term of her natural life or widowhood but no longer. The division of said land is to be made as soon after my death as practicable and if they cannot agree the division is to be made by Commisssioner chosen by the parties appointed by the Court of Record. I also will to my wife all the rest and residue of my personal property, money, effects, and slaves to hold for a during the term of her natural life or widowhood and no longer. In case my wife should marry again it is my will that she have one third of my personal property after payments of debts, charges of Administration, etc. 5th to my two grandchildren, the children of STEPHEN JOLLY, dec'd, t is my will that my Executors pay at the death or marriage of my wife, the sum of five dollars each and no more. 6th to my following named children: AILCY BAKER, ELIZA BEAVIN, WILLSON JOLLY, CYNTHIA BURDIT, NELSON JOLLY, POLLY JOLLY, SAMUEL MC JOLLY, AND JAMES WILLIAM JOLLY upon the marriage of my wife should she marry again all the rest and residue of my property not heretofore disposed of (or if at her death, not remarried, including the third which she is to receive in case of remarriage) shall be equally divided between them. 7th sons WILSON JOLLY AND NELSON JOLLY appointed executors. Eskridge CODICIL: I SAMUEL JOLLY, so being weak in body and beleaving I am near unto death But of sound mind and disposing memory do make this change or alteration in this last will and testament. My wish and desire is that if my executors or the survivors of them shall or it may best for my estate and wife are authorized to sell my black man Bob upon such terms as they may think best and put the money to interest but should my wife need the interest or even the principal for her support my said executors are directed to pay to her so much as is necessary for her decent support and the ballance of to descent as devised in the 6th clause of this my last will.
