Note: 1851 Census of Fitzroy, Microfilm # 11716, National Archives of Canada. Isaac is shown as being a Farmer, born in Vermont, No church, age 52. Isaac has died by the time of the 1861 Census. His wife Sara is listed as a widow. The "Surrogate Court Index of Ontario, Canada, 1859-1900, Vol.6, Carleton Co.", lists the will of : Smith, Isaac, Chauncey,(R), Fitzroy, #49, 1860. 6-501 The following probate and will were obtained from the Ontario Archives, microfilm #GS2R19,and transcribed as follows (spelling and punctuation copied from original transcription): "In Her Majesty's Surrogate Court of the County of Carleton Be it Known that on the twenty seventh day of November in the year of our Lord one thousand eight hundred and sixty the last Will and Testament of Isaac Chauncey Smith late of the Township of Fitzroy in the County of Carleton yeoman who died on or about the twenty second day of June in the year of our Lord one thousand eight hundred and sixty at the township of Fitzroy in the Counry of Carleton and who at the time of his death had a fixed place of abode at Fitzroy. Aforesaid in the said County of Carleton was proved and registered in the said Surrogate Court a true copy of which said last Will and Testament is hereunder written and that the administration of all and singular the personal estate and effects rights and credits of the said deceased and any way concerning his Will to be granted by the aforesaid Court to Sarah Smith of the township of Fitzroy in the County of Carleton Widow of the late Isaac Chaunce Smith the Executrix named in the said Will She having been first Sworn well and faithfully to adminster the same, paying the debts.. (rest of sentence illegible.)...and the legacies ordained in his Will Sofar as she is thereunto bound by law and to exhibit a true and perfect Inventory of all and singular the said estate and effects rights and credits, and to render a just and true account of her executorship whenever required by law to do so. Fraser Registrar of the Surrogate Court of the County of Carleton Will of Isaac Chauncey Smith: I Isaac Chauncey Smith of the township of Fitzroy in the County of Carleton and Province of Canada yeoman. Do hereby revoke all former wills codicils and other Testamentary Dispositions by me at anytime heretofore made and do hereby declare this to by my last will and Testament. I do hereby give desire and bequeath unto my wife Sarah Smith all my estate Real and personal and debts due to me and all property of what nature or kind so ever the same maybe which I own. or shall or may at the time of my decease own or be entitled to To be by her the said Sarah Smith enjoyed during the term of her natural life and at her decease to be disposed of in manner following that is to say: to be equally divided between each of the following children as shall survive the said Sarah Smith, that is to say Isaac Chauncey, Emma Caroline, Nelson, James Isaiah, Wakefield, Louis and Samuel, And I do hereby nominate Constitute and appoint the said Sarah Smith Sole Executrix of this my last will and Testament.
