Note:   Summary of Will of William-2, Peter-1 Hallock Wife: Margaratt Hallyock Date written: 02/10/1682 BIOGRAPHY: A Hallock Genealogy, William, Charles, and Lucius Hallock, revised in 1860, 1906, and 1928, respectively, Pg 621: "Only son of original Peter. Was son of Peter Hallock by his first wife, who died in England. (We do not know who she was.) William was born in England about 1610. He died in Aquebogue, or West Mattituck, as now known, in 1684. His burial place is not known. He married Margaret Howell, daughter by a former marriage of Widow Howell, his father's second wife, who accompanied him to Southold, L.I., upon his second visit. William and Mary (sic?) were married about 1640. William and Margaret settled on the land purchased by his father, Peter, in what is now West Mattituck, L. I. He wills the land where he lived to his sons, Thomas and Peter; to his son, William, land near Southold; and to son John, land in Wading River. He was greatly displeased with John because he had married a Quakeress and joined the Society of Friends. "William Hallock, who died Sept. 28, 1684, made a will, which is preserved in the ancient records both of Suffolk county at Riverhead and of New York city. It is dated, Southold (township), February 10, 1682," and was proved Oct. 21, 1684: " I commit my soul into the hands of Jesus Christ my gracious Redeemer, and my body to the earth by decent burial, in assured hope of the resurrection at the last day." He gives his property to his wife Margaret, his four sons, Thomas, Peter, William, and John, and his five daughters, Margaret, Martha, Sarah, Elizabeth, and Abigail. The land where I now dwell at Aquebogue (near Mattituck) and the lane dividing it, he wills to Thomas and Peter, giving Thomas the western half, ‘ except the swamp lot,’ near his house: and giving Peter the eastern half, with the swamp lot and his dwelling. To his son William he gives lands in or near Southold village, and to his son John land in Wading river. The will implies deep sorrow that his son John had married into and joined the then prescribed Society of Friends1, and has the proviso that if any one of his sons "shall apostatize from the Protestant doctrine and faith," or "wilfully and of set purpose contemn and neglect the public worship of God suitable thereto," what is here willed to him shall pass over to "the next lawful heir that shall steadfastly profess and own the said doctrine and faith." __________________________ DAUGHTERS OF WILLIAM HALLOCK The will lists different girls than the 1928 Hallock Genealogy. A researcher has published an article in the Southold Register asking why? He can find no real reason. Particularly substituting Margaret for Mary, although those names could be interchangeable in those times. See article in file. Also, the girls are definitely listed in birth order in the will, different, again, than the 1928 article. From: Smith <ehlsmith@suffolk.lib.ny.us> Date: Mon, 1 Feb 1999 15:50:40 -0500 (EST) Norris- Some additional info on the Abigail Hallock message I sent yesterday: the Fall 1992 issue of the Suffolk County Historical Society Register has an article by Jack E. Phillips, Sr. entitled "The Daughters of William Halliok/Hollyoake (c. 1610-1684)" [vol. xviii, pp. 34-36] in which the statement is made that William Hallock's will is in the Suffolk County Court of Sessions Record Book, pp. 155-159, which is in the Office of the County Clerk, Historic Documents Room. Further, it states that a microfilm copy of that record is at the Suffolk Co. Historical Society (which I know to be true, having used the film just last Saturday on a different matter). This article contains a transcript of the portion of the will naming William's daughters, made from the microfilm. It lists them in age order as Mary, Martha, Sarah, [Abigail-crossed out], Elizabeth, and Abigail "my youngest daughter". Thus, it seems to me the correction regarding Abigail was simply to rectify a mistake in omitting Elizabeth when making the list. Almost all the "original" wills found in probate research are not really the original document signed by the testator, which remained in the family's possesion, but clerk's copies made when the estate was probated. It is the clerk's copies which are the official records retained by the courts. In this case , the clerk probably lost his place when copying the document, skipped Elizabeth, caught his mistake and made the correction. As the article points out, this will contradicts several statements which have appeared in print- William Hallock did not have a daughter Margaret apparently, and Elizabeth was not his oldest daughter. No daughter's married name appears in the portion of the will cited. Unfortunately, the Suffolk Co. His. Soc. does not have a microfilm photocopier. Otherwise I would be glad to send you a copy of the will. However, I can send you, if interested, a copy of this article, and a copy of the will from a very well regarded modern transcription of the Court of Sessions Records. I could also send a copy of another article, from the Suffolk County Historical Society Register, vol. xvii, which questions whether Peter Hallock, supposed father of William, and an original settler of Southold, ever existed. It is entitled "Family Founder Peter Hallock: Fact or Fiction?", and was written by Richard P. Baldwin. Note also, insofar as livestock goes, he was primarily into swine, whereas Barnabas Horton was primarily into sheep. Note also it appears "head" means "house". Most others only had "one" head. Leaves to his beloved wife Margaret Hollyoake, "all that my third lot in the Town Plot next to Tooker's land, with the meadow called Booths meadow, with all the Commonage thereunto belonging, during her life and noe longer." Only she is to give my son William liberty to set up a house in some convenient place and such other benefits from said lands as she sees fit. Also one third of the profits of my land now improved in my lot at Accobauk, where I now dwell, on both sides of the lane or way that divides it, with full power to dwell in my said house at all times she pleases. Also leave her 4 cows and all the working cattle and all household goods, during her life. The will implies deep sorrow that his son John had married into and joined the prescribed Society of Friends. ____________________ Long Island Genealogies Pp 96-97 HALLOCK FAMILY. Tradition says that Peter1 Hallock came with twelve other heads of families to New Haven in 1640; same season crossed the sound and landed at Southold, Peter being the first to step on shore at a spot still called Hallock's Neck. Also, that having bought a large tract of land of the Indians, he went back to England for his family. Wife was unwilling to come, but Peter promised to give her two daughters (by a former husband) considerable land, and the family all came over in two or three years; meantime the Indians had resold his land, and another party had possession. The records of this period are lost. In 1654, according to Southold records, Wm.2 Hallock was in possession of a large property there, and was quite a man of business in the town. He died in 1688 or 1689. Will makes his wife Margaret executrix. The children named in the will were: John3 1679 m. Abigail Sweezey, dau. of John, he d. at Westbury 25, 5, 1737. Thomas,3 Mary,3 Martha,3 Sarah.3 Peter,3 William, wife named Mary. Elisabeth3 m. 1st Harrud, m. 2d 1675 Richard Howell. Abigail3 m. David Horton. The Sweezey's were Friends from Salem, Mass., and Wm. Hallock, who was a strong Church of England man, disiniherited his son John, and any others of the family to all time, if they married or contracted with any Quaker or any son or daughter of a Quaker. W. Case and published in 1882: "Southold ye 22d of May 1666. "More a percell of meadowe purchased of Samuel King lying at Aucquobouke, and between Mrs. Welles her right on the west and Mr Hutchson on ye east. "Entrd. 30 7th month 1675. Pr Benj: Yo. Rdr." "More a percell of meadow obteined of Captn John Yo. by way of exchang, lying at Ocquabauck on this side the River butting and bounding as followeth to ye meadow of Mr John Booth on ye north to ye sea on ye south, and ye east side of ye same creek yt runs up in that meadow.
