Note: Will - "State of Alabama, Cullman County. KNOW ALL MEN BY THESE PRESENCE, That I, Katherina Barbara Meyer, of Cullman County, State of Alabama, being in good health and of sound and disposing mind and memory, do hereby make, publish and declare this to be my last will and testament, hereby revoking all former wills by me at any time heretofore made. FIRST, I hereby direct that all my just debts and funeral expenses shall be paid by my executor as soon after my decease as convenient. SECOND, I hereby give, devise and bequeath to my son Max John Meyer the following property, to wit: The fifth (50) acres situated nearest the west border, running one-quarter (1/4) mile north and south and five eighths (5/8) mile west to east, of "the south half of the north west quarter, section seven, township eleven south, range two west in Cullman County, State of Alabama." This above described property is popularly known among my children as the "Home Place," and is the land up on which the home and other buildings are standing. This property I give to my son Max in recognition of faithful service and care rendered me and his sainted father during the declining years of our lives. THIRD, I hereby direct that all the rest, residue and remainder of my estate, real, personal and mixed, of whatever description and wheresoever situated, or which I may die seized or possessed, or to which I may be entitled at the time of my decease, shall be equally divided among my children, namely, Mrs. Barbara Meyer Brendel, Mrs. Sophie Meyer Grusnick, Mrs. Mary Meyer Hamrick, George, Meyer, Henry Meyer, Jr., and Paul Meyer, and among the children of my deceased daughter Mrs. Anna Meyer Lindeman, namely Margaret Lindeman, Albert Lindeman, Catherine Lindeman and Dorothy Lindeman, and the children of my deceased daughter Mrs. Emma Meyer Fox, namely Fritz Fox, Elizabeth Fox and George Fox. It is understood that each of my children shall receive one-eighth (1/8) part and my grandchildren mentioned above shall receive a proportionate share of the one-eighth (1/8) part to which their mother is entitled. I omit my son Max from the shares in this paragraph, because I bequeath to him the property described in paragraph two. FOURTH, I authorize and empower my executor hereinafter named to collect interest and principal of all outstanding money, and to cancel all mortgages, to sell and dispose of all or any of the real estate of which I may die seized or possessed, at public or private sale, at such times and on such conditions and terms as he shall deem meet or proper, and to execute, acknowledge and deliver all property writings, deeds of conveyance and transfer thereof. FIFTH, I hereby nominate and appoint my son Max John Meyer to be the sole executor and administrator of this my last will and testament requiring him to make an inventory and give bond as the law directs. SIXTH, I hereby bequeath to my children a faithful God and the Savior Jesus Christ to Whom I pray they may be faithful unto death, and an inheritance in heaven where I hope to meet them again. In witness whereof I have hereunto set my hand and seal in my home this seventh day of September, 1933 in the presence of Rev. Henry Meyer and Mr. C.H. Boight, whom I have requested to become attesting witnesses hereto. KATHERINA BARBARA MEYER The foregoing instrument was subscribed, sealed, published and declared by Mrs. Katherina Barbara Meyer as and for her last will and testament in our presence and in the presence of each of us, and we, at the same time at her request, in her presence and in the presence of each other hereunto subscribe our names and residences as attesting witnesses this seventh day of September, 1933.
