Matthews has resided upon and cultivated the Tract of Land Surveyed for the said Matthews, as a preemption claim by L.G. Harman Deputy Surveyor for Lamar District on the day of 18 for the space of three consecutive years and has fully complied with the Provisions of an act granting to settlers on Public Domain Preemption privileges approved January 22nd 1845 that he is a bony fide settler on vacant land that he was a resident settler on the date of the act of February 13th 1834 and has not heretofore secured or appropriated any Land under said act the above facts having been proved to me by the oaths of John H. Matthews and L.A. Matthews two respectable witnesses to me well known.

  !MILITARY SERVICE: TEXAS STATE TROOPS; 1861/1864; COMMENT: Sam served as a private in Capt. John J, Keith's Erath Co. Minute Men, enlisting on 17 August 1861. He was to recieve $25.00 for 17 days of regular scout service. In August of 1862, he was one of twelve men who in joint action sued the state to collect military service pay. In Sam's case, this was the $25.00 for his service in "...Capt. Jno. J. Keith's of mounted minute rangers". On 1 February 1864, he enlisted in The Company For Erath Co. 2nd Frontier District, commanded by Nicolas M. Gillentine, under Major George B. Erath. He is noted as having one shotgun and one pistol, and was to recieve $20.00 for 10 days service.

  !MIGRATION: MOVE TO SAN BERNARDINO CO. CALIFORNIA; 1870; COMMENT: Based on Martha's birth date, it is likely that the family left Houston in the spring of 1870. The August 1870 Arizona census locates the family on the trail. July 1871 voter registration indicates the family was settled in California on that date.
  !DEATH OF SPOUSE: ARIZONA; 1870; Robinson family tradition says that Emeline died during the family migration from Texas to Calfornia. "My mother used to tell her children about Aunt Lina going on that long and dangerous journey to California" [Letter circa 1940 to Martha Mathews Willett from Mrs. A.C.Cathey, daughter of Emeline's brother Williamson Milburn Robinson] Anabel Cowan Baxter of Dublin Texas remembers Emeline's younger half-brother, Rev. O.B.Robinson, telling a family reunion of her death on the journey. "They buried her in the sands of Arizona, possably a highway is running over her now." [Phone conversation 19 November 1992, David Lewis and Anabel Baxter] The 5 August 1870 Arizona Census entry lists the family, without Emeline, in Arizona City. Here the trail crosses the Colorado River to California. This information makes the family tradition very probable.

Mathews died on or about the 29th day of May, 1896, a resident of San Diego County.(b) Estate - About 13 acres of land and improvements thereon, situated in the SW1/4 of the SE1/4 of section 13 R4 SBM in Fallbrook township, and 2 head of horses, 2 cows, 7 calves, one wagon, one buggy. Value does not exceed twelve hundred dollars.(c) Next of kin/heirs in law listed as: Lizzie T. Mathews (your petitioner)his widow. Julia A. Bush, Carrie Hoffman, Ora Studley, Tennie Mathews, Martha Mathews, William J. Mathews, Lewis M. Mathews,His children.(d) No will found.(e) Widow believes she is entitled to letters of admininstration.
 2) Notice of Posting Application for Letters of Administration. Dated 30 June, 1896. Sets date for hearing as 10 July, 1896.

 9) Petition to Sell Personal Property. Filed 12 September, 1896. Lizzie notes;"the 13 acre tract valued at $1,000.00 is the homestead selected by your petitioner before the death of Samuel B. Mathews". The petition claims that the property can be sold to better advantage at private sale rather than public auction.
 10) Order to Sell Personal Property. Filed 12 September, 1896. Asking to sell property listed in appraisement; petition approved.
 11) Claim of A.S.Parker. Dated 16 September, 1896. Approved, filed and registered 7 October, 1896. Claim for medical services on a note dated 13 November, 1895 and "Professional services for self (SBM) and family from Mch 2nd to May 29th 1896, during last sickness" (Document sets date of final illness)
 12) Claim of H. Morrison. Filed and approved 7 October, 1896. Sold on 30 May, Coffin, $40.00, Burial Robe, $6.00.
 13) Claim of Watkins Brothers. Filed 16 October, 1896. Subscribed 30 Oct. 1896. Dated May 31, 1896. Team carring coffin to [grave]. $2.00. August to [sending][serving] note on Ora Studley and going after coffin. (Watkins Brothers was a livery stable. This documents sets the burial date and the burial as local, reinforcing the circumstantial connection with the Mathews/Studley plot in Odd Fellows Cemetary).
 14) Petition To Set Off To The Widow The Estate. Filed 8 December, 1896, states that: (a) Whole value of estate was $1,208.40, personal property $186.40, real estate comprising interest in lots and 13 acre parcel as described in item 8). (b) The 13 acres, apprased at $1,000.00 is also described as "was the premisis upon which your petitioner and the deceased lived at the time of his death, and upon which your petitioner (Lizzie T)prior to the death of said deceased had filed a homestead." (Look for that application) (c) The deceased "left no minor children but left surviving him children who are of age named as follows: Julia A. Bush, Carrie Hoffman, Ora Studley, Tennie Mathews, Martha Mathews, William J. Mathews and Lewis M. Mathews". (d) Property is furthur described as being on the west side of the County Road running from West Fallbroook to the Fallbrook Station. (e) Petitioner (Lizzie) asks that whole of estate be set off to her and she be discharged from furthur administration.
 15) Demurrer. Filed 18 December, 1896. Now come Julia A. Bush, Carrie Hoffman, Orie(sic) Studley, Tennie Matthews, Martha MAtthews, William J. Matthews and Lewis M. Mathews, children and heirs at law of said S.B.Matthews and demur to the petition to set off the estate to the widow. They state petition is ambiguous in sense of definintion of 13 acres or wheather she is seeking all property.
 16) Objections To Setting Off Estate To Widow. Filed 18 December, 1896. Julia A. Bush, Carrie Hoffman, Orie (sic) Studley, Tennie Matthews, Martha Matthews, William J. Matthews and Lewis M. Matthews, children and heirs at law make folowwing objections to setting off all or any property. (a) None of said property is or was community property at time of SBM death, but on contrary all of property was at time of death the separate property of SBM. (b) As it is separate property, the court is only authorized to set it apart for limited not absolute time. (c) That if the real estate was selected by Lizzie Matthews, then this court can only set it apart for a limited period. (d) That all of the parties named as objectors are the children and heirs at law of SBM deceased. (e) That the 13 acres of land (west side county road) petitioner is seeking to set off and assigned to her absolutely was recorded by said petitioner as homestead out of separate property of deceased.

 19) Order Of Distribution. Filed 18 Dec. 1896 "Order setting apart entire estate to widow", court overrules objections by Julia A. Bush, Carrie Hoffman, Ora Studley, Tennie Matthews, Martha Matthews, William J. Matthews and Lewis Matthews and awards property to widow who has "no property of her own nor means of support and maintence". The value not to exceed the amount of $1,208.40. Property defined as: 1) 4/6 interest in lot 6, block 10, West Fallbrook. 5/6 interest in lot 7, block 10, West Fallbrook. 13 Acres of land lying west of the county road leading from West Fallbrook to the Fallbroook Station in the west half (W 1/2) of the south west quarter (SW 1/4)of the south east quarter (SE 1/4) of Section 13, Township 9 South, Range 4 West, SBM. together with all improvements.
