On this 16th day of August A D 1871 comes George W Johnson of said county and being sworn says that: "I was sitting down at my brother Elijah Johnson in Howell County, Mo. I did not know that there was anything up until i heard a pistol snap or click which made a noise. I sat there a few moments and looked and saw Zeke Collins putting a pistol in his scabard. I got up- he walked toward the wall- I went and asked him again-- he said "No, by hell, he didnt." Then I went off and sat down in a corner. I saw somebody come crawling up on his all fores toward where I was sitting in the corner-- then I peeped through a crack and saw him go under the crack I was looking through and went out of my sight. Then Zeke Collins' wife came to me and told me I'd better get up from there. I went and put some --- on to ----. Then I went back and sat down in the same corner where I was sitting and Aaron Collins came and sat down by me and asked me if I was going home, then I told him "I told him I believed I wouldnt go, then and then I asked him if Zeke was mad at me." I desremember what he said- he said Zeke was out in the yard, lets go out there and see. I told him i would not go, that I'd see him some other time. So we started and I got to the door. My brother cetched me by the arm adn would not let me go and then he shuck me and asked me what was the matter. I told him Zeke snapped a pistol at me and I wanted to go out and see if he was mad at me. Somebody began to kuss out in the yard and call me a damed rascal, a horse theif ------etc.. Zeke came in a kussin and talked like he wanted to fight me in a fair fight. Aaron Collins stood sorter behind me with his pistol, do not know whether it was cocked or not. I looked around and Zeke's wife had hold of the pistol or his hand and dont know which. The went out doorses. some how, they was either put out or went--- and tried to get me out ----- I wouldn't go out. Directly Aaron come around riding on his horse and brother talked with him and tried to get him to make it up--- he talked like he would--- he went off directly. Then Zeke come around--- they talked to him and he sat down-- they tried to get him to go off-- they went off--- soon after that there was a rock throwed and hit me in the side--- the rock came through the chinky place--- but i did not see anybody out there. I heard somebody going off hollering--- Rock was bigger ern my fist but not so large as two fists--- Cross examination: I heard a pistol crack--- but did not see anybody cock it. I saw Zeke putting a pistol back in scabard. Did not see anybody stoping him. It was pretty dark--- dont know who called me a son of a bitch---I saw Aaron have a pistol. Dont know how he got the pistol--- Had the pistol sorta up-- made no threats--- there was a rock throwed--- it hit me in the side---I didnt see anybody out there--- dont know who threw it. his George W X Johnson mark Subscribed and sworn to before me this 16th day of August, 1871 S Y Franklin Isaiah Collins of lawful age being sworn says: "I live in Spudue, Texas County, Missouri. The first I knowed of the fuss, Aaron Collins and Zeke was trying to get George out of the house. I tried to get them to drop it-- they went in the house-- I saw Aaron Collins trying to strike George Johnson with a pistol and Deen Collins caught the pistol, or his arm-- they came out--got on his horse. I took the pistol from him and kept it some time. Zeke Collins told me if I would let him have the pistol, they would go home. I let him have it. I seed Zeke throw a rock-- there was nobody with him, he throwed the rock-- he was by himself-- the throwed toward George. I heard Aaron Collins say that would do him until he could get him out of the house--- I heard somthing strick--- Several in the house commenced screaming as soon as the rock was threw. I heard Zeke say that he knowed he must be hurt miserable bad for he just rared to his tip toes when he throwed it. I saw Aaron at the crack of the house with a pistol in his hand but didnt see him try to shoot--- he had the nose of the pistol in the crack of the house-- this was all in Howell County, Missouri, on or about the 9th of August, 1871. Cross examination by deft.: Didnt know whether Aaron Collins got the pistol from or not- he has it up in his hand--- I never heard him say anything, I dont know whether he was trying to strick or not--- he didnt hit him at that time. His Isaiah X Collins Mark David Collins of lawful age being sworn deposeth and says: I live in Howell County, Missouri--- I dont know the beginning of the full ---- I saw G W Johnson sitting by Zeke's wife--- Aaron went and sat down by the two and laid his arm on the shelf-- the nose toward George Johnson-- they all jumped up and hollered. Aaron Collins told me that Zeke would hurt him before he left there--- said he was going to Arkansas and didnt care if he did kill him-- they went in the house--- Aaron Collins had a pistol in his hand and told George Johnson to go out with him but the girls would not let him go out--- the boys went out-- Aaron swore that all he wanted to see of George Johnson was his head--- did not hear him say he would kill him. The Collins seemed to be pretty mad--- the fuss happened about midnight--- they left just before day--- and Cely Collins took the pistol from Aaron-- I saw no rock throwed--- I saw a man run around the house and heard a rock strick--- Aaron run on one side of the house and polked a revolver through a crack and Zeke run on the other side and threw the rock-- the boys asked me where the rock hit him, and if he was hurt very bad--- they was all around Johnson, so they could not shot him without hurting someone else. Cross Examination: I did not see him strick him-- I saw the musel of the pistol through the crack-- dont know whether it was cocked--- I dont think anybody out there prevented him from shooting outside. David Collins Subscribed and sworn to before me this 16th day of August, 1871 S Y Franklin, J P Nancy Collins of lawful age being sworn deposeth and says: I live in Texas County, Missouri--- I was at Elizah Johnson's on the 8th or 9th of August, 1871--- I heard Aaron Collins say to Zeke Collins to wait till he could get a chance and he would shoot him through the crack of the house--- I begged Aaron Collins not to shoot George adn caught his revolver and kept him from striking George Johnson--- I saw a pistol through the crack of the house in the hand of Aaron Collins--- he had the pistol presented toward George Johnson's head--- I went out and he dropped the pistol down-- I begged--- he told me he was not going to hurt George-- us girls got around George Johnson to keep them from shooting him--- the Collins were in bad humor at that time. Cross Examination by deft: When I went out he said he did not want to hurt George-- I saw a pistol poked through the crack by Aaron Collins-- it was when he was out of the house he said he did not want to hurt George. Subscribed and sworn to before me this 16th day of August, 1871. Caroline Johnson being sworn and examined deposeth and says: I am the wife of Elijah Johnson--- I was at home on the 8th of this month-- I heard Mr Aaron Collins say nothing would satisfy him but George Johnson's life-- this Aaron Collins is one of the prisoners now here in court-- I heard Aaron Collins say that all he wanted to see George Johnson out of the house--- this was in Howell County, Missouri. Cross Examination by deft: These threats were before day at my house--- it was after he drew the pistol that the threats were made. He Dropped Dead When Charley Collins Pointed Pistol At His Son�s Breast. "My God, don�t shoot." With these words on his lips, Ezekiel Collins, one of the old residents of the Collins settlement, dropped dead Sunday morning. Three feet from the spot where Ezekiel Collins breathed his last. Charley Collins stood with a pistol pointed at the breast of Lee Collins, a son of Ezekiel Collins. The fear that his son would be shot to death caused Ezekiel Collins to drop dead. Ezekiel Collins was one of the older members of the Collins generation, whose descendants are scattered along the western border of Howell county, in the neighborhood of the old town of Horton. In the early days when much pine timber was found in that part of the country, a railroad extended to Horton from Burnham. This road was ten miles long and was taken up fifteen years ago after the timber was cut out. Although the ____have been taken away from Horton a few houses remain. In one of these Ezekiel Collins had a store. Sunday morning Ed Moore, Joseph Lowe, Walter Keller and several others was pitching horse shoes in front of Collin�s store. Collins and his son, Lee Collins, 20 years old were watching the sport. In the distance they heard some shooting and said Charley and Ike Collins, brothers, came riding up. "We�re the best men in old Horton and can whip anybody in this crowd," one of them shouted with an oath as they both leaped from their horses. Lee Collins took exceptions to the boast of his cousins, and a quarrel ensued. Eye witnesses� to the affair say that during the quarrel Charley Collins drew his revolver and pointed the weapon at the breast of Lee Collins. This frightened Ezekiel Collins, who had heart trouble. The old man threw up his hands when he saw his son�s danger and dropped dead. Charley and Ike Collins then rode away. No shots were fired by any of the party. Deputy Sheriff Levi Collins, who resides in the neighborhood was notified of the affair. In company with Ed Moore, an eye witness to the exciting experience, the officer came to West Plains. Warrants were issued for the arrest of Charley and Ike Collins, charging them with carrying concealed weapons. Deputy Sheriff Levi Collins rode horseback from his place to Horton to serve the warrants while Deputy Sheriff L. R. Huston went to Willow Springs to watch the trains, as it was believed that Charley and Ike might leave the country and would come to that place to hoard a train. The men were found at their homes by Deputy Sheriff Collins and placed under arrest. They were brought to this city and lodged in jail. The Collins settlement has became notorious for the many events that have occurred within its borders. There are many families of this name in the settlement, numbers of whom are not related.
