a. Note:   Proof that the father of Levi Eakes was Dudley Eakes iscontained in Dudley's will.March 15, 1837: Levi Eakes purchases 80 acres of land inHancock County, Indiana from the US govt. A copy of thedocument is in possession. The document says that Levi Eakeswas from Wayne County, Indiana at the time of purchase. Hisfather, Dudley, purchases land at the same time.Levi's brother, Jeddiah, had already purchased land in HancockCounty two years earlier on Sept. 9, 1835. From the landdescriptions, it looks like the two lands bordered each other.Their father's land also borders that of the two brothers.1840 Hancock County, Indiana census:one male less than five years old - Joseph Robert Eakesone male between 5 and 10 yrs old - John L. Eakesone male between 10 and 15 yrs old - who is that?one male between 30 - 40 yrs old - Levi is actually 26 yrs oldone female less than 5 yrs old - who is that?one female between 20-30 yrs old - Martha is actually 37 yrsold. (She always shaves 10 yrs off her age to the censusperson!)**********************************************************1847: Levi and Martha sell land to a 'David Eakes' - possiblyLevi's brother.Hancock County land deeds, Book M, page 382:This ...... made this 18th day of January in the year of ourLord eighteen hundred and forty seven between Levi Eakes of theCounty of Hancock and state of Indiana of the one part and DavidEakes of the county and state aforesaid of the other partwitness that the said Levi Eakes for and in consideration of thesum of thirty dollars to him in hand paid the receipt whereof hedoth hereby acknowledge hath granted, bargained, sold, conveyedand confirmed unto the said David Eaks, his heirs, and assignsforever a certain tract or parcel of land in the county ofHancock aforesaid it being the east half of the north eastquarter of section number (36) in Township number (17) .... ofrange number (6) east containing eighty acres it being in thedistrict of land subject to sale at Indianapolis, Indiana,together with all the rightly privileges and appurtenancesthereunto belonging and the .... remainders and profits thereofand all the estate title and interest of the said Levi Eakes inlaw or equity in and to the same to have and to hold the landshereby conveyed with all the appurtenances there unto belongingto the only proper use, benefit and behoof of him the said DavidEakes, his heirs and assigns forever in witness where of thesaid Levi Eakes and Martha Eaks have hereunto set their handsand seals the day and year first above written. Levi died 25 days after this notewould have come due. Apparently, the debt was not paid and theland was tranferred back to Wiley Walker after Levi's death.Court papers asking for this tranfer are on file on Monday, May28, 1850 - Wiley Walker vs Martha Eakes and others. Martha wasserved papers three times by the sheriff's office but did notreact or show up for the hearing.Question: What happened to Levi that he did not pay the debt?1. Levi did not make a go of the farm and could not pay off the$1000.2. Levi became ill and died.3. Levi took his life?4. Levi was in a farm accident and died?Where was the land located? Carmel Cemetery in Hancock, INDirections: Go to Gravel Lawn Cemetery in Fortville. It's onthe same road. The Road is Connecticut Boulevard. Follow itwest for about 5 miles. It is a small cemetery, located nextto a church which has been converted to a private home. It'son the right side of the road.Offspring:Joseph Robert Eakes - our ancestorAndrew Eakes 4/7/1841-1/25/1863 He died in the Civil War and wasburied in the Nashville Memorial Cemetery. He was marriedbefore he died.John Eakes 2/9/1844-died same dayIn the 1850 census, all the ages are correct. A Josiah Eakeswas listed as being part of the household and Levi was alreadydead.In the 1860 census, Martha and her two sons, Joseph and Andreware listed along with Helen A. Eakes. I don't know who she is.Martha's assets increased from $600 in 1850 to $1750 in 1860.She also had an income of $536. Andrew was listed as 19 yearsof age and his occupation was farming. Martha's age was off by10 years.
