Note: August 1837:Tuesday morning, ten o'clock, Court met provision foradjournment...judges as yesterday.In the matter of the estate of Andrew Eakes, deceased:Letters of Administration on the estate of Andrew Eakes late ofHancock County, Indiana. Deceased having been granted by theclerk of this court on vacation, to Dudley Eakes, and the ?????fully seen and inspected, it is ordered, and adjudged that thegranting of said letters be and is hereby confirmed.[So....Dudley could be the son OR the brother of this particularAndrew Eakes. Sigh. They coulda said!!!!]This appeared in the Indiana Court Records - Probate Order Book1828-1843, page 130. Dudley Eakes is appointed administrator ofthe estate of Andrew Eakes who died August 15, 1837.********************March 15, 1837: Dudley Eakes purchases 80 acres of land inHancock County, Indiana from the US govt: Certificate # 17479 Acopy of the certificate is in possession. The certificate saysthat Dudley was from Wayne County, Indiana at the time ofpurchase. His son, Jeddiah, had already purchased land inHancock County two years prior. Dudley and son, Levi, purchasedland bordering Jeddiah's at the same time.*********************September 9, 1835: Dudley purchases an additional 80 acres ofland in Hancock County, Indiana***********************He appears in the 1840 Indiana census for Hancock County. Thereis, in the household, one male aged between 10 and 15 (Josiah?),one male between the ages of 50 and 60 (Dudley himself) and onefemale between the ages of 50 and 60 (wife Marjary). Only oneother child, Mary, is of an age where she could be in the house.But, at 17 years of age, it is entirely possible that she isalready married. Isiah would be 18 in 1840 and probably out ofthe house, David would be 22 and all the other children areolder than the ones mentioned here.*************************History of Hancock County, Indiana: Very early in the historyof the township (Green), Dudley Eakes runs a tannery in thesouthwest part of the township, on Leander Robert's farm. Hisvats consisted of large troughs made of walnut., It was in thenorthern part of section 36, township 17, range 6, probably inthe latter thirties (1830s) or early forties, and......(In the early 1840's the Leander Roberts that we know of wasborn in 1829 which would mean he would be a teen-ager. Perhapsthere was more than one Leander Roberts? OR perhaps the book wasonly pointing out that the tannery used to be located on what isnow Leander Robert's farm. Josiah Ellis was selling land to Dudley?]I Dudley Eakes of Hancock County in the State of Indiana do makeand publish this my said will and testament hereby revoking andmaking void all former wills by me at any time heretofore made.First, I ???? that my body be decently interrred and that myfuneral be conducted in a manner corresponding with my estateand satisfaction in life and as to such would by estate andsituation in life and also ?? would be ?? do it has blessed Godto interest me with I dispose of the same in the followingmanner to wit.I direct first that all ???? debts and funeral expenses be paidas soon after my decease as possible out of the first money thatshall come to the hand of my Executor. Second I give andbequeath unto my beloved Wife Mar??ery (Marjary) all personalEstate as long as she lives after the debts and expenses arepaid.That I give and bequeath unto my beloved wife Margary all myreal estate as long as she lives.Forth (sp) I give and bequeath unto my oldest daughter, MaryJohnson, the 80 acre lot of land on which she now lives beingthe East half of the North west quarter of Section 36 in Town 17North of Range 6 East containing 80 acres. This bequest is totake place at the death of my wife or in other words, it is myintention that Mary Johnson shall have the above described landin ??(fee simple?) to her and her heirs after the death of mywife.Fifth I give and bequeath unto my son Levi a certain three yearold horse being the Sorrel Colt.Sixth I give and bequeath unto my children after the death of mywife the tract on which I live being the East half of the NE qrof Sec 36, Town 17, Ran 6 East.
