  George Van was murdered. He and his brother had left the polls with George Van on horseback and Anderson Wallace in a buggy. They were stopped by Frank Sutton and a friend who were both on horseback. Sutton accused Wallace of stealing and branding a neightbor's cow. There was an argument which looked like it was leading to a "fisticuffs" as refported by Suttons friend in his deposition. As Wallace left the buggy, Sutton returned to his horse and drew his gun. George Van stepped in front of Wallace in what the friend took as a jesture to break up the "fight". Sutton shot George Van through the head killing him instantly. Sutton then mounted and took off. Wallace went to his buggy, pulled out his rifle and shot several times. More than one bullet hit Sutton, finally killing him. Per the legal records, Wallace was originally arrested for carrying a weapon to the polls. Records show that the sheriff was not filing charges against Wallace. At some point after that he was charged with murder. He was convicted in Harris County, but on appeal in Montgomery County he was aquitted. There are no transcripts of the trials. There are lawyers notes, jury lists, witness lists, summons jail charges and judge instructions. Wallace did brand another's cow, but restitution was made. Sutton was at one time a law enforcement officer in Harris County. It would appear that Wallace and Sutton must have had a long standing fued of some type. Whatever the case, the killings left 2 widows, each with 5 children. In the 1900 census, each widow has a brother-in-law living with her. Clyde Charles was with Augusta.
  Some family members state that George Van's daughter Oddie was also in the wagon that day and witnessed her father's murder, perhaps leading to her problems with mental illness later in life. However, there are no records of her presence that day.
  Per Marzee Goodson Ware, the shootings took place at Cooper Hills School which was later attended by George Vans grandchildren.
  Also, during slack times, some farmers hauled lumber. George Van sometimes took his wages in lumber and from that he built his home.
  Per Marzee and Mertis Goodson, George was always referred to as George Van.
