The petition states that Virginia Cuthbert, died interstate in Harney County, Oregon, on October 4, 1956, as a result of mortal injuries sustanined while riding as a guest passenger in an automobile owned and operated by Clifford Pamperian on U.S. Highway No. 20 at a point about thirty miles East of Burns, Oregon. That the automobile was driven in a generally westerly direction on said highway and left the highway and overturned causing the injuries to decedent resulting in her death. Said motor vehicle was being operated without gross negligence and that the attorney for Administrator has advised him that the question of liability is uncertain and that the defense of contributory negligence could possibly be established in the event recovery were sought from said Clifford Pamperian. Deloy Cuthbert paid for Virginia Sharp to be buried. He wanted to make sure she had a tombstone, and did not want her to be buried by the state. Even though he was divorcing her at the time of the accident, he still felt like he should give her a proper burial.
