Plainly exhausted, he offered no resistance although armed with a rifle and a .38 revolver, and a belt of cartridges round his waist. He turned out to have a number of buckshot wounds on his back and elsewhere, a partly due to a scar on his neck was quickly identified as Nick Lamar. A couple of weeks later, Friday, May 4, officers at Amarillo, Tex., stopped a Nash car and arrested the occupants, who transpired to be the much-wanted Big Boy Berry, a convicted Texas horse-thief named Carl Priss, and Al Spencer's girl friend, Goldie Bates. The car was found to have been hijacked from a man in Ochelata, Okla., the evening before the Pawhuska raid. The trio were returned to Oklahoma where Priss and the girl were freed soon after, no evidence being found to connect them with any current crimes. There was some debate as to what to do with Lamar and Berry. Both were suspected in Oklahoma bank robberies, where the penalty for bank robbry was five to fifty years. In Arkansas, the maximum penalty was twenty-one years, but what tipped the balance was that, presumably, to avoid charges in the Pawhuska affair, the pair confessed to the Gentry robbery and were duly handed over to Arkansas In the Benton County circuit court at Bentonville on June 2, 1923, they were convicted and consigned to the State Penitentiary; Berry for 7-10 years, Lamar for 15-20 years. * "Daily Journal-World" Lawrence, Kansas Thursday, March 21, 1935 pg. 4 Kansas News Briefs ElDorado, Kan., March 21 (AP) -- Trial of Ira Clark, ex-Oklahoma convict, charged with robbery of the Benton, Kan., State bank March 12, 1933, opened here yesterday. Clark is alleged to have stolen $5,000 and a safe valued at $300. The safe later was found on the Ora Brackett farm near Mannford, Okla., along with several other stolen safes. Nick Lamar was involved in a murder case in 1910 when he killed Eugene Gunn at a cardgame in the Barlow Block uptown (108-110-112 Jackson St). So now I am curious if there are records for Kansas State Penitentiary available? The subject of my request is of course, Nick Lamar, an inmate from Georgia at Kansas State Penitentiary in 1920, according to the Census for that year. Having looked through historic newspapers I think I made the discovery that he may have escaped from this facility in about 1922. It appears that he led a notorious life, and after escaping, ran with "The Spencer Gang" who created much havoc in Kansas, Oklahoma, and Arkansas in the 1920's. It seems that Nick Lamar was caught in about 1923 and possibly sent back to this facility. Then, perhaps in about 1933, it seems that he was caught again in crime and possibly returned there. Anyway, the real thing I am trying to find out is if he died in the prison systems, and am trying to find a death date, and place. I am also wondering if there could be information in the Freedom Of Information Act that I could obtain. Any information would be helpful. Obviously that search came up empty but the good news is the Kansas State penitentiary records are still intact and available. They are at the Kansas State Historical Society. You can find their contact information at KSHS.org. In terms of locating death records independent of his prison file, birth and death records are the domain of the state. If you think he died in Kansas the staff at the state historical society can help you with that as well. If he died in a different state, just contact the state archives for the appropriate state.
