Resume of Evidence: This is an undefended action for divorce, tried at Calgary, Alberta on the 13th day of March 1945, before Mr. Justice Parlee. The plaintiff stated; that she [is] employed at P. Burns and Co., as an Egg-Grader, and was the wife of Harvey McBee, who was living at Cochrane and is a truck driver by occupation. The defendant was born in the United States, and came to Canada in 1909 and homesteaded in Saskatchewan. He returned to Des Moines in 1914. The defendant married the plaintiff on the 22nd day of August, 1914, then came to Alberta in 1930, and with the intention of staying here permanently and commenced farming operation, which he carried on near Carstairs until 1942. There is a large family of children, but only three of them are not self-supporting and are in the custody of the mother, in Calgary. The defendant has been living with a woman by the name of Margery Bowbey of Cochrane. The plaintiff has been able to support the chilfren and herself from what she earned and through the efforts of the police. The defendant served thirty days in Lethbridge for non-support. On the 14th of October the defendant was found in bed with a woman who is unknown to the plaintiff and is believed to be some woman from Cochrane. The plaintiff denied collusion, condonation, or connivance.
