Title: WILSON, Joseph (Will) Author: Joseph Wilson Will Text: Will of Joseph Wilson ===============Page 1 =============== THIS IS THE LAST WILL and Testament of me Joseph Wilson of Cannon Street in the city of London, Hop Merchant being of sound mind, memory and understanding do make and declare this my last Will and Testament as follows. First I direct all my just debts and Funeral expences to be fully paid and satisfied and I give and devise unto my Brother Thomas Wilson of Catherine Court in the City of London Merchant Thomas Hodgson of Church Lane Whitechapel in the County of Middlesex Sugar Refiner William Henderson of Tower Hill London Cornfactor and John Elstob of Catherine Court London Gentleman All these my freehold messuages hereditaments? and premises situate in Laurence Pountney Lane Cannon (verified on map) Street London and all other my Freehold estates over which I have a power of disposition with their and every of their appurtances and all that messuage or dwellinghouse with the appurtances wherein I now dwell for such estate Term and interest as I shall leave therein at the time of my decease and also all that my leasehold Messuage Lands and Tenements situate lying and being at Newbiggen in the parish of Ireby in the county of Cumberland now in the occupation of my tenant John Gilbanks which I hold by Lease under the Dean and Chapter of the city of Carlisle for all my estate and interest therein at my decease ========= Page 2 =============== to hold the said freehold and Leasehold premises aforsaid unto and to the use of said Thomas Wilson Thomas Hodgson William Sanderson and John Elstob their heirs Executors administrators and assigns upon trust that they the said Thomas Wilson, Thomas Hodgson, William Henderson and John Elstob their heirs executors administrators or assigns do and shall where and so soon as conveniently may be or as my said trustees think proper sell and dispose of either together or in parcels all my said freehold and leasehold premises for the most money and best price and prices that can or may be reasonabely had or gotten for the same and do and shall place out or invest the money which shall arise from such Sale or Sales in or upon Governnment or real Securities at Interest in their own names and from time to time alter and transpose such Securities and Funds until the Money placed out thereof shall become payable by virtue of the trusts and Directions hereinafter contained and do and shall stand and be possessed of the Money so to be placed out or invested upon the trusts and to and for the interests and purposes herein after mentioned expressed and declared of and concerning the same and I give and bequeath to my dear wife Sarah Wilson all my household Goods Furniture Silver China Plate and Books in and about my dwellinghouse in Cannon Street aforesaid or wherein I may reside at the time of my decease to and for her own use and benefit and I also give and bequeath to my said wife the sum of one hundred pounds of lawful money of Great Britain to be paid to her by my Executors immediately after my decease. And I give to my said trustees their executors adm(inistrato)rs and assigns my gold watch chain seals and rings upon trust as soon as they conveniently can after my decease to deliver the same to my son Roger Williamson Wilson to and for his own use and benefit and I give to the said Thomas Wilson, Thomas Hodgson, William Henderson and John Elstob the Sum of Twenty pounds apiece of like lawful money for the care and trouble they may have in the execution of this my Will the same to be received by them as soon as conveniently can be after my decease And as to all the residue and Remainder of my Estate and Effects Ready Money, Debts and Securities for Money, Stock Merchandise and all other my personal Estate whatsoever and wheresoever and of what nature said Thomas Wilson, Thomas Hodgson, William Henderson and John Elstob their Executors Administrators and assigns upon trust to sell dispose collect receive get in and convert the whole thereof into money and thereout to pay my debts and funeral expenses and the expenses of proving this my Will and to pay and retain the primary legacies herein before given and as to the residue of the money to arise and be produced from the residue of my personal estate after payment of any debts and funeral expenses and the expenses of proving this my Will and the Legacies herein before directed to be paid thereout upon trust that they the said Thomas Wilson, Thomas Hodgson, William Henderson and John Elstob and the survivors or survivor of them his Executors and administrators shall and do place out and invest the same at interest upon Government or real securities in their own names and do and shall from time to time alter vary and transpose such stocks funds and securities as often as they shall see occasion and I declare and direct that the said Thomas Wilson, Thomas Hodgson, William Henderson and John Elstob and the survivors and survivor of them his Executors and administrators shall stand and be possessed of and interested in all the same monies, stocks funds and securities upon the trusrs following that is to say upon trust that they the said Thomas Wilson, Thomas Hodgson, William Henderson and John Elstob and the survivors and survivor of them and the executors or administrators of such survivor shall and do in the first place set apart the sum of two thousand pounds part thereof and pay the Interest thereupon arriving unto my said wife Sarah Wilson or her assigns for and during the term of her natural life if she shall so long continue my Widow and from and after her decease or second marriage which shall first happen then I direct that the said Thomas Wilson, Thomas Hodgson, William Henderson and John Elstob and the survivors and survivor of them his Executors or administrators shall stand and be possessed of and interested in the said sum of two thousand pounds and the stocks funds and securities =================Page 4============= thereof upon the same trusts intents and purposes as are hereafter declared concerning the remaining part or ultimate residue of the monies last herein before directed to be invested or placed out at interest or such of those as shall be then subsisting or capable of taking effect and I declare and direct that the said Thomas Wilson, Thomas Hodgson, William Henderson and John Elstob and the survivors and survivor of them his Executors and administrators shall stand and be possessed of and interested in the remaining part or ultimate residue of the monies last hereinbefore directed to be invested or placed out at interest and also in all and every sum and sums of money to arise from the sale of my said freehold and leasehold estates and hereinbefore directed to be invested or placed out at interest In trust for all and every my child and children living at my decease my decease or born in due time afterwards in equal shares if more than one and for their respective Executors, administrators and assigns and if I shall have but one such child then In Trust for such only child his or her executors or administrators but if any one or more of my said children shall happen to depart this life under the age of twenty one years then as well the original share as every other share of him her or them so dying of and in the remaining part or ultimate residue of the monies last hereinbefore directed to be invested or placed out at interest and also of and in the sum and sums of money to arise from the sale of my said freehold and leasehold estates and hereinbefore directed to be invested or placed out at interest shall be in trust for the others or other of them in equal shares if more than one but shall not be vested or payable sooner than the original share or shares of such other or others of them shall become vested and payable provided always and it is my Will and meaning and I do hereby direct that my said trustees and the survivors or survivor of them his Executors and administrators do and shall during the respective minorities of my said children pay and apply the dividends and interest of their respective shares of the said several monies herein before directed to be invested or placed out at interest for the maintainance and education of my said child or children and also do and shall of their own proper authority assign dispose of and apply and I declare and direct that if I shall have no chikld or children living at the time of my decease or born alive in due time afterwards or having such all of them shall die under the age of twenty one years that thou the said Thomas Wilson, Thomas Hodgson, William Henderson and John Elstob their Executors administrators and assigns shall stand and be possessed of and interested in the said remaining part or ultimate Residue of the monies last herein before directed to be invested or placed out at interest and of and in the sum and sums of money to arise from the sale of my said leasehold and freehold estates and hereinbefore directed to be invested or placed out at at interest or so much thereof as shall not have been applied for the advancement of any of my children according to the power hereinbefore contained in trust to continue the sum of two thousand pounds part thereof in the funds stocks and securities and pay the Interest and dividends thereof as the same shall be received unto my said wife to and for her own use and benefit for and during the term of her natural life or so long as she shall continue my Widow in addition to the Interest of the said sum of two thousand pounds first hereinbefore directed to be appropriated for her benefit and as to the residue thereof and also as to the said two sums of two thousand pounds and and two thousand pounds after the death or marriage of my said wife and such failure of my children as aforesaid the same share be in trust for my brother Thomas Wilson his executors administrators and assigns to and for his own and their own proper use and benefit and I do hereby declare and direct that the receipt and receipts of the said Thomas Wilson, Thomas Hodgson, William Henderson and John Elstob or the survivors or survivor of them or of the heirs Executors Administrators or ================Page 6==================== or assigns of such survivor shall from time to time be a good and sufficient discharge and good and sufficient discharges to the purchaser or purchasers of the said several premises so to be sold as aforesaid or any of them or any part or parts thereof and to his her and their heirs Executors, administrators and Assigns for so muchof the purchase money as shall be therein acknowledged to be received and that such purchasor or purchasors his her or their heirs Executors , Administrators and assigns shall not afterwards be answerable or answerable for any loss misapplication or nonapplication of such purchase money so received or any part thereof and I declare and direct that in the meantime and until the sale or sales hereinbefore directed to be made of my said freehold and leasehold estates shall have been made and executed the rents and annual profits of the said estates hereinbefore directed to be sold shall be applied and disposed of in the in the same manner and for the same purposes as the interest of the money to arise and be (produced by and with Sale or sales as would after such sale or sales be) payable or applicable to by virtue of the trusts and directions of this my Will in case such sale or sales were actually made and executed and I declare and direct that if the said Thomas Wilson , Thomas Hodgson, William Henderson and John Elstob or any of them shall die or refuse or decline to act in the trusts of this my Will then a new trustee or trustees may be appointed by the trustees or trustee so declining to act or the executor or administrators of such of them as shall so die and the said Trust Estate monies and premises shall in that case be conveyed and assigned so as to be vested in such now and such surviving or continuing trustees or trustee or in such new trustees wholly as the case may happen upon the same trusts and with the same powers as are hereinbefore mentioned and declared and so from time to time as often as that case shall happen and I do hereby nominate and appoint the said Thomas Wilson, Thomas Hodgson, William Henderson and John Elstob Executors of this my will and I appoint the said Thomas Wilson, Thomas Hodgson, William Henderson and John Elstob( and the survivors and survivor of them guardians & guardian of my said children durin their respective minorities and I give to the said Thomas Wilson, Thomas Hodgson, William Henderson and John Elstob) their Executors and assigns all such real estates as are now vested in me by way of mortgage in order to enable them with the greatest ease and convenience to recover secure and get in the money secured by such mortgages for the purpose of this my will and I give to the said Thomas Wilson, Thomas Hodgson, William =================Page 7==================== Henderson and John Elstob their heirs and assigns upon the trusts affecting the same and I declare that the provision hereby made for my said wife is intended to be and shall be accepted by her in full discharge of her dower and every other claim which she can or may or otherwise might be entitled to out of my real and personal estate or either of them or any part or parts thereof save and except such benefit as she is entitled to under the settlement made previous to our marriage and I declare that my said executors and trustees and the trustee or trustees for the time being of this my will shall not be answerable out for another and by no means for involuntary losses and that they shall be allowed and may return to and reimburse themselves all their costs, charges, damages and expenses to be occasioned by the due execution of the trusts hereby in in them reposed and I hereby revoke all former wills in witness whereof I the said Joseph Wilson the Testator have to the Six first sheets of this my last will and testament contained in and written on seven sheets of paper affixed together at the top and then sealed set my hand and to this seventh and last sheet thereof set my hand and seal this Eighth day of January in the year of our The Will of Joseph Wilson was written in 1806 so Thomas was still at 10 Catherine Court then, this is the last written record before the new occupier was there in 1815. |
