Note: John the Constable. Hurt, Oscar H., THE EARLY HURT FAMILY OF VIRGINIA: a compilation, 1963 pg. 15, (unpublished typed document) FHL# 34425-13. O. Hurt also assigns a Philemon Hurt who d. in Caroline Co. in 1736 as a child of John the Constable, but he would seem to be rather the son of William "the Elder". Comments onf three items in Spotsylvania (County) Order Books 29, 36, 37 fot 1724-1730. On pg. 153 occurs this; coving the court session for 3 May 1727: "In the action of trespass and assault brought by William Mays against John Hurt, defendant, no proclamation being filed, ordered that this suit be dismissed." On pg. 153 of same: "Debt action by Henry Webber against Daniel Brown: plantif failed to appear; dismissed." On pg. 156, "In action of debt brought by Henry Webber against John Hurt, defendent, who not appearing to answer the suit, at the plaintiff's motion and order is granted against him, the said defendant, and John Smith, his security." The scene of this action appears to be in that part of Spotsylvania cut off in 1728 as part of Caroline County, where John Hurt for several years served as constable, estate appraiser and general minor factotum of the ...Circuit Court. In 1733, he is reported to have served "King" Robert Carter of Lancaster Co. as overseer of a large tract of land in Caroline Co. Pet. Jno. Anderson vs Jno. Hurt, Judgement granted Anderson 9 Aug 1733 - Caroline County Court Order Book 1732- 1740, pg. 101. On 11 Oct 1733, County Levy Jno. Hurt Constable 223 pounds tobacco. Ibid pg. 105. Two entries for John Hurt from the Caroline County, Virginia court: (1) John Hurt served on the jury 8 Oct 1736, Ibid., pg. 375-376 (2) John Hurt was Constable 12 Nov 1736, Ibid. pg. 380. At a court held 12 Nov 1736, John Hurt, Constable stated the levy on tobacco at £3.22 and £3.27. Caroline County, Virginia Court Order Book 1732-1740, pg. 453. 11 May 1739 - "Wm. Evans, Robt. Jones, Wm. Oliver and Jno. Hurt Constables appointed by action of Assembly for further cont. and amending action for amending the staples of tobacco and preventing frauds in His Majesty's customers; also by action for better preservation of the deer and preventing unlawful hunting." Ibid. pg. 532. 8 Apr 1743 - "In the action of Trespass, assault and Battery between Robt. Lyon plt and John Hurt Constable deft - Jud is granted to the plt by then hil dicit unless the said deft do appear and plead next Court". - Caroline County Court Order Book 1741-1746, pg. 169 13 May 1743 -"The action of Trespass, assault and Battery between Robert Lyon plt and John Hurt Constable deft is dismissed being agreed." - Ibid. pg. 184. 24 Sep 1752 - On information John Hurt Constable and Zackary Lewis present Robert Powell and Drury Smith. Caroline County, Virginia Court Order Book 1746-1754, pg. 343. 11 Oct 1753 - Moza Hurt and John Hurt made oath that hey have done their duty as Constables. - Ibid, pg. 431. On 12 Jun 1760, the court ordered John Hurt, Sen. be levy free. This was usually granted to the very aged so that they were not required to pay taxes. Caroline County, Virginia Court Order Book 1759-1763 pg. 144. 12 Nov 1762, Caroline County, Virginia, John Hurt Jr. failed to appear as witness - fined 350 pounds of tobacco. Court Order Book 1759-1763, pg. 381 15 Jun 1765, John Hurt, Sr. (constable, now aged) and John Hurt, Jr. of Caroline County, Virginia appeared at court. See Court Order Book 1765-1767, pg. 93, 210. George Magruder Battey III believed that this John probably died in Prince Edward County where he went with his daughter, Tabitha and her family.
