a. Note:   I have a marriage record for a Johann Niclas Weinerth widower from Hussloch who married to Anna Clara, widow of the deceased Hennrich Christoph Maurers. They were married in Friedelsheim, Germany on February 14, 1747. This info comes from the IGI of the LDS church. Johan Nicholas married Anna Clara Maurers a widow of Hennrich Christoph Maurers of Friedelsheim whom she had married 3 years previously. Many people gave me the information which they had researched over the years, and which I have been working to verify. In the process of verification I have come across new evidence on the Ancestry of Johan Nicholas Weinert. I look forward to hearing from other researchers about this new information. Questions and comments are very welcome and will be appreciated. The Weinert/Vineyard Will: There has been much debate over the years about a Will of Johan Nicholas Weinert. I believe that I have found the correct estate record for him dated 1786 in Berks county, PA. I will attach a copy of this estate record for your review. I also will explain my reasoning that this is the correct estate record, and the reasons why the 1759 Will and the 1771 Will cannot be the correct Wills for our Johan Nicholas. The Will of 1759 is widely accepted as the correct Will for Johan Nicholas Weinert. There are several reasons why I do not accept this Will as that of Johan Nicholas. It was written too early. Family records have established that the sons of Johan Nicholas Weinert were born in the 1750's. If this is true, then this cannot be the Will of Johan Nicholas. This Will was cleared by the orphans court, which meant that there were no dependant children who needed to be assigned guardianship. If there had been dependant children, then this should have been taken care of with a document from the Orphans court. Some have suggested that perhaps family members took in the children, which I do not believe to be a reasonable explanation. If the court took the trouble to handle the Will at all, then likely they would not have skipped over such an important task as documenting the guardianship of minor children. In addition; this Will is that of a John Vineyard. There is no evidence that this John Vineyard ever went by Weinert. Some have stated that he did, but no document proves such. There is however a note in the history of Orange County, VA which tells of a John Vineyard who arrived abt. 1730 from England and who was of English descent. Notes from several people indicate that that John Vineyard paid taxes in VA as early as 1728 and one John Vineyard singed an oath of importation June 17, 1735 in VA. A John Vineyard appeared in court in order to settle charges of the purchase of a house and saddle that he had not paid for. I believe that all of this information listed here actually is evidence of the John Vineyard who arrived in VA and whose will is dated 1759. In the document of 1759 it is stated that the estate of John Vineyard was to be appraised and sold to pay off debts. This would be consistent with the man who earlier had been sued over failure to pay for a house/horse and saddle. The Will of 1759 is also written in English, which is not consistent with what we know about the Weinert family. In fact Johan Nicholas's son Christian had a Will written in Old German which was difficult for the traslators. It is more likely that if Christian had a Will written in German that the primary language of the family was German and that his father also would have used German. It is noted that one clue in the 1759 Will is the fact that a Christopher Winger purchased something from the estate. In fact; if that had been our Christian Weinert, he would have been a child and would not have been old enough to be purchasing anything from an estate and certainly would not have had to purchase from his own father's estate. In fact, there is evidence of a Christopher Wenger who lived in the same area as John Vineyard who likely is the purchaser of the estate. See notes on the Wenger Will of 1771 in next paragraph. Many researchers who previously had questioned the 1759 Will, believed that the 1771 Will of Lancaster PA was a more likely choice to be the Will of Johan Nicholas Weinert. In fact, there is more evidence to show that the 1771 Will is that of Johan Wenger. Evidence supports that it is. The following information on the Wenger family came to me from a Wenger descendant. Johannes/Hans Wenger b. 1705 in the Bernese area of Switzerland. Several authors give that he was born at Bern. It is widely held that Hans married Anna Shirk, 1705-1771, the daughter of Casper Shirk (Sherrick), 1710-1770 who later sold Hans his original property. This has not been verified and the approximate dates for Anna and Casper would indicate otherwise. A note in the papers of NWN state the fact that he married Anna Shirk is recorded in Casper's Bible and that the marriage took place in Europe. It is not clear who Casper is. It is assumed that Casper is Ann'a brother and not her father. This is consistent with Hans buying land from "his brother-in-law" and not his "father-in-law". The marriage recorded in the bible was about 1727. They left Switzerland due to religious persecution and settled in about 1744 in Zweibrucken of the Lower Palatinate on the Rhine. They were Mennonite. Some have reported that all of his children were born in the Palatinate, but this requires that he would have arrived at an earlier date. The 1744 date would mean that all of his children were born in Switzerland. He arrived at the age of 43 in Philadelphia on Sept. 16, 1748 via the Ship Paliena (Patience), John Brown Master from Rotterdam, last from Cowes. He traveled with his children Stephen, (age 20), Christian, (gae 18), Judith (age 16), John (Hans) (age 16), Maria (age13), Henry (age11), Abraham (age 8) and Martin (age 6). The family settled in Bethel Township (now Swatara Twp., present Jonestown, Lebenon Co. which was originally Lancaster county PA) The farm that he settled on in 1749 is stated as being 125 (possibly 175-see below) acres and was purchased for $125.00 from Casper Shirrock (Shirk, Sherk, Sherrick) (1710-1770) who bought the land in 1740 from John Penn, Thomas Penn, and Richard Penn who were sons of William Penn. Warrent #250 Bureau of Land Records- Harrisbur, PA Oct 5, 1738 To Casper Sherk for 200 acres on Swatara Creek in Bethel Twp., Lancaster (now Lebanon county) surveyed March 31, 1740 for 170 acres. Patented (Pat. A120-279-29) to Casper Sherk on Nov. 29, 1745. Signed by Thomas Penn, son of William Penn. Nov. 1 1749 Deed P-94-Lancaster Co., Casper and Magdalena Sherick sell land of 170 acres to John Wenger. Neighbors were Nicholas Youngblood, Peter Lane, George Hauck and Jacob Miller. Same land as in Warrant #250. On July 3, 1767 John Wenger of Bethel Twp., Lancaster Co. sold to son John 62 acres, 76 p. for $373. 6s. S.P. (bounded by John Wenger and Stephen Wenger). On July 3, 1767, John Wenger Sr. sold to Stephen Wenger 2 1/2 acres, Stephen Wenger willed above to his on Johnand wife. On June 16, 1800, John Wenger of Dauphin Co., Bethel Twp. sold 179 acres, 52 perch to Jacob Wenger for $800 in gold and siver. On June 6, 1816, John Wenger and Anna his wife sold 2 1/2 acres to Jacob Wenger and Anna his wife for 125? being tract Stephen boughtof John Sr. on July 3 1767, and which he willed to his son John b. 1778 d. 1857. Wife, Barbar Wolf became the owner of the homestead tract and his descendants maintained possesion for many eyars. It was perhaps owned by John L. Wnger in 1900. The farm then purchased by the Yoder family. The original deed and instruments of transfer were in the possession of Mrs. Lizzie Wenger Boud, G140533 of Jonestown in 1970. The current location of this deed is unknown. Site of the farm on elevation overlooking the fertile valley of Big Swatara Creek. Wenger Cem. is situated on the northwest corner. Wenger meeting house is now built there. Some of Dwight Eisenhower's relatives are buried in this cemetery. Han's brothers, Christian, Michael, arrived with their widowed mother Hannah in PA on Sept. 9, 1749 and settled in Rapho Township, Lancaster Co., PA. His father, a weaver, lived and is buried in the Canton of Bern, Switzerland. The number of his offspring was corrected from the earlier records and is reflected here on his memorial stone placed in the Wenger cemetery in 1994. His will was dated Sept. 15, 1771 and probated June 1, 1772 so his date of is sometime between these two dates. His son John was executor. Hans is no doubt buried in the Wenger Cem., but no stone exists. It is thought that he and Anna are buried under the current wall of the Wenger meeting house which is sagging under a window area. It is thought that the sagging is due to the earth having been excavated for the graves. It is reported that while the church was being constructed, the grave was exposed, but they continued with the construction. As you can see from the Wenger family history; the family is well documented in birth and land records. The Will of 1771 in fact lists the name of children of the deceased and these names are consistent with those of the Wenger family. See copy of attached Will of 1771, and related documents. I have located an Estate record in 1786 in Berks county, Pennsylvania which is a more likely choice to be that of Johan Nicholas Weinert. The spelling of the surname matches the surname as given in the marriage record for son Christian who married in 1774 in The Reformed Lutheran Church in Frederick county, Maryland, and who gave his father's name as Johan Nicholas Weinert . If fact in that document lists Christian himself as a Weinert, indicating to me at least that the family was still going by Weinert. I now believe that other records showing Christian listed as a Vineyard prior to 1786 are in reference to a different man by that same name. My next project will be to develop evidence to show this. In any case; in 1774 Christian did list his father as Johan Nicholas Weinert. We know that the family was German and that at least Christian attended the Reformed Lutheran Church at the time of his marriage. Please see attached Estate Record of 1786. This document shows that the wife of the deceased, Nicholas Weinert, was named Clara Weinert. Assisting her in the administration is a John Schnell and Peter Ermolt. More info on these two men follows. This document, written in English shows that Clara herself was likely illiterate as she signed only with a mark. The signing with a mark is consistent with the way Johan Nicklas Wyner signed the Oath of Importation declaring that he had arrived in PA aboard the ship Dragon in 1749. The mark itself is not proof, but it does give a possible clue. I suggest that because Clara signed with a mark rather than a signature that the clerk of the court most likely had the document translated for her and simply used English because it didn't matter since Clara couldn't read English or German. It was simply a required proceedure to identify the deceased and assign someone to divide the estate. There is no mention of any children in this record because they were now adults. They did not require guardianship and the court didn't care one way or the other who received anything from the estate. They simply assigned Clara to divide the assets and closed the case. The Germany Connection A Johan Nicholas Weinert/Weinerth married June 5, 1747 to Anna Clara in Friedelsheim, Germany. The marriage took place in a Reformed Lutheran Church which is consistent with other evidence of the family attending this church in America. In the marriage document it is stated that Johan Nicholas Weinert was a widower from Haslcoh, Germany and that Anna Clara Maurers was the widow of Hennrich Christoph Maurer, whom she had married in 1744 (3 years previously). The marriage of a Johan Nicholas Weinert to Anna Clara in Friedelsheim matches the names of the estate record of 1786 in which Nicholas Weinert deceased, is named with his wife Clara. I have now located the birth record for John Weinert/Vineyard, and Jacob Weinert/Vineyard sons of Johan Nicholas Weinert. We already know that Johan Nicholas Weinert had sons John and Jacob. I still need to locate the birth record for Christian, and I'm looking. Name: Weimert, Johannes Description: Baptized Event: Baptism Date: January 1759 Place: York Co., PA Name: Weinnet, Niclaus Description: Father Event: Baptism Place: York Co., PA Name: Weinnet, Anna Clara Description: Mother Event: Baptism Place: York Co., PA Name: Weinnet, Johan Jacob Event: Baptism Date: May 1761 Place: York Co., PA Name: Weimert, Niclaus Description: Father Event: Baptism Place: York Co., PA Name: Weimert, Anna Clora Description: Mother Event: Baptism Place: York Co., PA This information also shows that a Johannes Schauer and wife Anna Maria were sponsers of the baptism of Johannes Weimert and that Peter Wannert is the sponser for the baptism of Johan Jacob in 1759. The baptisms are recorded in York County, Pennsylvania Church Records, 1744-69: Jacob Lischy's Private Pastoral Record. Surely there is some connection between Peter Wannert and Johan Nicholas Weinert. The parents to Johan Weinert and Jacob Weinert match the names of Johan Nicholas Weinert and Anna Clara from the Berks county Will, and from the marriage record in Germany in 1747. Descendants of Christian Weinert/Vineyard indicate that verbal history says he came from Lancaster county PA. Kegleys Virginia Frontier comfirms this. In addition it states that Christian's wife Christina Tabler came from Berks county, PA. This information places Johan Nicholas Weinert in the area of Lancaster county PA prior to 1774. Parts of Berks county PA as well as York county PA were at one time part of Lancaster county PA which give evidence that the birth records as well as the estate record all relate to the family of Johan Nicholas Weinert, father to Christian, John, and Jacob. The one son John, known to have served in the Rev. War enlisted in PA. I believe that all of the above information indicates that our Johan Nicholas Weinert was in fact the man who arrived in 1749 aboard the ship Dragon. The ship register recorded only the adult males although many other people were counted onboard. If Anna Clara came with Johan Nicholas in 1749, two years after their marriage in Freidelsheim, Germany then she would have been counted as a passenger, but her name would not have been on the register. This town can be located on the map only a couple of miles from the town of Friedelsheim where the marrige took place for Johan Nicholas Weinert and Anna Clara in 1747, and the town of Hassloch, where according to the marriage record of Friedelsheim, Johan Nicholas was from. It appears that these families may have traveled together to Lancaster county, PA aboard the ship Dragon in 1749. Additional evidence can be found in the birth record of one Johan Nicholas Weinert of Hasloch Germany recorded in the Reformed Lutheran Church Register there. One Johan Nicholas Weinert, son of Johannes Conradt Weinert and Marguarita Pabst b. 10 Feb. 1716 and christened 16 February 1716 in the Reformed Lutheran Church of Hasloch. Johanna Conradt is a name that has come up over the years. Several researchers note that the name comes from the Virginia History Room and is a reference to the spouse of Johan Nicholas. No evidence exists to prove this piece of information. Researchers have tried to locate the supposed record which cannot now be located. However as I review this piece of information it appears to me to have some possible truth to it. The name must have come from somewhere. I suggest that the name of Johanna Conradt is NOT the name of the spouse to Johan Nicholas, but rather the name of his father, Johannes Conradt Weinert of Germany. The information could easily have become confused over the years. This information matches the birth record of 1716 in Haslcoh, Germany where a Johan Nicholas Weinert, son of Johannes Conradt was christened. A marriage record dated May 7th, 1741 in the Reformed Lutheran Church of Hassloch, Germany shows Johan Nicolaus Weynerth/Weinerth (both spellings occur in the same document) is the son of Johan Conradt Weinerth and Margaretha Pabt. On May 7th 1741 Johan Nicolaus married to Maria Elisabetha. A year later in 1742, Johan Nicolaus and Maria Elisabetha became the parents to a Johan Jacob. By 1743 another child was stillborn to this couple; but apparently Maria Elisabetha died from childbirth and the child was christened stillborn. The record is difficult to read- but may say Johan something? By 1747, Johan Nicholas married Anna Clara Maurers a widow of Hennrich Christoph Maurers of Friedelsheim whom she had married 3 years previously. Johan Nicholas was listed as a "widow of Hassloch". I believe that our Johan Nicholas Weinert is the man who married Anna Clara in Friedelsheim, came to America in 1749 and later died in Berks county in 1786 leaving behind his wife Anna Clara who signed the estate record with her mark. Certainly this Nicholas Weinert and Anna Clara are the parents to John born in 1759 and Jacob born in 1761 in York county PA who are most likely the brothers to Christian Weinert/Vineyard.
