He moved to Woodward, Oklahoma with family and he died there 1 Apr 1905. Mary Elizabeth Troxell was born 21 Dec 1836 in Martinsville?? Ruby Wattenbarger says her grandpa David and wife Mary Ellen came to MO from Indiana for health reasons. He was sick so much in Ind...Has swamp fever. Her dad told her this information. Finchum was plaintiff and Mary E. Warren, Samuel Finchum, Robert Finchum, Jessie Finchum, Sarah Busick, Ray Finchum, Cyrus Finchum, John Finchum, Albert A. Smith, Minnie Shatto and Sarah Thomas were defendants, judgement was rendered in said court in said action is in favor of plaintiff and against said defendants as follows to-wit"State of Oklahoma County of Harpr SS. Know all men by these presents: Whereas David M. Finchum on the 15th day of February 1910 obtained a decree in the district court in and for Harper County State of Oklahoma, against Mary E. Warren, Samuel Finchum, Robert Finchum, Jessie Finchum, Sarah Busic, Ray Finchum, Cyrus Finchum, John Finchum, Albert A. Smith, Minnie Shatto and Sarah Thomas defendants, that the plaintiff is entitled to and is seized in ........... and each of the following named six defendants are entitled to and are likewise seized in fee simple of an undivided one-ninth interest in and to the following described lands to-wit the North east quarter of Section Thirty-one in Township Twenty Five North of Range Twenty, West of the Indiamn Meridian in Harper County State of Oklahoma said six defendants who being Mary E. Warren, Samuel Finchum, Robert Finchum, Cyrus Finchum, John Finchum and Sarah Busick and that each of the following names\d beinf defendants are entitled to and are seized each for himself of undivided one-eighteenth interest in said lands to-wit: Albert A. Smith and Minnie Shatto, and the following names defendants are entitled to and are seized in fee simple of an undivided one-twenty-seventh interest in said land, to-wit: Ray Finchum, Bessie Finchum, and Sarah Thomas, and that partition of the said lands should be made as prayed for in said petition of plaintiff and that B. C. Williams, J. A. Robertson and J. L. Wooden were appointed commissioners to make partition of said land in accordance with the shares of the respective parties as herein found and determined by the court in said decree if the same could be done without injury to said estate and make reoort of their findings in that behalf to the said court, and whereas on the 6th day of June 1910, the said commissioners, so appointed having made their report that said lands could not be divided without manifest injury to said and having returned their appraisement of said land as required by law and the court being satisfied with the said report and having confirmed the same and the same was to be made official in and court and it was therefore furthert made and decreed by the court that .........of the parties. The said action shall exist to take the said lands at the appraisement thereof and to be returned. then that an auction sale be .... the sheriff of said Harper County directing him to sell said land in open ..xecition and make return thereof to said court and none said parties having elected to take residence .. such appraisement of said land having been on said .date ..returned into court according to law on said last named date, it eas by the court on the ..th day of June 1910 ...that said appraisement ..turn. the said commissioners be and the same was approved and confirmed. ,,Whereas on the 6th day of June, 1910, an order of sale issued out of said court on said judgement direted to the sheriff of Harper County State of Oklahoma commanding him ..due..and sell at public auction said real estate and all the right ... interest and equity of redemption of said plaintiff and defendants in and of said property..is case of sales at real estate in ..caution with appraisement and to return such unit into court according to law and show by his ... what he has done with it:................. ........... ................... appraisement of said property at $ 2,000 and upon recipt of said appraisement the said sheriff deposited a copy thereof with the clerk of said court. And thereon. the said sheriff then advertised said real estate for sale as directed in said order of sale, causing notice to be published in the Harper County Democrat, a weekly newspaper published at Buffalo in Said Harper County and of General circulation in said county for more than thirty days immediately preceeding the first day of August, 1910 the day fixed for said sale in said notice, that he would on the 1st day of August 1910 at the hour of five (?) o'clock in the afternoon at the front door of the court house in said Harper County offer for sale to the highest bidder for cash to said real estate and all the right title, interest and equity of redemption of said plaintiff and defendants in and to said real estate. And Whereas on the 1st day of August 1910 at the time and place mentioned in said notice the said sheriff did offer for sale and sold at public auction to H. P. Kent for the sum of $1365.99 cash in hand, the said real estate with all the right title, interest and equity of redemption of said plaintiff and defendants in and to said real estate, to the said K. Kent being the highest bidder ...at said sale and his said bid being more than two thirds of the value of said real estate as fixed by said appraiseal and commissioners. And Whereas on the 1st day of August, 1910 the said sheriff duly returned into court said order of sale with his proceedings. the court duly ... ....... by said ... the 5 day of September, 1910 after having carefully examined said proceedings of said sheriff and being .... that the said sale in all ...have been made directed the clerk of said court to mark an entry in the journal thereof that said court is satisfied with the ..nity of said sale and that said sale to and the same is hereby approved and confirmed by the court and the said sheriff of Harper County State of Oklahoma make the purchase of said property so purchased as aforesaid and such entry and order was therefore duly made and entered respectively. Beeman, the sheriff of said county of Harper in consideration of premises and the said sum of money paid to me as aforesaid by said purchaser by virtue of the power in me vested by law as said sheriff do duly sell and ... convey unto the said H.
