Notes
a. Note:   Armistead must have been the next to the youngest child of his parents James Jones Waggener and Elizabeth Garnett, and their youngest son. From the census records below, I have determined that he must have been born between 1802 and 1804. His parents were living in Culpeper County, Virginia at the time, so he must have been born there. His parents moved to the area of Todd County, Kentucky just after the census in 1820, and it seems likely that Armistead moved with them. In the record below from 1822, he seems to have gone to to Jefferson County, if for nothing else than to help the wife of his brother James, deal with the death of her husband. Armistead seems to be back in Todd County in 1825, where he married Martha Jane Street. He also is listed on a couple of other deeds there in 1825, apparently involving some money he borrowed in lieu of his inheritance from his parents. Armistead is also listed on the census in Todd County in 1830, apparently with his wife Martha and three children. I do not know the names of any of their children and do not have any further substantive information about what became of Armistead and Martha. I believe that there is a possibility that they moved to Scott County, Missouri, and I have found a series of records there which I believe may be them, and which I list below, but which I feel unable to firmly prove at this time. Rick Waggener =============== In the 1820 Virginia Census of Culpeper County, Virginia, page 103; found at ancestry.com image #37 of 53, Armistead seems to be listed in the household of his father, "James Waggoner," as 1 male 16-18 years and 1 male 16-25 years, ============== The following record was taken from the Kentucky Earlier Settlers, the Records of Jefferson County, Kentucky; from the Filson Club History Quarterly, Genealogical Publishing Co., Inc., 1988: ****** From the Calendar of Early Jefferson County, Kentucky Wills; Will Book No. 2, pg. 193: Will of James Waggener, dated July 27, 1822, proved October 15, 1822, recorded November 18, 1822. To brothers, Armstead and Reubin Waggener, estate, in trust, for wife Elizabeth and her three children George, Mary and Elesis Waggener. Executors: None named. Witnesses: Ben W. Johnston, William Lewis. This would seem to show that Armistead was in Jefferson County, Kentucky in 1822. He apparently moved to Todd County, Kentucky sometime between 1822 and 1825. ============== From the Todd County, Kentucky Tax Records, Tax books 1820-1830, 1833-1835, 1837-1839; FHL US/CAN Film (8241) Armistead is listed in the following records: ***** 1823; Waggoner, Armstead; page 52, 1 white male over 21, 1 horse, total value- $50 (Armistead is listed directly below his brother Stokeley.) ***** 1824; Waggener, Armstead; page 57, 1 white male over 21, 0 total value ============== From Dodd, Jordan. Kentucky Marriages to 1850. [database online] Provo, UT: Ancestry.com, 1997. Electronic transcription of marriage records held by the individual counties in Kentucky: Kentucky, Todd County Street, Martha Jane married Waggoner, Armstead on 06 Jan 1825 in Todd County, Kentucky ============= From a series of records gathered by Frieda Winkley in Todd County, Kentucky. From Todd County, Kentucky Deed Book D, page 245; Frieda noted, "concerns Armstead Waggoner and debt of $484." ---------------------- From Todd County, Kentucky Deed Book D, page 246, dated November 7, 1825; "Armstead Waggoner deed to A. F. Read all Negroes in his inheritance from his father's estate. Signed. Recorded August 14, 1826." --------------------- From the Todd County, Kentucky Deed Book D, page 128; dated December 12, 1825: This agreement between Elizabeth Waggoner, Fanny Kay who was Fanny Waggoner, James Kay and Sarah his wife, who was Sarah Waggoner, Robert Menefee and Polly his wife, who was Polly Waggoner, Robert G. Waggoner, James Waggener, Richard Waggoner, Reuben Waggoner, Stokely T. Waggener, Anthony F. Read, who is assignee of Armstead Waggoner, claiming his part by purchase and Thomas I. Walker and Eliza his wife who was Eliza Waggoner all heirs and representatives of the Estate of James Waggoner, dec'd...." (This document involves Armistead's mother, Elizabeth (Garnett) Waggener, dividing and distributing the estate of her and her husband James Jones Waggener, amongst their children. It had been bequeathed to Elizabeth in James' will in 1821. It appears that all three deeds listed above are related and that they seem to show that Armstead had borrowed money from Anthony F. Read, in exchange for his inheritance. I don't have any other details and can only speculate about the circumstances of this situation. Since Armistead had married earlier in the year, perhaps he had purchased property. Another interesting feature of this deed is that is appears to list the children of James and Elizabeth Waggener in the order of their birth. This supports the fact that Armistead was the next to the youngest child, and that the birth date that I have determined for him, between 1802 and 1804, is probably accurate. - Rick Waggener) ============= From the Todd County, Kentucky Tax Records, Tax books 1820-1830, 1833-1835, 1837-1839; FHL US/CAN Film (8241) Armistead is listed in more records: ***** 1826, Waggener, Armsted, page 54, 1 white male over 21, 2 Blacks total, 1 horse, 92 acres, value $4.50 an acre, total value- $864 (Armistead clearly seems to have benefited from his mother's distribution of the estate.) ***** 1827; Waggoner, Armstead, page 87, 1 white male over 21, 2 horses, 80 acres on West Fork?, total value- $308? ***** 1828; ????, Armsted, page 86, can't read land, 1 white male over 21, 1 Black over 16, 3 Blacks total, 1 horse, total value- $650 ***** 1829; Waggoner, Armstead, page 91, 1 white male over 21, 1 Black over 16, 3 Blacks total, 3 horses, total value- $750 ***** 1830; Waggener, Armstead, page 90, 1 white male over 21, 1 Black total, 3 horses, total value- $325 (Armistead is listed just below the record of his brother-in-law, Iverson Walker. Since there is no subsequent tax record in Todd County for Martha Waggener, I think they probably moved. I found a series of records that I think may be Armistead and Martha. The first is a census record in 1840 in Scott County, Missouri. The next is a census record from 1850, also in Scott County, but for a "Martha Waggoner," living with children Henry and Elizabeth. Then I think I found what I think is Martha again in the 1860 census, in Alexander County, Illinois, in the home of H.G. Waggoner. I am not sure that this is sufficient evidence to prove that this is Armitage and Martha and their family. I am going to enter the information here into the notes, but I am not going to change the file at this time. Although I don't know why Armistead would have gone to Scott County, because I don't know of any other relatives who went there. However, Armistead's older brother Robert Garnett Waggener moved to New Madrid County, Missouri in about 1825, which is just south of Scott County.
