a. Note:   John's first wife, Deliverence, lived but a short time after their marriage. An interesting document located in the N. H. Records and Archives in Concord, N. H. is the will of John Leavitt, Deliverence's first husband. This will was witnessed by three people including John Nay, Jr. and contains John's signature. It was witnessed on 23 December, 1726, about six months prior to the marriage of John and Deliverence on & June, 1727. There was evidently some question about the circumstances involved as the Register of Deeds, Benjamin Gambling, required the other two witnesses to appear before him and testify under oath that John Leavitt was of sound mind at the time the will was executed. Will of John Leavitt, Hampton In ye name of God Amen this 23 Day of December 1726 I john Leavitt of Hampton in ye Province of New Hampshire in New England Being now weak in Body but of sound Perfect memory Praise be Given to God for ye same and knowing ye uncertainty of this life; on Earth & being Deserves to settle things in order Doe make this my last Will & testement in manner & Form Following: yet is to say, First & Principly I commend my soul to Allmight God my Creator, assuredly believing yet I shall Receive Full Pardon & Full Remission of all my sins & be saved by ye Precious Death & merits of my Blessed Savior & Redeemer Christ Jesus & my Body to ye Earth From Whence it was taken to be buried in such decent & Christian manner as my Executors here after Named shall be thought meet & convenient; And as touching such worldly Estate as ye lord in mercy hath lent me, my will & meaning is yet ye same shall be Imployed & bestowed as here after by this Wills by be formerly made & Declare & appoint this my last Will & testament. Imprivins I give unto my Beloved wife Deliverence ye improvement of my Estate both Real & Personal. But two small pieces of Land; Which lyes on ye Falls side of ye town in ye West Division undivided With ye land of my Cousin Thomas Leavitt, these two pieces of land I Dont se cause to will away to any Person. My wife is to Improve my Estate until my Daughter Deliverence be Eighteen years old or until she be married. And then my Wife is to improve one half of all me Estate & if my Daughter should Dye before she be married then my wife is to improve all my Estate both Real & Personal as long as she shall live. Item: I give unto my Daughter Deliverence ye improvement of one Half of all my Estate Both Real & Personal as sone as she is married or when she is Eighteen years old & ye other half of all my Estate at her mother"s Dearth And if my Daughter have a male Heir of her own body, then I give unto him after his mothers Decease all my Estate Bouth Real & Personal; unto him & unto his heirs forever. And if my Daughter Deliverence Dye without a male Heir of her own Body; then I give all my Real Estate unto my Cousin Thomas Leavitts Eldest son John & unto his heirs forever the John Leavitt which I mean is grandson to my Brother Chrites Leavitt, And I doe appoint Capt. Jabez Smith & my above Named Wive Deliverence to be Executors to this my last Will & Testament & in Confirmation hereof I have unto set my hand & seal ye day & year above mentioned. Memd Capt Smith disaccepts ye Executorship Memd Ye Widow married Mr. John Nay after ye Warrt of Apprsmt of ye Probate of Will August 8, 1727. Thomas Elkins & John Dearborn Personally appearing made oath that they were present & saw John Leavitt Deceased Sign & Seal ye aforegoing Will & declaring ye same to be his last will & testament & yet he was of sound Desparing mind at ye doing thereof & also that John Nay Junior was Present & signed with them as witness thereto. Benjamin Gambling, Regr. John Jr. took as his second wife, Elizabeth Ladd, daughter of Daniel Ladd and Mehitable Philbrick Ladd. They were married on 21 December, 1731. Elizabeth was born on 11 February, 1716 and died on 2 March, 1781. John Jr. settled first on the homestead of the late Samuel Mace but returned to his paternal
