 Last Will and Testament of James Wallace, Lawrence County AL, 4 June 1858 Note: There are two handwritten editions: one apparently written by him and another more clearly written, but missing a middle page. Relatives and friends mentioned in the will are: Brothers: Isaiah Wallace (gifts to sons James and William T.), Jeremiah Wallace, William H. Wallace Sister: Elizabeth Harrison (to her children not named), Nancy (to her son William Stephens/Stevens) Cousins: Franklin Wallace (Benjamin Franklin Wallace, son of Davis Wallace); Kirk Wallace (William Kirkland Wallace, son of John Wallace). Unknown Relationship: Tranquilla Wallace (slaves to be held by Isaac or James Wallace [first name is overwritten] until she is of mature age) Friend and Executor: $200 to H.L. Stephenson [Hodge L. Stephenson]. Also appoints H.L. Stephenson as sole executrix/executor of the estate. A newspaper article citing his death indicates that James Wallace never married. Friday June 18, 1858

STEPHENSON, as Executor of the Last will and Testament of James WALLACE, deceased, and filed his application, setting forth, that on the 8th day of June, 1858, James WALLACE, late of said county, after making and publishing his last Will and Testament, departed this life, and by a provision of said last Will and Testament, appointed and constituted him the Executor thereof....The following named persons are the heirs at law of said Testator to wit: William H. WALLACE, of Franklin County (AL), Barton P.O., Jeremiah WALLACE, of Cherokee county, Texas, Rust P. O., James HARRISON, Isaiah HARRISON, Barnes P. O., Tishomingo county, Mississippi: and three other children of Elizabeth HARRISON, deceased, who was a sister of said Testator, whose names, ages & et. are unknown to this proponent, and who reside in Cherokee county, State of Texas, James WALLACE, William T. WALLACE, and Thos. D. WALLACE, sons of Isaiah WALLACE, deceased, who was a brother of Testator, and three daughters of ISAIAH, names and ages not known, who reside in Winston county, Mississippi, Websterville P.  This shows that Hannah Wallace is the widow of Davis Wallace, who died about November 1840 in Lawrence County AL since his widow Hannah Wallace applied for and was appointed administrator of the estate during the December 1840 term of the court. That page also indicates another matter which was continued from the November term. Bond was made by Guy W. [actually George W.] Wallace and James Phelps. It also names five men appointed to appraise the estate, the first being Hodge L. Stephenson, this being the H.L. Stephenson mentioned in the 1858 will of James Wallace.  The 1860 Slave Census shows "Frank Wallice" owns one 57-year old black female and one 52-year old black male. These are, respectively, Matty and Paris, who were bequeathed to him by his cousin James Wallace in 1858. Kirk Wallace is listed as another cousin and beneficiary of James Wallace in 1858.  This states William and Bluitt's mother was Mary M. Gibson [who may possibly a sister to Isaac Wallace's wife Sarah Gibson]. It also shows William K. Wallace's parents were John Wallace, 1770 – 1842, and Jane Blackburn, 1779 – 1844, who married 22 May 1798 in Blount County TN. John Wallace appears in the 1830 and 1840 Lawrence County AL census.  William K. Wallace's obituary states he was born 30 Mar 1819 and died 22 Sep 1911 and that he married three times. It also indicates Hannah was his wife when he died and that his father died when he was very young. No record of any wife other than Mary Gibson and Hannah Pearce was found. Probate records show the estate, which was administered by son "Bluit P. Wallace," was valued at about $30 thousand dollars. 1850 Lawrence County AL census
